QUESTION 1 (5 MARKS)
If you are a manager in a manufacturing company, do you think a DOSH Officer is an important
person when it comes to safety and health? Explain your answers in detail.

If I am a manager in a manufacturing company, I think DOSH Officers is an important person when it


comes to safety and health. The Department of Occupational Safety and Health (DOSH) is a
department under the Ministry of Human Resources. This department is responsible for ensuring the
safety, health and welfare of people at work as well as protecting other people from the safety and
health hazards arising from the work activities. It is important to note that since manufacturing is one
of the major contributors to the Malaysian economy, the development of manufacturing sector must
also be in line with the awareness and compliance of the industry towards safety and health. The
policy for manufacturing in Malaysia does not only cover technology, market access, productivity and
financial component but must also consider numerous hazards in the work environment. Various
occupational and health issues such as exposure to chemical, lack of trained workers and deficiency in
enforcement must be appropriately managed. It is important to understand what constitutes
‘manufacturing sector’. According to the Industrial Co-ordination Act 1975 (ICA), ‘manufacturing
activity’ is defined as the making, altering, blending, ornamenting, finishing or otherwise treating or
adapting any article or substances with a view to its use, sale, transport, delivery or disposal; and
includes the assembly of parts and hip repairing but shall not include any activity normally associated
with retail or wholesale trade. As a government agency, the department (DOSH) is responsible for the
administration and enforcement of legislations related to occupational safety and health of the country,
with a vision of becoming an organisation which leads the nation in creating a safe and healthy work
culture that contributes towards enhancing the quality of working life.

Putra Books Enterprise has 7 employees employed at the place of work. What does the employer need
to establish? Which section is involved under this situation? What are the penalties that can be
imposed if the company fails to do so?

OSHA supports compliance with federal standards by offering free consultations and other programs
that may be especially useful to small businesses, which it defines as having 10 or fewer employees.
Small businesses have different reporting requirements than larger companies. Rules also vary by
industry. Employees need to be established with a good safety plan. The company should recommend
a four-prong approach that incorporates management commitment and worker involvement, workplace
analysis, company-wide training and hazard prevention and control. These guidelines apply to
companies of all sizes, including smaller companies exempt from federal reporting and documentation
requirements. However, they can help companies that are not exempt achieve and exceed compliance
standards. Then, creating a plan. OSHA advises small business owners to consider current and future
needs as they develop their safety plans. Someone on staff, whether the business owner or a designated
employee, accounts for the plan's creation and implementation. Although businesses may create plans
on their own, OSHA notes that it has a variety of publications and programs, including free
consultations, for owners or managers who need guidance. Employees need to establish with sharing
the plan. Although businesses with 10 or fewer employees are not required to have a written plan,
putting the plan in writing and making it part of company's policy demonstrates a commitment to
employees' health and safety and helps to involve them in the process of improving workplace safety.
OSHA suggests posting the policy next to the OSHA workplace poster, if the business has one.
Businesses with 10 or fewer employees are exempt from most OSHA reporting requirements.
However, good record-keeping can help business owners and identify and resolve health and safety
issues. The records may also support a company's credit applications and insurance and other audits,
according to OSHA. The agency recommends documenting all efforts a company takes in developing
and implementing its safety plan. The company should also document each injury or work-related
illness requiring more treatment than first aid and prepare an annual summary using OSHA Form
300A. Managers should consider including even those incidences where illness or injury may have
resulted but did not. Penalties that can be imposed is Section 19 under section 15-18, fine will not
exceeding RM50,000, imprisonment not exceeding 2 years or both

Gemilang Chemicals Sdn Bhd has more than 80 employees at the place of work. What does the
employer need to establish other than a safety policy? Explain the functions of establishing it.

In section 30, SHC must be establish if there are 40 or more employees at the workplace. Consist of
chairman, secretary, management representatives and employees’ representatives. Preventing a
mismatch between individual board members attitudes, behavior or decisions and the organization’s
Safety Statement so as not to undermine workers belief in maintaining good safety and health
standards. The organization needs to understand how human factors affect safety and health
performance. Senior executive directors or other senior management controlling body members and
executive senior managers are primarily responsible for safety and health management in the
organization. These people need to ensure that all their decisions reflect their safety and health
intentions
