1. That we are the surviving heirs of the deceased FRANCISCA DENSO and LIZARDO
MEDINA;
2. That both deceased died intestate, without any Last Will or Testament, and without any
outstanding debts or accounts;
3. That both deceased left PORTIONS of a certain parcel of land covered by Original
Certificate of Title No. O-576, and more particularly described as follows:
A parcel of land ( Lot No. 6154 of the Cadastral Survey of Ormoc, Cad. Case No. 33, LRC Cad.
Record No. 1788 ), situated in the Barrio of Aslom Lao, City of Ormoc. Bounded on the NE., points 7-11,
by Aslom River; on the SE., points 11-13, by Dacong Suba River; on the SW., points 13-16, by No. 6155;
points 16-1, by Lot No. 6156; points 1-2, by Lot No. 6157; and points 2-3, by Lot No. 6158; and on the
NW., points 3-7, by Molagiliw Brook. Beginning at a point marked “1” on plan, being N. 15 deg.54’E.,
469.68 m. from B.B.M. No. 23, then ce
Beginnings; containing an area of EIGHTY SIX THOUSAND SEVEN HUNDRED THIRTY SEVEN
(86,737) SQURE METERS, more or less. All points referred to are indicated on the plan and are marked
on the ground; bearings true; dates of the Cadastral Survey, August 1928 – June, 1935.
4. That the above-stated landholding was further subdivided into 3 sub-lots according to
Subdivision Plan No. PSD-08-022754-D to wit:
6. That also during her lifetime, Francisca Denso sold a portion of Lot no. 6154-C with an
area of 20,000 square meters to Luisito D. Medina by virtue of a Deed of Absolute Sale
executed on September 30, 1988 under the Notarial Seal of Segulo R. Bangasan docketed
as Doc. No 231, Page no. 47, Book no. XLI, Series of 1988
8. That the above-described parcel of land is not tenanted and does not come within the
operation of the Comprehensive Agrarian Reform Program;
9. That the subject of this instrument is Lot 6154-B with an area of 28, 912 square meters
owned by Lizardo Medina by virtue of the Deed of Donation above-stated, and having
died without issue and a portion of Lot 6154-C with an area of 8, 913 square meters;
10. That pursuant to Section 1 of Rule 74 of the Revised Rules of Court of the Philippines,
and all being with full capacity to contract, we do hereby adjudicate unto ourselves the
land described above, in equal shares pro indiviso;
11. That FURTHER, and for and in consideration of the sum of THREE HUNDRED
THOUSAND PESOS (Php 300,000.00), Philippine Currency, receipt of which is hereby
acknowledged by us to our full and complete satisfaction, we do hereby SELL,
CONVEY, and TRANSFER by way of ABSOLUTE SALE, PORTIONS of the above-
described property more specifically Lot 6154-B with an area of 28,912 square meters
and portion of Lot 6154-C with an area of 8,913 square meters or a total area of 37,825
square meters unto SPOUSES ZOSIMO V. ADOBO and GEMMA GARCIA
ADOBO, their heirs, assigns and successors-in-interests, all our rights, interests and
participation over the above-described portions of land.
