THE IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT


NO. 9266, AN ACT PROVIDING FOR A MORE RESPONSIVE AND
COMPREHENSIVE REGULATION FOR THE REGISTRATION, LICENSING AND
PRACTICE OF ARCHITECTURE, REPEALING FOR THE PURPOSE REPUBLIC ACT NO.
545, AS AMENDED, OTHERWISE KNOWN AS “AN ACT TO REGULATE THE
PRACTICE OF ARCHITECTURE IN THE PHILIPPINES,” AND FOR OTHER PURPOSES

Pursuant to Section 7 (a), Article II and Section 41, Article V of Republic Act No. 9266, known
as “The Architecture Act of 2004”, the Board of Architecture hereby prescribes, adopts, and
promulgates the following Rules and Regulations to carry out the provisions thereof.

RULE I
"THE RULES AND REGULATIONS IMPLEMENTING THE PROVISIONS OF REPUBLIC ACT
NO. 9266," generally known as "THE ARCHITECTURE ACT OF 2004," should be the name of the set of
rules and regulations. It may be referred to as "IRR of the Architecture Act of 2004" for reference. The
IRR of the Architecture Act of 2004 shall interpret and understand in this statement of the problem can be
read in Section 2 of R.A. 9266, as a whole we recognize the importance of architects in building
developments and nation building. A professional shall practice and well-mold as world-class
competitive, excellent, well committed and effective. They shall practice credible and effective in
licensure examinations, as well as programs and activities that encourage developing oneself and their
growth as aspiring professionals.
Architecture is the art and science or profession of planning, designing and constructing
buildings in their totality taking into account their environment, a recital of principles of good
architecture proclaimed by Vitruvius in De Architectura: Utilitas (utility), Fermitas (strength) and
Venustas (beauty). Architects are the professional who perform these practices, they should be
knowledgeable enough to qualified, duly registered and licensed under R.A 9266 with Certificate of
Recognition and Professional Identification Card issued by the PRBoA and PRC. Architects has their own
specialty or terms for the different work of an Architect such as Architect of record, Architect who’s in
charge in construction and the Consulting Architect. In general practice of architecture, it is an act of
planning and architectural designing, structural conceptualization, specifying, supervising, and giving
general administration and responsible direction to the erection, enlargement, or alterations of buildings
and building environments, as well as accepting projects with legal architectural documents and contract
documents with the client. It also practices the studies of proposed plans, specifications, site visits,
consultation to professionals, contracts and advice from the professionals/ contractor. The scope of
architecture is not limited to preparation of plans, specifications, structural conceptualization, and
architectural designs, conservation and restoration. Architects can teach to aspiring students who can be
them in the future they can teach Architectural subjects, computer aided-design projects. Architecture is
flexible in all aspects of life any work intended for the development of complex buildings and
managements, health related facilities and engineering structures. Architecture is for all it has laws and
codes to be consider and is partnered and linked with other organizations such as IAPOA same as UAP,
DOLE, DTI, BOA, PCAB, PRCA, PDCB, ched and so on that related to Philippine Architecture.

