E-AUCTION RESULT Payment Within 03 working days from the date of intimation of
CONFIRMATION & such provisional acceptance, the highest/ successful bidder has
PAYMENT to pay an amount equivalent to 10% (Ten Per cent) of his bid

• SELLER: Seller referred in this condition of sale is L&T Construction (Larsen & Toubro
Construction).
• SERVICE PROVIDER/ AUCTIONEER: Accurate Auctioneers (hereinafter referred
to as “Accurate Auctioneers.”) is an e- auction service provider appointed by the Seller to
facilitate Tender- cum- virtual auction by the Seller. Accurate Auctioneers will only
facilitate online auction and are considered as third party not particularly interested in the
item/ s being sold on behalf of the Seller.
• BIDDER– Any person representing as an individual OR, as proprietor OR, as a partner
OR as an authorized representative of any company and who is paying the caution money
deposit as mentioned against each lot separately and registered at Accurate Auctioneers is
considered as a Bidder. One individual can represent as a Bidder on his own behalf and
on behalf of other companies provided, he registers himself in those capacity separately,
i.e., for each representation he should pay separate caution money deposit.
• BUYER/PURCHASER: Any Bidder who has participated in the Auction and is the
highest Bidder of a particular Lot in the E-Auction or E-Tender is termed as Buyer. The
highest bidder will pay Rs. 1,500/- plus GST as service charge for auction.
SPECIAL TERMS & CONDITIONS OF THE E-AUCTION:
1. Quantity given are either in No or in LOT. Buyer must clear the entire Machine as
One or as Lot as given here as per instructions from L&T Ltd.
2. No segregation of the items of any Machine or lot is allowed inside the L&T Ltd
premises.

3. All payments except EMD/CMD to be made by way of Fund Transfer to the following
bank Auctioneer A/c.

4. EMD/CMD shall be paid to Auctioneer by the bidders and the same shall be
transferred to L&T of the successful bidders.
5. The EMD will not be adjusted in lifting payment; it will be returned to the buyer after
lifting completion confirmation from Plant in Charge.
6. In case of Failure to make the payment or make payment within prescribed timeline,
the EMD of the H1 Bidder will be transferred to L&T Account by Auctioneer. Such
transfer will be termed as forfeited amount, and bidder shall have no right on his Emd,
after forfeiture has been done.
7. Buyer shall inform plant for vehicle placement in advance to start lifting activity.
8. Lifting of the material to be completed on or before scheduled date.
9. Buyer shall keep all documents PAN, GST, authorization Letter (on letter head) and
shall submit before lifting.
10.If P&M is not lifted as per specified time as above, Entire EMD Submitted to us will
be forfeited without any further notice.
11.Personnel representing agencies (transport-Labourers-Hydra etc.) hired by buyers,
Such personnel/Agencies are solely responsible for any act observed for unethical
practice during Dismantling/loading/unloading etc., In this regards Buyers has to
ensure settlement/Penalty etc., of such issues immediately, or else buyers will be
responsible for agencies act, & such decision by L&T will be final &
binding/unarguable in any court of law.
12.Buyer must arrange Safety Gadgets by Workmen; without PPE workmen will not
allow inside the L&T premises.
13. Buyer must accept L&T weighbridge, if applicable as a final weighment.
14.After the EHS Engineer inspection confirmation only L&T will allow Gas Cutting.
For scrap cutting at site, we can allow “DA + Oxygen” or “Nanocut + Oxygen”. LPG is not
allowed.

