Abstract:

The tsunami of emerging advanced technologies brings with it the slump of exploitation of
advancements. The exploitation attracts similar criminal penalties as of the real world. The
metaverse, one of the most discussed ideas in contemporary technology, can be characterized
as a dynamic, immersive 3D virtual environment where users can interact and engage in a
variety of activities using avatars. These activities can include entertainment and gaming,
business and professional encounters, financial transactions, and even medical procedures
like surgery. It is already clear that the metaverse will present a variety of opportunities as
well as a variety of threats in a variety of policy sectors, even though the precise scope and
influence of the metaverse on society and the economy are yet unknown.

To its openness, anonymity, and accessibility, the Internet can be a shelter for people who
perpetrate violent acts there. The existence of established legal remedies for victims of other
behavioural patterns, such as organized grieving and cyber-rape, is obscure. One can analyse
cyberspace as a place based on the psychology of the constructed persona, and online
betrayals in the context of cases of virtual violence on social networking sites, immersive
games, and metaverses. The present paper deals with the legal issues and complexities around
the legal personality of avatars and applicability of real-world criminal provisions for the
different types of offences committed.
