Whether or not the CA is correct in
heavily relying on the findings of the
OMB-Mindanao and affirming its
decision to hold petitioner liable
THE CA IS CORRECT. The findings of the OMB are
accorded great weight and respect, if not finality, by the
courts considering its specialized knowledge and
expertise over matters falling under their jurisdiction.
The findings of fact by the OMB are conclusive
when supported by substantial evidence — or
"such relevant evidence as a reasonable mind
may accept as adequate to support a conclusion.
The requirement is satisfied where there is reasonable ground to believe
that the petitioner is guilty of the act or omission complained of, even if the
evidence might not be overwhelming.

Therefore, the Court finds no cogent reason to overturn the OMB-


Mindanao's conclusions, more so in this case when such findings and
conclusions are affirmed by the CA.