15.Buyer has to place the vehicle on 09:30 AM TO 03:30 PM only. No Loading and
Disposal is allowed between 01st To 05th of Every Month.
16.Buyer has to ensure all the workmen should have Aadhar card or Voter Id card,
without ID card workmen will not allow at L&T premises.
17.Buyer has to organize the New Gen Crane for Lifting Activity. The Hydra Cranes are
not allowed inside the premise.
18.The above Plant & Machineries will be sold on “As is Where Is basis & on no
complain basis.
19.Relevant taxes, GST, TCS will be applicable on bid value.
20.For Inspection bidders are requested to contact with L&T Constructions Team.
21.All costs towards dismantling /Pickup/Loading & Transportation charges in buyer’s
scope.
22.The Successful bidder has to deposit the entire 100% payment within 15 days
from the date of Confirmation from Auctioneer.
In case, if the agency chooses to pay part payment, the minimum payment to be 25 Lakhs or
Payment equivalent to 02 Loads or payment equivalent to 20% of Auction Value whichever
is higher, to be Transferred to L&T A/c one day earlier to the lifting date. In any case, the No
of Installment of Part payment cannot be more than 04 Installments may please be noted.
The Time Extension may be given based on the situation like Covid etc. for lifting the
Materials. However, no extension shall be provided for Remitting the Auction Money, which
is to be completed in the given time period of 02 Weeks/15 days. When the buyer chooses to
pay part payment, L&T shall decide which material Plant to be lifted first, which shall be
much lower than the Installment Amount.
However, if the buyer pays the 100% payment upfront, they can choose which Machinery to
move put first.
23.The agency has to remove the materials within 15 Days from the date of 100%
payment with or without Cutting. Else, a holding fee may be levied. Other lot that
does not require cutting will have to be cleared and move out within 01 week.
24.Offline quotes will not be accepted, even from unsuccessful bidders once the auction
is over. Bidders are expected to obey the rules and not to submit counteroffer in
disguised names (i.e. from relative/sister concerns). It will be considered under
sabotaging tactics, as a result L&T might debar such unethical bidders for all the
upcoming e-auctions. Kindly do not contact L&T team directly when the auction is in

process. It will lead to forfeiture of the EMD that is held as security deposit with
Auctioneer.
25. Successful bidders have to get register with L&T by submitting the following
documents before delivery.
a) GST Registration form b) PAN Card c) Cancelled Cheque.
d) Turnover Statement/ITR Statement (FY 2020-2021) e) Contact Details & Address (To be
mentioned in Letter Head)

26. If any Motor Vehicle is in Auction List, unless specified otherwise, the Vehicle is
assumed to be Transferred as Vehicle ‘with RC Book’ and 28% GST is applicable.
27. In case, if L&T Chooses to Cancel the RC Book and Transfer the Machine to the
buyer as an obsolete/condemned/scrap Machine, L&T shall take 4 weeks from the date
of payment from the buyer to complete the RC Book Cancellation Process.
Terms in Brief

• Pre- paid EMD/ CMD (refundable) for E-auction: As mentioned against each lot
separately for participating in any of the LOTS EMD/ CMD MUST be submitted through
NEFT/ RTGS in Auctioneers Account as mentioned.
• Return of CMD/ EMD’s of unsuccessful Bidders will be done with in 5 working days,
subject to request by the unsuccessful bidders
• To BID for LOT basis. The rate of GST or any other statutory levies surcharge etc. will
be applicable Extra and payable by the Buyer as prevailing on the date of actual physical
delivery of materials.
• Payment and Delivery Details.: Confirmation of the bid Acceptance/Final payment &
status will be communicated by Auctioneer on the behalf of the Seller (Intimation will be
done through Registered E-Mail ID at Auctioneer’s Portal). All payments are to be done in
the SELLER’S Account.
• After Acceptance, the Bidder must deposit the final Amount within 7(Seven) Working
Days.
• Delivery should be taken within 7 (Seven) days after Invoice has been generated
• Note: Auto-Time Extension is 3 minutes (unlimited) in this e-Auction

To participate in E-Auction, the bidder must pay Earnest Money Deposit (EMD) as per
detail mentioned above for item interested to go for E-Auction. Those bidders who have
submitted their documents (ANNEXURE NO.1) need to submit EMD in the similar
pattern and must accept the terms and condition on the website. For participation in E-
AUCTION, bidder must register and submit ANNEXURE NO.1 day before e-auction

1. Bidder participating for lots must register himself at Error! Hyperlink reference not valid. &
On payment of Earnest Money Deposit he will be allowed to participate in the E-
Auction

2. Identity/username (email address) and Password must be entered into Website


www.accurateauctioneers.in for the DEMO/ MOCK e-auction and Actual Online
Auction method of Bidding.

3. The highest bid received in e-Auction will be accepted as final highest bid for
confirmation of lot in the e-Auction.

4. Price Basis: -Rates should be quoted excluding GST &TCS and other taxes and duties.
Any increase in Govt. levies or any fresh statutory levies after the submission of the
bid will be to the sole account of the bidder. The vehicles for transportation of the
material/scrap will be arranged by the purchasers.

5. Goods are being sold on 'AS IS WHERE IS and WHATEVER IT IS BASIS' and “NO
COMPLAINT BASIS”.
6. SELLER. reserves the right to accept or reject any offer for any reason whatsoever or
even without assigning any reason. In the event of any dispute at last or highest bid,
the same shall be resolved through Mutual discussions of seller & Auctioneer.

