CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

THIS DEED, made and executed by and between:

SPOUSES PATRICIO BAUTISTA DELA CRUZ and FELISA CASTILLO DELA CRUZ,
both of legal age, Filipino Citizens, and residents of 709 Algeciras St. Sampaloc, Manila,
hereinafter referred to as “TRANSFERORS/VENDORS”, hereby represented by their
Attorney-in-Fact, TERESITA CASTILLO DELA CRUZ, of legal age, Filipino, and a resident
of 709 Algeciras St., Sampaloc, Manila by virtue of an Special Power of Attorney, herein
attached as annex “A”;
-AND-

SAMIER PECAYO ROUZE, of legal age, Filipino Citizen, and residents of Block 65 Lot
4 Confederation Drive, City Homes Subdivision, Sampaloc IV, Dasmarinas City, Cavite,
hereinafter referred to as “VENDEES”.

-WITNESSETH-
WHEREAS the TRANSFEROR/VENDORS are the registered purchasers of the
property, located at in Lot 27 Block 32 Area A-3, Dasmariñas City, Cavite, containing an area of
ONE HUNDRED (100) SQUARE METERS, more or less, under National Housing
Authority (NHA).
         WHEREAS the TRANSFERORS/VENDORS has offered to assign all his rights, title
and interest over the above award residential lot and the TRANSFEREE/VENDEE hereby
accepts the assignment in accordance with the terms herein set forth;
 

       NOW THEREFORE, for and in consideration of the total sum of SEVEN HUNDRED


THIRTY FIVE THOUSAND PESOS ONLY (Php735, 000.00) Philippine Currency, and of
the covenants herein after set forth the SELLERS, agree to sell the said portion of the property
and the BUYERS agree to purchase the same subject to the following terms and conditions:

TERMS AND CONDITIONS:

1. That the SECOND PARTY will pay an amount of TWO HUNDRED SEVENTY
THOUSAND PESOS ONLY (Php270,000.00), as DOWNPAYMENT, for the said
property;

2. That the SECOND PAYMENT amounting to THREE HUNDRED TEN THOUSAND


PESOS ONLY (Php310,000.00) , Philippine Currency, will be paid on or before
March 16, 2022, via Philippine National Bank (PNB) Check Number 2000000065;

3. That after the EIGHTY PERCENT (80%) of payment has been made, both parties
agreed that the FIRST PARTY will give consent/rights to the SECOND PARTY over
the property if the SECOND PARTY wants to establish a house;

4. That both parties agreed that the FIRST PARTY will process the release of Transfer
Certificate of Title from National Housing Authority (NHA) and it will be shouldered
by the FIRST PARTY;

5. And the remaining TWENTY (20%) PERCENT, shall be paid upon completion of
documents from National Housing Authority (NHA) as well the release of Transfer
Certificate of Title (under the name of the FIRST PARTY);
6. The ownership is reserved until full payment is made.
7. That both parties agreed that they will execute and notarize a Deed of Absolute Sale,
Acknowledgment Receipt, or Extrajudicial Settlement of Estate with Sale (if
needed) in favor of the SECOND PARTY, as the completion of this sale transaction
property after the payment has been settled;

Known to me and to me known to be the same persons who executed the foregoing Deed of
Absolute Sale and they acknowledged to me that same was executed by them freely and
voluntarily. This instrument, consisting of TWO (2) PAGES, has been signed by the Parties and
their instrumental witnesses, sealed with my notarial seal and relates to the registered parcel of
land with improvements existing thereon. Based on documents presented, the parties are both
Filipino Citizens.
