INFRASTRUCTURE AND UTILITIES INCLUDING OPERATION AND
MAINTENANCE OF SELECTED FACILITIES DURING O&M PERIOD(S) AND

PERIOD(S) WITHIN SITE B AT NAVAL BASE KARWAR THROUGH DESIGN-
BUILD WORKS CONTRACT (DB-03)
CLARIFICATION ON TECHNICAL PROPOSAL
Please refer to your Technical Proposal submitted for the above Works.
After examining your above Technical Proposal, we found certain
inconsistencies in your submission, which are stated as follows:
(a) Pre-Contract Integrity Pact:
You have submitted Pre-Contract Integrity Pact, in which certain
discrepancies have been observed:
() The para s. no. 8.2 as given in format under Form-20 of RFP
Document, has been excluded from the Integrity Pact submitted by the
Tenderer.
(ii) The headings! sub-headings serial numbered as 13 & 14 in format
under Form-20 of RFP Document, have been numbered as 12 & 13
respectively in the Integrity Pact submitted by the Tenderer.
In view of above, you are advised to submit appropriate supplementary
agreement, duly enforceable by applicable laws, to rectify above mentioned
discrepancies in the submitted Integrity pact, so as to fully comply with Integrity
Pact requirements of the Tender Document(s). You are also advised to submit
appropriate board resolution to bind yourselves with such supplementary
agreement to the Integrity Pact.

(b) FORM-01: LET-TECH: Letter_of Tender _(Technical_Proposal)/
Authenticity of the Tender:
You have submitted Letter of Tender (Technical Proposal) without
acknowledging the examination of, and having no reservation on the documents
such as (i) Addendum No. 3 dated 16.11.2018, (il) Addendum No. 4 dated
29.11.2018, (ji) Response to Pre-Tender Queries dated 02-11-2018, (iv)
Response to Pre-Tender Queries dated 05.11.2018, (v) Response to Additional
Pre-Tender Queries dated 16-11-2018, and (vi) Response to Additional Pre-
Tender Queries dated 29-11-2018.
Further, in your Technical Proposal, two continuous pages have been
found to be numbered as 444.
You are, therefore, advised to submit an undertaking on the letterhead of
the Tenderer, as follows:
“UNDERTAKING
Subject Works: Design and Construction of Residential Buildings/Towers
and Townships along with related facilities, Trunk infrastructure and utilties
including operation and maintenance of selected faciliies during the O&M
period(s) and maintenance of elevators during elevators’ maintenance period(s)
within Site B through Design-Build Works Contract (DB-03)
We, (Name of Tenderer), in continuation to our dectaration
made under sub-para 6(a) of our Letter of Tender (Technical Proposal)
submitted with our Tender, further declare that we have examined and have no
reservation to the Tender Documents, including (i) Addendum No. 3 dated
16.11.2018, (ii) Addendum No. 4 dated 29.11.2018, (ii) Response to Pre-
Tender Queries dated 02-11-2018, (iv) Response to Pre-Tender Queries dated
05.11.2018, (v) Response to Additional Pre-Tender Queries dated 16-11-2018,
and (vi) Response to Additional Pre-Tender Queries dated 29-11-2018. We also
undertake that (i) Addendum No. 3 dated 16.11.2018, (ii) Addendum No. 4
dated 29.11.2018, (ii) Response to Pre-Tender Queries dated 02-11-2018, (iv)
Response to Pre-Tender Queries dated 05.11.2018, (v) Response to Additional
Pre-Tender Queries dated 16-11-2018, and (vi) Response to Additional Pre-
Tender Queries dated 29-11-2018 shall be deemed to form integral part of our
Technical Proposal and Tender.
We also undertake that we have submitted two continuous pages
numbered as 444 in our original submitted Tender for the subject Works; both of
these pages are owned by us and shall be deemed to form integral part of our
Tender.

