MOTION TO REVIVE, SET CASE FOR

HEARING WITH RESERVATION OF THE
RIGHT TO INSTITUTE SEPARATELY THE
CIVIL ACTION

COMES NOW the undersigned private complainant in the above-

entitled case and unto this Honorable Court respectfully alleges:
1. That the above-entitled case was sent to the archives pending the
arrest of the accused;
2. That considering that the accused has already posted bail for his
provisional liberty, the above-entitled case may now be revived and
set for hearing or arraignment of the accused on May 20, 2004 at 8:30
a.m.;
3. That considering that the prosecution has not yet started the
presentation of its evidence, undersigned private complainant serves
notice that he is reserving his right to institute separately with the
Regional Trial Court, Gapan City the civil action for the recovery of
civil liability arising from the offense charged in the information;

WHEREFORE, and in the interest of justice and speedy disposition of

cases, it is respectfully prayed that the above-entitled case be revived and
thereafter immediately set for hearing on May 20, 2004 at 8:30 a.m..
Undersigned private complainant likewise prays that the reservation
of his right to institute a separate civil action be noted.
Such other reliefs and remedies just and equitable in the premises are
likewise prayed for.
