AN ACT PROVIDING FOR A MORE RESPONSIVE AND


COMPREHENSIVE REGULATION FOR THE REGISTRATION,
LICENSING AND PRACTICE OF ARCHITECTURE. REPEALING
FOR THE PURPOSE REPUBLIC ACT NO. 545, AS AMENDED,
OTHERWISE KNOWN AS “AN ACT TO REGULATE THE
PRACTICE OF ARCHITECTURE IN THE PHILIPPINES,” AND
FOR OTHER PURPOSES.

PROFESSION REGULATORY BOARD

• The Board of Architecture is a collegial body under the


supervision and administrative control of the Commission.
• Composed of a Chairman and two members
• Chairman: Ar. Robert Sac
• Members: Ar. Milafuerte
• Appointed by the President of the Philippines
• Nominated by IAPOA and recommended by PRC

• Citizen and resident of the Republic of the Philippines


• Holder of BS Degree in Architecture
• With a valid Certificate of Registration (COR) and Professional
Identification Card (PIC)
• Active practitioner of architecture for at least 10 years
• Not a member or a former member of the faculty of any school or review
institution
• No pecuniary interest in such institution unless he/she had officially
resigned from such an institution and has completely stopped teaching,
advising or reviewing activities for at least 5 years prior to the nomination
• Has never been convicted of any crime involving moral turpitude

TE R M OF OF F I C E

• The members of the Board shall hold office for a term of 3 years
after appointment or until their successors shall have been
appointed and duly qualified
• Any vacancy occurring within the term of a member shall be
filled for the unexpired portion of the term only
• Each member of the Board may be reappointed for one full term
of 3 years
• Of the members of the Board first appointed under this Act,
• 1 member = Chairman = 3 years term
• 1 member = 2 years term
• 1 member = 1 year term
• Each member of the Board shall qualify by taking the proper
oath prior to the performance of their duties

P OW E R S A ND F U NC TI ONS OD TH E
BOA R D

• The Board shall exercise the following specific powers, functions, and
responsibilities:
• Prescribe and adopt the rules and regulations of RA 9266
• Supervise the registration, licensure, and practice of architects
• Administer oaths in connection with the administration of this Act
• Issue, suspend, revoke, or reinstate the COR and PIC
• Adopt an official seal of the Board
• Monitor the conditions affecting the practice of Architecture and adopt measures
• Prescribe and/or adopt the Code of Ethical Conduct and SPP
• Hear and decide administrative cases involving violations of RA 9266, the Code of Ethical
Conduct and SPP,
• To issue subpoena testificandum and subpoena duces tecum to secure the appearance of witnesses
and the production of documents in connection therewith
• The decision of the Board shall, unless appealed to the Commission, become final and executory
after 15 days from receipt of notice of judgement or decision
• The decision of the Commission may be appealed to the Court of Appeals
• Prescribe guidelines for the CPD program in consultation with the IAPOA.
• Prepare, adopt, issue or amend the syllabi of the subjects for examinations as well as
administer, correct, and release the results of the licensure exams.
• Approve, issue, limit, or cancel temporary or special permit to practice architecture
• In coordination with CHED, ensure that all higher educational instruction and offerings
of architecture comply with the policies, standards, and requirements of the course
• To adopt a program for the full computerization of the licensure examination
• Discharge other duties and functions
• The policies, resolutions, rules and regulations, issued or promulgated by the Board shall
be subject to review and approval of the Commission
• The Board’s decisions, resolutions or orders rendered in administrative cases shall be
subject to review only of on appeal.

• The Board shall be under the administrative supervision of


the Commission
• All records of the Board pertaining to licensure examination,
administrative and other investigative cases conducted by the
Board shall be under the custody of the Commission
• The Commission shall designate the Secretary of the Board
and shall provide the secretariat and other support services
to implement the provisions of this Act

R E MOVA L OF ME MB E R S OF TH E BOA R D

• The President of the Philippines upon the recommendation


of the Commission, may suspend of remove any member on
the following grounds:
• Incompetence
• Violation of tolerance of the violation of this Act, or IRR or
Code of Ethical Conduct and SPP
• Final judgement of crimes including moral turpitude
• Manipulation or rigging of the ALE results, disclosure of secret
and confidential information or tampering of grades

• The Chairman and Members of the Board shall receive


compensation and allowances as provided for in the General
Appropriations Act.

