NOTIFICATION
No. Rule/P.3601/2022.— The Hon’ble the Chief Justice and the Judges of the High Court are
pleased to direct that the following amendment shall be made in Chapter I of the Bombay High
Court Appellate Side Rules, 1960 (Reprint 1981) :—
The following new Rules 9(A) to (C) be incorporated after existing Rule 8.
“9 (A).—  Whenever one Division Bench shall differ from the decision of any other
Division Bench upon a point of law or usage having the force of law, the case shall be
directed to be placed before the Chief Justice for decision by a larger Bench. In such a case
of difference of opinion on a point of law, the Division Bench referring the case shall state
the point on which it differs, formulate the question or issue to be answered and refer the
case to the Chief Justice for decision by a larger Bench.
(B)  If the question arises in an appeal from an original decree, the questions of law
shall alone be referred, and the larger Bench shall return the case with an expression of its
opinion upon such points of law for final adjudication by the Division Bench which referred
it, and in case of necessity in consequence of the absence of any or either of the referring
Judges, for the ultimate decision of another Division Bench.
(C)  The provisions in sub-rules (A) and (B) of Rule 9 shall apply Mutatis Mutandis to
Single Judges.”

NOTIFICATION
No. Rule-P.3601/2022.— The Hon’ble the Chief Justice and the Judges of the High Court are
pleased to direct that the following amendment shall be made in Chapter XV of the Bombay High
Court Appellate Side Rules, 1960 (Reprint 1981) :—
I
Delete the Sub-rules (7) and (8) of Rules 3 (iii) of Chapter XV of the Bombay High Court Appellate
Side Rules, 1960.
II
Insert the following sub-rules (8) and (9) to Rule 3(i) of Chapter XV of the Bombay High Court
Appellate Side Rules, 1960.
(8)  Original memoranda of appeals, and cross objections, and original revision applications,
references and applications for review, without annexures.
(9)  Applications under Articles 226 and 227 of the Constitution without annexures.

NOTIFICATION

No. G/amend/1077/2022.— The Hon’ble the Chief Justice and the Judges of the High Court are
pleased to direct that the following amendment shall be made in Chapter I of the Bombay High
Court Original Side Rules, 1980 :—
The following new sub-rules 28(A) to 28(C) be incorporated after existing Rule 28.
“28 (A).—  Whenever one Division Bench shall differ from the decision of any other
Division Bench upon a point of law or usage having the force of law, the case shall be

pleased to direct that the following amendment shall be made in Appendix III of the Bombay High
Court Original Side Rules, 1980 :—
I
Delete the rules D (iii) and D(iv) of Appendix III, Part I of the Bombay High Court Original
Side Rules, 1980.
II
Insert the following sub-rules 3(iv) and 3(v) to Rule (A), Appendix III, Part I of the Bombay High
Court Original Side Rules, 1980.
(iv)  Memo of appeal without annexures.
(v)  Memo of cross-objections without annexures.
III
Insert the following sub-rule 8 to Rule (A), Appendix III, Part I of the Bombay High Court
Original Side Rules, 1980.
(8)  Petitions under Articles 226 and 227 of the Constitution without annexures.