7. Offers received in respect of lots sold subject to confirmation shall remain open for a
period of 30 days from the date of sale. If the offer is withdrawn within 30 days, EMD
and the Security Deposit paid will be forfeited. In case the sale is not confirmed within
30 days, the purchaser if he so desires, can withdraw his offer at any time before
confirmation of sale and seek refund of EMD and the security deposit. However, he
shall have no right to withdraw his offer once the sale is confirmed. If the offer is
withdrawn after the confirmation of sale, EMD and the Security Deposit will be
forfeited.

8. Accurate Auctioneers takes no responsibility of the quality, quantity, documentation
details of sellers. The buyers agree to defend indemnity and hold harmless Accurate
Auctioneers from any loss, damage, cost and expenses caused by any reason during
this transaction. In no event Accurate Auctioneers shall be liable for any loss for the
transactions by business, revenues, profit, costs direct and incidental, consequential, or
punitive damages of any claim. Participation in the Auction will be termed as
conclusive proof that bidder is satisfied with material.

9. Goods are sold on the assumptions that the bidder has inspected the lot prior to
bidding and know what he is bidding for. No complaint shall be entertained after the
lot is allotted.

10.Any damage or loss caused to any material, equipment’s, machines, building or,
other property belonging to the company's visitors or other contractors resulting from
purchaser or any of the purchaser's men's negligence shall be liable to made good by
the purchaser. The company shall not be responsible for any claim of damage/loss to
property and / or persons of purchaser arising due to any mishap while working in the
company.

11.It is the responsibility of the successful bidder to arrange dismantling/loading of


material manpower force at their own cost.

12. All bids placed are legally valid bids and are to be considered as bids from the bidder
himself. Once the bid is placed, the Bidders cannot reduce or withdraw or cancel the
bid for whatever reason and no communication will be accepted. If done so, the seller
will forfeit the EMD

13.Any lot or part thereof may be withdrawn from the sale at any time before it is
physically delivered out of the site without disclosing any reasons for such
withdrawal. However, if any payment has been made it would be refunded without
Interest.

14.The goods shall be lying in the premises after the conclusion of the bidding at the sole
risk and cost of the purchaser in all respect and the purchaser should take the delivery
at his own expenses at the earliest and in any case not later than the period prescribed
above.

15.Auction Sale Invoice will be issued in the name of the original bidder as recorded in
the “Acceptance Form”. Any further correspondence will be only with the bidder’s
name and address as recorded in the “Acceptance Form”.

16.The bidder shall be responsible for any damage that may be done to premises / fittings
of sellers while removing the lot or lots purchased by them. The authority may at its
option arrange to make good such damages and the bidder shall pay for the same on
demand.

17.In the event of failure on the part of the successful bidder to fulfil his contractual
obligations SELLER. / ACCURATE AUCTIONEERS. reserves the right to debar
such bidder from participating in any future auction/tender auction on BEHALF OF
THE SELLER

Chapter -2 Disclaimer
1. Accurate Auctioneers runs its business based on a robust website & is having dedicated
server hosted at pan India Network from a third-party hosting company and hence shall
ensure smooth running of the website. The Seller/ Auctioneer will not be held responsible
for any failure of power, network, server, hosting server, internet connectivity, ISP or
otherwise at the Bidder’s end or at The Seller/ Accurate Auctioneers, directly or indirectly
affecting online method of Bidding.
2. Neither the Seller nor Auctioneer takes responsibility of the quality, quantity,
documentation details of the Buyers/ Seller. Both the Buyers & Sellers agree to defend
indemnity and hold harmless Auctioneer from any loss, damage, cost and expenses
caused by any reason during this transaction. In no event, shall the Auctioneer be liable
for any loss for the transactions by business, revenues, profit, costs direct and incidental,
consequential, or punitive damages of any claim.
3. The Bidder agrees to have discussed all the related matter regarding this transaction and
have understood in full that Accurate Auctioneers has provided his service as an Auction
Service Provider and has nothing to do any further, especially with regards to quality,
warranty, guarantees, delivery schedules, payments, rejections, transportation, legal laws
and regulations, etc., to be followed from time to time. Since Accurate Auctioneers does
not possess knowledge base of the commodities under transaction, both the parties agree
that the matter contained in the materials as a part or does not violate any applicable law.
No complaint will be entertained after the lot is successfully bid and awarded after
the closing of the Auction.