A NNUA L RE P ORT

• The Board shall submit an annual report to the Commission


after the close of each year giving a detailed account of its
proceedings during the year and making such
recommendations as it may deem proper

• All applicants shall be required to undergo a licensure exam


to be given by the Board in accordance with the provisions of
RA 8981:

• Filipino citizen / citizen of a foreign country


• Good moral character
• Holder of the degree of BS Architecture conferred by an
institution duly recognized &/ accredited by the CHED
• At least 2 years or equivalent diversified architectural experience
duly certified by a RLA
• Applicant holding a Master’s Degree in Architecture shall be
credited 1 year in his/her practical experience
• Has not been convicted of any criminal offence involving
moral turpitude

obtained by each candidate within 30 calendar days after the
examination, unless extended for just cause
• Upon the release of the results, the Board shall send by mail
the rating received by each examinee at the given address

• All successful candidates shall be required to take an oath of


profession before

• Any government official authorized by the Commission

• A roster showing the names and place of business of all


registered professional architects
• Shall be prepared and updated by the Board and copies
thereof shall be made available
SECTION 20
SE A L, I SSUA NC E , A ND USE OF SE A L

A duly licensed architect shall affix the seal prescribed by the


Board bearing the registrant’s name, registration number and
title “Architect” on all architectural plans, drawings,
specifications and all other contract documents prepared by or
under his direct supervision.
1. Each registrant shall obtain a seal of such design as the Board shall authorized
and direct
• Architectural plans and specifications shall be stamped with seal
• It shall unlawful to stamp or seal after the COR has expired or has been revoked
2. No officer or employee shall accept or approve any architectural plans or
specifications which have not been prepared and submitted in full accordance
with all the provisions of this Act
• Nor shall any payments/ bribe be approved
3. It shall be unlawful for any architect
• To sign, affix the seal, or use any other method of signature on architectural plans and
specifications or other documents made under another Architect’s supervision
• To sign for any branch of work for any function of architectural practice not actually
performed by him/her

4. Intellectual Property
• Signed, stamped, or sealed drawings and specifications of a RLA
• Unlawful to use without the consent of the Architect
5. All architectural plans, designs, specifications, drawings, and documents shall
bear the seal and signature only of a RLA

• The BOA shall have the power to suspend or revoke


• COR, PIC, Special Permit
• Offenses that such action of the board shall be subject to appeal to the Commission
whose decision is final if he/she
• Has signed & affixed/permitted documents or work NOT prepared by him/her or not executed
under his/her immediate supervision
• Has paid money to secure COR
• Falsely impersonated a practitioner
• Has aided in the practice of architecture NOT duly authorized to practice architecture in the
Philippines
• Has openly solicited projects without a valid service agreement (nagpapabayad w/out
guaranteeing compensation of services)
• Violation any provision of RA 9266

destroyed, or mutilated, may be re-issued, subject to the rules
promulgated by the BOA and the PRC, upon payment of the
required fees

Unless have received COR and PIC, no person shall:


• Practice architecture
• Engage in preparing architectural plans, specification
• Prepare preliminary data for the erection or alteration of any
building
• Use the title ”Architect”
• Offer to practice architecture
SECTION 26
V E S TE D RI G H T S

• All architects registered at the time this law takes effect shall
automatically be registered.
• COR held by such persons in good standing shall have the
same force and effect as though issued after the passage of
this Act.
SECTION 27
R E C I P ROC I T Y R E QU I R E ME NT S

• A person who is NOT a citizen shall not be allowed to take


the licensure examination unless they can prove that their
country admits citizens of the Philippines to practice the
same profession without restriction or allows them to
practice it after passing an examination.

D E V E LOP ME NT ( C P D )

• All practicing architects shall maintain a CPD program.


• Other entities or organizations may become CPD providers
upon accreditation by BOA
• IAPOA
• Shall have the responsibility of developing a CPD program for
Architects
• CPD program shall be formulated by the Continuing
Professional Education (CPE) Council for Architects based
on the existing guidelines of the PRC with levels of
compliance and proficiency evaluation as a rating factor

• Penalty
• PHP 100,000 – PHP 5,000,000
• Imprisonment: 6 months – 6 years
• Guilty of Misdemeanor
• Offenses:
• Practicing architecture without being registered/licensed
• Not a holder of temporary/special permits
• Any person presenting /attempting to use as their own the COR/PIC or seal
of another or TSP
• Any person who shall give any false or forged evidence of any kind in
obtaining COR/PIC/TSP
• Any person who shall falsely impersonate any registrant
• Any person who shall attempt to use a revoked or suspended COR/PIC or
cancelled TSP
• Any person advertise themselves as an Architect when they are NOT
• Person/s knowingly allows the use, adaptation, implementation of plans,
designs/specifications made by any person, firm NOT DULY LICENSED to
engage in the practice of architecture
• Violate any Provisions of RA 9266, Code of Ethical Conduct and SPP, or any
policy of the Board
• Offenses
• Gov’t & private firms employees who are not RLA shall NOT perform architectural
works without the direct supervision of a RLA.
• Any public official who shall order/cause a non-architect to perform activities which
constitute practice of architecture

• Penalty:
• 50, 000 – 500,000
• Imprisonment: 6 months and 1 day – 6 years
• Offenses:
• Any head of government agency or officers of a private firm who violates Sec. 7 of
RA 8981: PRC Modernization Act of 2000
SECTION 30