RULE II
According to Section 4 a Professional Regulatory Board of Architecture established as a collegial
body under the supervision and administrative control of the Professional Regulation Commission,
hereinafter referred to as the Commission. The Board attached a chairman and two (2) members
appointed by the President of the Philippines from a list of three (3) recommended chosen from a list of
five (5) nominees for each position submitted to the Commission. The Board must be formed within six
(6) months of the Architecture Act of 2004 becoming effective. To be one of the Professional Regulatory
Board a person should follow the qualifications; citizen and resident of the Philippines, degree holder in
BS Architecture granted by the universities and colleges, or accredited by the CHED. To qualified an
architect must have Certificate of Registration and Professional I.D., and an active practitioner in his/her
field for at least ten years, and must not part of the officer of IAPOA or other organizations of architects,
must not also member of faculty of any colleges and universities if a person resigned, he/she at least five
years stopped teaching prior to the nomination.
According to Section 6, the member of the Board shall serve for three years on his term after the
appointment or duly qualified to his position. Each member of the board that appointed is under the R.A.
9266, one member appointed as chairman for three years, one member for two years and the other one is
one year they are qualify to take oath prior to their commitment towards their duties. The power and
function of the board must adopt the IRR of the Architecture Act of 2004 for carrying out the provision of
R.A. 9266.Supervise the licensure and practice of architects, and issue of Certificate of Recognition and
Professional I.D. as well as ratifying seal of the Board for the practice of the said profession. Counted also
in Section 7 the adaptation of Code of Ethical Conduct and Professional Practice, and dealing with the
violation cases especially to R.A. No. 9266. In coordination with the CHED ensuring architecture
profession follows the standards, requirements prescribed by them, adopting a computerized form
licensure examination while policies, rules and regulation and resolution are issued by the Board and
approved by the Commission. Section 9 of this rule discussed the ground for suspension or removal of
members of the board, he/she neglect the duties given, tolerance of the violation of R.A. 9266,
manipulating licensure examination, disclosure of important information and it is investigated by
Commission guided by section 7.
Compensation and allowances for the chairman and members of the Board shall be equal to those
paid to the chairman and members of existing regulatory boards under the Commission. After the end of
each year, the Board shall submit to the Commission an annual report giving an account of its activities
throughout the year and making any recommendations it deems appropriate.
RULE III

According to Section 12, all applicants for registration taking the architecture field or
practice architecture are required to take the licensure examination to be given by the Board with
time and place depending on the designation. Applicants need to comply with the requirements
of the Board taking the licensure examination: he/ she must be a Filipino citizen or a citizen of a
foreign country, have a good moral character, degree holder of BS Architecture of any colleges
and universities accredited by the CHED, he may also have two years’ experience of diversified
architectural certified by the registered and licensed architect. And as an aspiring professional
does not have any record of a criminal offense.
The courses/ subjects that cover of licensure examination are the following but not limited on
this:
 History and Theory of Architecture
Principles of Planning
Architectural Practice
 Structural Design
Building Materials
Architectural Specifications
Methods of Construction and Utilities
 Urban Design
Architectural Interiors
 Architectural Design
Site Planning
The rating in licensure exam to be consider as qualified they must obtain a GWA of 70%
with no grade lower than 50% in any subjects. All the board passers candidates are required to
take an ought to prior enter of the architecture profession. As stated on this rule the Commission
will issue the Certificate of Registration and Professional Identification Card. Stated on Section
20, the board shall attach the seal prescribed by the Board bearing the registrant’s name, number
and his/her title as Architect applied on all architectural plan and documents under his own
management. The Board have the power to cancel or suspend the validity of Cert. of Registration
and Professional I.D once the architect is suspected on the ground stated on Section 22, for
misinterpret himself/herself in his/her application for examination. And it goes through final
appeal subjected to Commission, if he/she has violated any provision of R.A 9266, its
implementing rules and regulation, the code of ethical conduct and standard of professional
practice. And paying except to the provided regular fees to reserve the slot for certificate of
registration.
RULE IV
Based on Section 25, no person shall practice architectural plans, detailing, and specifications or get a
project without knowing the profession of this field. No illegal practice must execute in this country,
display the Architect title on the documents, or make-believed that a person is a registered and licensed
architect unless this professional architect received from the Board a Certificate of registration and
Professional I.D.

Section 27, a person who is not a Filipino citizen is not allowed to take licensure examination unless the
country where he/she is a citizen can prove that he/she practice the same profession, provision, and
subjects. It can allow them to practice after the examination on terms of equal treatment and process to
citizens. Nonetheless, when a foreign citizen studied or not in the country desires to take licensure exams
for architects through reciprocity, he/she must comply with the required documents and seal with the
Board of Directors from his/her country to register in the Philippines to take the examination with the
equal term with Filipino citizen.
As stated in Section 29, any person who utilizes or performs an architectural plan without becoming
registered, licensed, or degree holder of any permits is in compliance with the conditions of R.A. No.
9266, or any practice that forges or manipulates to be a professional, generates illegal copies of certificate
of registration and professional I.D., implementation of the strategy and design from any person, firm, or
company not duly registered to practice architecture, violations of the law are punishable by a fine of not
less than 100,000 but not more than 5,000,000, or by imprisonment for not less than six months but not
much more than six years, either by both, at the Commission's discretion.
