COMPROMISE AGREEMENT

This Agreement executed this 02 day of May 2022 at Quezon City,

Philippines, by and between:

EMMANUEL PILAPIL of legal age, Filipino and a resident

of , referred as the “PLAINTIFF”, and represented by
____________________________

-and-

PETER MAURICE B. TORELLA, MARIA LOURDES B.

TORELLA, both of legal age, Filipino, and a resident of
Rivera Compound Del Rey Ville 1, Jordan Valley Baesa,
Quezon City referred as the Defendants, and represented by
Atty. Rosalinda Adriano-Montenegro.

WITNESSETH THAT:

WHEREAS, the PRIVATE COMPLAINANT has instituted LRC Case No.

2020-091-092 for the Surrender or Annulment of Transfer Certificate of
Title No. 010-2015001566 and 010-2015001567 against the defendant before
the Regional Trial Court Branch 294, Parañaque, City.

WHEREAS, the Defendant Maria Lourdes B. Torella also filed a Civil Case
No. 2021-007 for annulment of Auction Sale , Notice of Sale, Certificate of
Sale with Damages raffled to the Branch 257 of the Regional Trial Court of
Parañaque City ;

WHEREAS, the PRIVATE COMPLAINANT and Defendants have agreed

and decided to settle the the foregoing cases among themselves and the
Defendant offered to release the two (2) titles of the property subject of
this case in exchange the Private Complainant shall have the foregoing
LRC Case Dismissed.

NOW THEREFORE, for and in consideration of the foregoing premises,

the parties agree as follows:

1. Defendants undertakes to present Transfer Certificate of Title

No. 010-2015001566 and 010-2015001567 to the PLAINTIFF on the next
scheduled hearing under the following conditions to wit:

a. That, upon the signing of this Compromise Agreement,

Defendant will release to the Plaintiff, Transfer Certificate of
Title Nos. 010-2015001566 and 010;

b. That, simultaneously, the plaintiff will cause the withdrawal of

the instant case;

 c. That, the Plaintiff shall waive and renounce and forever
quitclaim whatever right/s or cause/s of action/s, criminal or
civil, subject of the afore-cited case as well as those that may
arise therefrom, in connection therewith or in relation thereto;

2. After the conditions have been met, PLAINTIFF shall cause the
permanent dismissal of the LRC Case No. 2020-091-092; Likewise the
DEFENDANT will cause the withdrawal of Civil Case No. 2021-007
Annulment of Auction Sale , Notice of Sale, Certificate of Sale with
Damages raffled to the Branch 257 of the Regional Trial Court of
Parañaque City ;

3. The execution of this Agreement shall not be deemed,

considered, construed, or interpreted in any way as an admission or
acknowledgement of liability of the defendants. The PLAINTIFF and
DEFENDANT entered into this Agreement out of a desire to avoid the
inconvenience of continued litigation and to put an end to their dispute
relating to, arising out of, or in connection with the pending LRC Case;

4. The PLAINTIFF and DEFENDANT voluntarily agree to the

provisions of this Compromise Agreement, and shall execute the same
with all the diligence required by law;

5. The foregoing covenants are not contrary to law, morals, or

public policy and the PLAINTIFF and DEFENDANT bind themselves to
comply strictly with their undertakings.

IN WITNESS WHEREOF, the parties hereby submit this

Compromise Agreement for the Approval of the Honorable Court and that
a Judgment be rendered thereon.