• Any person/entity, Filipino/Foreigner, public/private who


force a RLA to undertake/perform any service under the
general practice of Architecture without first executing a
written contract/service agreement.
• Guilty of a Misdemeanor
• Fine: min. 200, 000 php
• imprisonment: max. 6 years

• It shall be unlawful for any person or firm or corporation to


• Seek to avoid the provision of RA 9266 by having a representative
or employee seek architectural work in their behalf
• Solicit architectural work

• It shall be unlawful for any architect to sign their name, affix


their signature, or use any other method of signature of
architectural plans, specifications, or other documents made
by another architect

• Architectural documents duly signed, stamped, or sealed, as


instruments of service, are the intellectual property and
documents of the architect
• It shall be unlawful for any person to duplicate
• All architects shall incorporate this provision in all contract
documents and other instruments of service.

• Any person NOT registered as an architect shall not claim


nor represent either services or work or for any branch of
architectural practice, even though no form of the title
“Architect” is used.

• Within 3 years from the effectivity of this Act, all existing


and proposed positions in the local and national gov’t,
whether career, permanent, temporary or contractual and
primarily requiring the services of an architect shall be filed
only by registered and licensed architect.

C OLLE C TI ON OF P ROF E SSI ONA L F E E S

• It shall be unlawful for any unregistered person to collect a


fee for architectural services EXCEPT as an employee
collecting a fee representative of a RLA
SECTION 37
LI MI TATI ON TO TH E RE G I S TR ATI ON OF
A F I RM, C OMPA NY, PA RTNE RSH I P,
C OR P OR ATI ON OR A SSOC I ATI ON

• The practice shall be determined upon the basis of individual


personal qualifications.
• Conditions for firm, company, corporation, partnership or
association to register
• Only Filipino citizens, among themselves or together with allied
technical professionals
• RLA shall compose at least 75% of the owners/members
• Individual members shall be responsible for their individual &
collective acts as an entity
• Shall be registered with the SEC and BOA

P E R MI T S

• Foreign nationals to perform professional services as


architects/consultants shall secure a TSP from BOA subject
to approval of PRC.
• Provided, that a foreigner shall be deemed practicing
architecture in the Philippines, whether the services is
consummated in a foreign country.
• Conditions:
• He has a special permits to practice within their territorial limits
or country
• Legally qualified to practice architecture in his/her own country
& his expertise is necessary and advantageous to our country
particularly in the aspects of technological transfer and
specialization
• Shall be required to work with a Filipino counterpart and shall
also be responsible for public utilities and taxes due to the
Philippine gov’t.
• Those who secure the services of a Foreign professional
authorized shall be responsible for securing a special permit from
PRC and DOLE pursuant to PRC and DOLE rules.

BOA & IAPOA may issue a TSP to foreign architects allowing them
to practice the profession in the Philippines.

U ND E R A TE MP ORA RY / SP E C I A L P E R MI T

• Foreigners engage in the practice of architecture must secure


locally their professional liability insurance or malpractice
insurance or their equivalent in bond commensurate with
the magnitude of their project.
• BOA in consultation with IAPOA shall implement it within
6 months from the effectivity of this Act.

FINAL PROVISIONS
SECTION 40
I NTE G R ATI ON OF TH E A RC H I TE C TU R E
P ROF E SSI ON

• The architecture profession shall be integrated into 1 national


organization which shall be accredited by BOA, subject to the
approval by PRC, as the IAPOA
• Such IAPOA shall be registered with SEC, as a non-profit, non-
stock corporation
• An architect duly registered with the Board shall automatically
become member of the IAPOA and shall receive benefits and
privileges upon payment of fees and dues.
• Membership in the IAPOA shall not be a bar to membership in
other associations.

R E G U LATI ONS

• 60 days after the effectivity of this Act, the BOA, subject to


the approval of the PRC
• In coordination with the IAPOA, BOA shall adopt and
promulgate IRR, Code of Ethical Conduct and Standards of
Professional Practice, which shall be effective 15 days after
publication in the Official Gazette or in 2 major daily
newspapers.
SECTION 42

• The PRC shall immediately include the funding in the


annual General Appropriations Act.

AC T NOT A F F E C TI NG OTH E R
P ROF E SSI ONA LS

• RA 9266 shall not be construed to affect or prevent other


practices
SECTION 44
E NFORC E ME NT OF TH E AC T

• The primary duty of PRC, BOA and all government agencies


is to render assistance in enforcing this ACT and to
prosecute any person violating the provisions of the same.
• The Secretary of Justice shall act as legal adviser to the
Commission.
• Any person may bring before PRC, BOA or officer of the
Law cases of illegal practice or violations of this Act.
• BOA shall assist the Commission, in filing cases of illegal
practice or violations of this Act through the concerned
prosecution office in accordance with the law and the Rules
of Court
SECTION 45

• If any provision shall be declared unconstitutional, such


judgement shall not affect other part hereof
SECTION 46
R E P E A LI NG C LAU SE
