hereinafter referred to as "the party of the second part " holding PAN
No.____________Aadhar No.___________(hereinafter called the Second
Party); (which expression shall unless it is repugnant to the context mean and include his legal
representatives, executors, administrators, and assigns)
AND
The parties herein are members of the same family and they are related to each other. The
party of first party is the senior member of the family. The party for second party is her
Daughter in Law. The party of the third party is her Son, and the party for the fourth party is
her Son.
Before the execution of these presents, the parties have been enjoying the following
immovable properties jointly:
The specific terms of the distribution of the said property shall be as under:
Mrs. Indra Kumari, W/o. Late Shri Fateh Singh, aged about 80 years, resident of
704, Ground Floor, Chirag Delhi, New Delhi-110017 is the absolute owner of Ground
Floor, as well as Roof of the said premises, till she is alive, and after her death Ground
Floor, and Roof of the said premises will be used as common space for any family
functions and common use and maintenance/renovation, etc. will be borne by all the
beneficiaries collectively.
Mr. Dinesh Kumar Sharma S/o. Late Shri Fateh Singh, aged about _____, resident
of 704, Second Floor, Chirag Delhi, New Delhi-110017, will be the owner of the
Second Floor of the said Premises.
Mr. Bhupendra Kumar Bhardwaj S/o. Late Shri Fateh Singh, aged about 57 years’
resident of 704, Third Floor, Chirag Delhi, New Delhi-110017. will be the owner of
the Third Floor of the said Premises.
Now this deed witnesses that under the agreement for family settlement and in
consideration of the settlement arrived at between the parties hereunder, the parties
hereby agree with each other that they will observe, perform and convene the terms
and conditions stated hereinabove.
That it is hereby declared and agreed between the parties that this agreement for family
settlement ends all disputes between the parties relating to the respective rights and
claims of the parties to the joint family properties and the parties admit and
acknowledge the claims of each other towards their respective properties as per this
agreement for family settlement.
All the conditions of the proposed agreement for family settlement have been fully
explained to all the parties, who are the signatories to this agreement for family
settlement and the said signatories have in consultation fully examined and considered
the said terms and conditions and have given their free consent at their will without
any force, coercion and/or inducement.
The present agreement for family settlement shall be considered final and conclusive
and shall not be altered or changed at any subsequent settlement stage. All the parties
of the present agreement for family settlement shall be bound by the terms of the
present Settlement agreement and shall adhere to the respective shares as demarcated
and stated under the present agreement for family settlement.
That under the present agreement for family settlement, this Settlement agreement
shall be registered and all the parties to the present Settlement undertake to present
themselves for registration of the present Settlement agreement before the authorities
concerned.
That the present Settlement Deed will have a legal force and shall be presented, and
forwarded before the Authorities concerned for the transfer of the respective shares of
properties between the parties. Should any party or parties require at any stage, the
parties to the present Settlement agreement shall be bound to issue NOC and execute
other documents that may be required about the mutation of the properties.
That the parties to the present settlement shall voluntarily at their will, consent and
execute the NOC about the transfer of the property from their name to the beneficiary
parties in terms of the agreement for family settlement. They shall further be bound to
present themselves, execute, and sign any other document required at any other stage
for the transfer of these properties.
That the transfer of the properties under this agreement for family settlement shall be
along with the entire charge on the said property and the beneficiaries of the said
property shall be liable and responsible for the payment of any dues against the
properties, whether past or arising in future at any stage. The previous owner(s) of the
properties under this Settlement agreement shall not be liable/responsible in the future
concerning any claim or dues concerning the said property at any stage. The entire
dues whether notified or not shall be the sole liability and responsibility of the
beneficiary/transferee, henceforth according to the execution of this present Settlement
agreement and they shall not raise any claim in this regard in any manner whatsoever.

The parties believe that the properties can no longer be held in common so the parties
herein have decided and mutually agreed to divide the properties amicably without any
litigation or dispute. The parties are desirous of executing a deed of family settlement
of the properties mentioned hereinabove among themselves in the manner as agreed
below
The party of the first part herein is allotted the schedule 'A' mentioned Property.
The party of the second part herein is allotted the schedule 'B' mentioned property.
The party of the third part herein is allotted the schedule 'C' mentioned property
The party of the fourth part herein is allotted the schedule 'D' mentioned property
AND THE PARTIES HEREBY COVENANT that all disputes and differences
between the parties concerning the schedule mentioned properties have been fully and
finally settled and in any event no party has any claim against the other on any account
whatsoever and this deed of family settlement shall not be reopened on any ground
whatsoever.
The cost of preparing, executing, and registering these presents shall be borne by the
said parties equally. The party of the first part shall retain the original copy of this deed
of settlement and the other parties shall retain a true copy of the same signed by all the
parties.
Such true copy shall be deemed to be an original deed. The Settlement hereby is free
and mutual and shall be irrevocable and binding on all the parties.