Chapter- 3 PARTICIPATION

1. The prospective Bidder must register with the Auctioneer on their website
(www.accurateauctioneers.in). The prospective Bidder shall have to deposit Caution
Money Deposit (CMD/EMD) as mentioned for participating in any of the LOTS through
NEFT/RTGS in Accurate Auctioneers’ Account. The details are already mentioned in the
Document.
2. On payment of CMD/EMD for online auction, Seller/ Auctioneer will allow the User to
participate and Bid
3. The Bidders SHOULD NOT disclose their PASSWORD to anyone and safeguard its
secrecy.
4. The Bidders are advised to change the Password. Refer the “Steps of Actual Bidding
Procedure”.
5. CASH will not be accepted at any cost
6. E-Tender: The Tender Bidder should pay an EMD as mentioned.
7. In E-tender, the Bidder must enter the Amount and should verify it after entering. The
flexibility has been provided by the Auctioneer to edit the E-tender Amount entered, the
change will only be allowed till the closing time of the E-Tender.
8. The Bidder must not declare his E-tender amount to any other Bidder/Person
9. Once the E-tender is closed, No Further changes shall be allowed, though the Bidder can
improvise his offer in the E-Auction.
Chapter-4
CONDITIONS APPLICABLE TO “ONLINE” AUCTION METHOD OF BIDDING
1. Time Extension: Auto-Time Extension is 3 minutes unlimited in this e-Auction.
2. Training: Accurate Auctioneers will provide training (on-line) if required by the
Bidders at a mutually convenient date and time before the Auction.
3. Bids: All Bids placed are legally valid Bids and are to be considered as bids from the
Bidder himself. Once the Bid is placed, the Bidders cannot reduce or withdraw the Bid
for whatever reason. If done so, the Seller will forfeit the EMD. The highest and the
latest Bid on the Auction shall supersede all the previous bids of the Bidder. The
Bidders may please note that in the event of a manual bid amount matching that of a
Maximum limit of Auto-Bid, the Manual Bid will prevail and be considered. The
Bidder with the highest offer/ Bid does not get any right to demand acceptance of his
Bid.
4. Auto Bid: Auto Bid facility is provided to Bidders intending to place a maximum
value for a lot/lots.
5. Auto Bid is not a confirmed Bid. It is only the maximum ceiling amount set by the
Bidder to enable the auction engine to place Bids on his behalf, whenever he is out
Bid, up to the ceiling set by him.
6. Once Auto Bid is set, the auction engine will consider the ceiling amount for the next
possible Bid only, depending on the highest Bid prevailing at that point of time and the
increment amount prescribed for that lot. The minimum increment is set by default and
the Bidder doesn’t have the capability to change the minimum increment.

7. VALIDITY: The Online Auction Bids and E-Tender Bids will be valid for a period of
30 (Ninety) calendar days from the date of closing of e-Auction, excluding the date of
closing. In case, the 30th day falls on a holiday or remains closed, validity of such
Bids will be deemed to be automatically extended to be valid up to the next working
day of the Seller.(Excluding Auction day)
8. PERIOD OF CONTRACT: Up to the validity period of the final Delivery / Release
Order issued by the Seller.
9. PAYMENTS: All payments for EMD/ Balance amount are to be made by Demand
Draft / Pay Order/RTGS/NEFT on any Scheduled / Nationalized Bank Drawn in favor
of “Seller .” or in the Account of Seller as per Intimation E-mail.

10.The Bidders participating for all lots must make the balance payment & take delivery
of all the lots allotted to him.
11.CMD/EMD amount can be adjusted only during delivery of the last lot, in case of
multiple lots being offered.
12.Penalty for non-payment of the Final payment will be forfeiture of CMD/EMD
Amount or deposited amount, which is higher. Further, such Bidder’s will be barred
from participating in our future auctions.
13.In the event of any dispute about non-lifting / non-availability of inspected materials
etc. and forfeiture of 'EMD', Auctioneer will not be held responsible for the loss /
forfeiture and purchaser shall keep Auctioneer fully indemnified and harmless against
any claim and proceedings.
14.Seller ’s management reserves its right to accept or reject any offer for any reason
whatsoever or even without any reason.
15.The highest Bid will only be provisionally accepted on Subject to Confirmation (STC)
basis and hence the highest Bidder does not get any right to demand acceptance of his
offer.

