Consultation Procedure ‘The consultation of landholders whose lands is to be taken shall follow the following procedure: V/A written notice shall be sent to all concerned land holders and proof of receipt by such landholders shall be provided 2/The consul ion shall proceed where three fourth (3/4) or more of land holders whose land is wo be expropriated are present 3/ Where theee foruth of land holders are not present in the first mecting called under sub-attcle 2 of this Article, a second consultative meeting shall be called and conducted where more than half ofthe land holders are present 4/Where half of the landholders are not present in the consutative meeting called for the second time under sub-article 3 of this Article, a third notice shall be sent ‘out and the consultative meeting shall be conducted in the presence of any number of land holders. Protecting the Boundary of Expropristed Land VThe region or Addis Ababa or Dire Dawa City Adliinistrations: shall pay the compensation deposited with them to land holders and shall ensure protection of the boundaries of lands which are already expropriated, and compensation pard 2 Institutions that are installing utility Lines shall ascertain that the boundaries of lands expropriated and: compensation paid before entering into utility tine installation contracts 7. Common Provisions on Priority Right to Develop V/A request for priority right to develop may be lodged where a)The Woreda or Urban Administration approves that the land to be expropriated may be developed by the landholders according to the development plan byThe land to be expropriated is not assigned to investment of national oF regional significance, government infrastructure and utility Fines, green area, and complex infrastructures. ©)The investment proposed is allowed to be undertaken individualy or jointly 2/ The request to individually or jointly develop the land shall be submitted within 60(sixty) days since the consultation with residents on the expropriation of the land is conducted. 3/ It shall be presumed that the land holder residents do not have the intent to develop their land holding, where a request under sub-articte 2 of this Article is not submitted 4/ Management and administration and the procedure of the right to develp their land holding shall be determined in directive that shall be issued under this Regulation, 9.
