Sub:- Registration and Stamps Department - Registration of Undivided Share
of land (UDS) - Irregularities noticed - Earlier orders reiterated - Reg.

It has been brought to notice that few builders/developers/promoters/
individuals are offering built up area in the guise of undivided share (UDS) of land
in projects, which are yet to be launched/constructed, at nominal/ discounted
prices. They are offering residential or commercial space in the form of UDS in
Proposed land for development. It is further informed that the amounts collected are
being diverted for other purposes without utilising for the said project. There is a
danger that the gullible purchasers may be defrauded if the project is not launched
or delayed or not at all constructed.
In this regard, attention is invited to certain instructions issued vide reference
1 and 2 cited wherein it was clearly stipulated that registration of undivided share
of land, must be accompanied by either duly approved construction agreement/
Agreement of sale (duly approved by competent authority) or development
agreement is respect of Apartment/Commercial space by paying necessary stamp
duty as per Article 6(B) of Schedule I-A of Indian Stamp Act, 1899.
Therefore all the registering authorities are advised to follow the aforesaid
instructions scrupulously. Inspecting Officers like Zonal DIG's etc,, shall ensure that
these instructions are strictly complied with.
