CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease executed and entered into Catbalogan City, Samar, on April 30,
2022 by and between:

DONALD B. DOMALAON, single, of legal age, Filipino and with residence


and postal addressed at Brgy. 10 Poblacion Catbalogan City, Samar, herein after referred
to as the LESSOR:

-and-

ALICIA M. ABANILLA, widow, of legal age, Filipino and a resident of Brgy.


01 Poblacion Catbalogan City, Samar, herein after referred to as the LESSEE.

WITNESSETH

WHEREAS, the LESSOR is the owner of a commercial space subject of this Contract
located at corner San Francisco Street and Burgos Avenue Brgy. 01 Poblacion Catbalogan City,
Samar.

WHEREAS, the LESSOR hereby lets and lease unto the LESSEE the commercial space
under the following terms and conditions:

1. That the term of the lease shall be a period of five (5) years commencing on April 30,
2022, renewable upon mutual agreement of both parties subject of Five (5%) Percent
increse every end of the contract:
2. That the monthly rental shall be TEN THOUSAND (₽10,000.00) PESOS, payable on or
before every last day of the month, Withholding Tax shall be borne by the LESSEE:
3. That a deposit equivalent to the amount of one (1) month rental shall be collected to
cover for the unpaid billings and /or physical damages in case of early termination of
this Contract:
4. That the LESSEE shall have separate electric, water, internet and telephone lines, and
that its monthly payments up to the termination of this Contract, Including its repair and
maintenance, shall be for LESSEE’s account:
5. That the LESSEE shat not directly or indirectly sublease any portion thereof under any
circumstance whatsoever, and any such Contract made in violation of this clause shall
ne null and void:
6. That both parties have the right to terminate the Contract after thirty (30) days of the
commencement date upon proper notice, otherwise, the same shall be enforced until
revoked:
7. That the LESSEE hereby expressly agrees and warrants that the leased premises shall be
used for ligitimate purposes only, and is hereby prohibited to use said premises for any
other purpose without prior written consent from the LESSOR:
8. That the LESSEE shall not introduce any improvements on the leased premises without
prior written consent of the LESSOR and that any improvement of the leased premises
shall be for the account of the LESSEE: that all permanent improvements or renovations
made by the LESSEE on the leased premises shall become an integral part of the leased
premises at the time of such, unless the LESSOR has waived or given its consent thereto
in writing and shall not cause any damage to the property, if so removeed; damage to
the property shall be paid by the LESSEE:
9. That the LESSOR or his duly authorized representative shall have the right to inspect
the leased premises at any reasonable hour of the day: and
10. That in case of non-payment of rental for one (1) month or violation of any terms and
conditions of this Contract, the leased shall be considered rescinded and the LESSOR
shall have the right to demand that the LESSEE vacates the premises and surrenders
possession of the leased premises peacefully without need of instituting any legal action.
Deposit of notice to vacate the leased premises shall constitute due and sufficient notice
to the LESSEE as provided by law.

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures on this ______