You have submitted a Bank Guarantee in lieu of Tender Security, in
which certain discrepancies have been observed:
(i) In 5th line of last para (s. no. 8) of BG: the words ‘duly received by
an authorized official of the Bank’ are inserted between the words ‘claim’
and ‘or demand which does not meet the requirement of format
prescribed (Form-06) in the Tender Document(s)
In view of above, you are advised to submit appropriate addendum, duly
issued by the Bank, to rectify above mentioned discrepancies in the Bank
Guarantee submitted as Tender Security. The Bank Guarantee along with
Addendum so issued, shall also meet the format requirements as prescribed at
Form-06 of the Tender Documents.
(4) Blank Tender Documents:
You have not submitted the following documents as part of the blank
Tender Document, as per ITT 13.2 of Tender Documents:
(i) Addendum no. 1 dated 27-09-2018,
(ii) Response to Pre-Tender Queries dated 02-11-2018, and
(i) Response to Pre-Tender Queries dated 05-11-2018.
You are, therefore, advised to submit the above mentioned documents as
part of blank Tender Document(s), duly sealed and initialled/ signed by the
Authorised Representative.
(e) Form-08/ Form-09 Proposed Key Personnel/ Resume of Proposed Key
Personnel:
You have submitted four nos. of CVs (Form-09s) in addition to the
proposed key personnel listed in Form-08, which is not as per the stipulations
made in the Tender Document. Further, a list of presently employed technical
personnel has also been submitted. You are, therefore, advised to submit
necessary clarification along with relevant supporting documents (if necessary)
to rectify the discrepancies as mentioned hereinbefore.
‘A few proposed key personnel listed in Form-08, namely Mr. D.
Nagaswara Rao (proposed as Quality Control Manager), Mr. G. Srikant and Mr.
M. Raja Babu (both proposed as Construction Manager ~ Structures), and Mr.
Naresh Duppada (proposed as Design Manager ~ Infrastructure / Utilities) do
Not fulfil the requirement of total work experience! similar work experience as
per the details submitted in their respective CVs. You are, therefore, advised to
submit necessary clarification along with relevant supporting documents/ revised
CVs (Form-09s), or propose alternative personnel(s), along with revised Form-
08 & Form-09(s) for the key positions referred herein, to substantiate
compliance with requirement(s) of the Tender Document.

(f) — Form-10 EQP: Contractor's Equipment:
You have proposed Tower Crane(s) (manufactured by Ace Ltd./ Model
no. TC5540), which as per published specifications have a jib length of 55m,
instead of 65m as specified in the Form-10, against the requirement of 60m as
specified in Tender Document(s). You are, therefore, advised to submit
necessary clarification along with relevant supporting documents to substantiate
the capacity of the proposed equipment, or as an alternative to resubmit FORM-
10 EQP with revised proposal of tower cranes, duly complying the Tender
requirements.
(g) Form-12 ORGANISATION:
You have submitted Organization chart without describing the Roles &
Responsibilities for the proposed Key Personnel as listed at Form-08. Further,
the proposed key personnel (as given in Form-08) are not included in the
organization chart, nor have been referenced to FORM-08: PER-01 & FORM-
09: PER-02, You are, therefore, advised to resubmit FORM-12 ORGANISATION
along with description of Roles & Responsibilities of the proposed Key
Personnel including proper references to FORM-08: PER-01 and FORM-09:
PER 02.
(h) Form-13 WORK PROGRAMME:
In the Form-13, the time schedules have not been referred from the ‘D’
date (commencement date), as per requirements stated in the Tender
Document. You are, therefore, advised to resubmit FORM-13 WORK
PROGRAMME with time schedules clearly marked with reference to ‘D’ date
(commencement date) as per requirements stated in the Tender Document.
In addition to above, the key milestone dates have not been explicitly
highlighted in the work programme attached with FORM-13. You are also
advised to resubmit FORM-13 WORK PROGRAMME with key milestone dates
explicitly highlighted.
Further in Form-13 submitted by you, the design submission program has
been proposed without the identification, description and cross referencing of
various design packages/submissions. The design submission program also
doesn't highlight duration of design coordination with other consultants. You
are, therefore, further advised to resubmit FORM-13 WORK PROGRAMME with
identification, description and cross referencing of various design
packages/submissions along with duration of design coordination with other
consultants clearly highlighted in the schedule.
Further pertaining to Narrative Statement, no such statement has been
submitted along with the Form-13, You are advised to resubmit FORM-13
WORK PROGRAMME with a detailed narrative statement as per the
requirements stated in the Tender Documents.(i) Form-17 SEP:
The Outline Site Establishment Plan submitted by you is generic in nature
‘and does not specifically illustrate the intended means to comply with the
Employer's requirements, Further, substantial details in regards to the site
establishment and temporary works, including details of proposed labour camps
and facilities, is not provided. You are, therefore, advised to resubmit FORM-17
with proposal complying with the Employer's requirements including details of
site establishment and temporary works such as proposed labour camps and
facilities to be proposed by the Tenderer.
3. The Applicant is requested to provide the documents in support of clarifications
and submissions (one original and 2 copies) within 14 calendar days from the date of
this letter, failing which your Application shall be evaluated based on the information
and documents already submitted.
4, The Applicant is further advised not to submit loose sheets in plastic folders,
The document submission shall be in spiral or hard bound form only. The Applicant is
furthermore advised to machine number all the pages and prepare a table of contents
at the beginning of each volume of documents referring the page numbers of the
indexed items. Each page of the submission should be stamped and signed by
authorized representative of the Applicant.
5. Advance copy of documents can be sent through e-mail followed by hard copy
submission as detailed above but copy of documents sent through e-mail must be
properly machine page numbered, stamped and signed by authorized representative of
the Applicant.
6. _ Please note that no further opportunity or extension of date for the submission
shall be given.