Chapter -5
INTIMATION TO HIGHEST BIDDER

Only the highest Bidder will be issued an Intimation E-Mail on closing of the Auction. Such
bids will be Subject to Confirmation by the Seller.
1. For the Bidders who bid through Online Auction, the Confirmation will be primarily sent
through E- mail. Please note that the date of sending e- mail will be considered as Date of
Intimation.

2. If no Intimation reaches for reasons beyond our control, the Buyers are expected to take
efforts to find out the status. Non-receipt of Intimation should not be an excuse for Non-
payment.
3. Bidders/ Tenderers must, therefore, keep a watch on their incoming e-mail in this regard.
Seller or Auctioneer will not be liable for wrong E-mail ID registered by the Bidder or for
return of the mail for mailbox being full.
4. CMD/ EMD will be returned to the un-successful Bidders on the day as mentioned in the
Schedule. The un-successful Bidders will have to collect the refund from Seller Office
by hand. For the outstation Bidders, the same will be sent through speed post.
5. Sale order will be issued in the name of the original Buyer as recorded in the Bid
logs/System generated Report. Any further correspondence will be only with the Buyer’s
name and address as recorded in the report only.
6. Lots sold on STC Basis will be confirmed or rejected within a 30-calendar day time
(excluding the date of Auction) through Auctioneer to deposit the balance Sale Value
along with applicable Taxes and other charges within 07 (Seven) working days from the
date of issue of FINAL CONFIRMATION LETTER by Accurate Auctioneers. (excluding
the date of issue). If the Buyer fails to make payment within the stipulated period, the
EMD/CMD or any deposited Bid amount will be forfeited, and such Bidders will be
barred from participating in our future auctions.
7. The Weight/Number/Quantity against the respective Lots are indicated approximately,
which in actual, may turn out to be more or less than the indicated quantity. In case of
actual quantity turning out to be less than the indicated quantity after due completion of
the lifting by the Buyer within the stipulated period, the Buyer shall not be entitled to
claim any damages, loss of interest or compensation on any other account.
8. The Seller / Auctioneer shall not be responsible for any loss or liabilities of the Bidders if
the purchased lots could not be delivered due to circumstances beyond the control of
Seller / Auctioneer.
9. All Bidders and Buyers shall be deemed to have read and understood these conditions of
sale herein before listed and be bound by these conditions and to give their bids in E-
Auction/E-tender, subject to these terms and conditions.
10.The Bidders must clearly note that there is no provision whatsoever to participate in the
auction by giving counter conditions at variance with the terms and conditions prescribed.
Any communication received from the Bidders containing such counter conditions at any
time shall be ignored.
11.The Seller reserves the right to modify and amend the Terms & Conditions and announce
the same if necessary, at any time prior to the commencement of the auction.
12.The Employees of Seller , Accurate Auctioneer and their relatives will be barred from
participating in the online auction, unless specifically approved by the Management
of Seller
13.In the event of any dispute, the same will be referred to a sole arbitrator to be appointed
by the Managing Director of the Auctioneer and the Arbitration proceedings would be

governed by arbitration and Conciliation Act 1996. Charges of Arbitration will be paid by
Buyer/Purchaser only. Place of Arbitration shall be Delhi Only.

14.The Seller / Auctioneer will not be liable for any claim and purchaser/Buyer shall keep
fully Seller/Auctioneers indemnified and harmless against any claim and proceedings of
any of their own or against the employees or others.

Chapter -6 INSPECTION

1. Where specimen samples are shown it is clearly understood that the quality of the
material inside the Premises. may not necessarily be of exact quality, quantity, size,
dimensions, specification features etc.
2. The Bidders should carry the Catalog along with them for the inspection of material at the
Site, which will be subject to the usual security rules of the Seller. Any clarification
required may be sought by the Bidders from the Seller at the time of inspection and no
dispute regarding the material will be entertained thereafter.

Chapter -7 PAYMENT
1. All payments for Caution Money Deposit/ EMD/ Security Deposit are to be remitted by
way of Bank Pay Order or by Demand Draft of any Scheduled Bank in favor of the Seller
“Seller ” or through NEFT/RTGS. Bank details of the Seller for the Final payment will be
mentioned in the Intimation mail sent by the Auctioneer.
2. The Seller will retain the right to refuse acceptance of demand draft/ Pay Order/Bankers
Cheque issued by any bank, if the Seller has reason to believe that realization against the
DD/PO is doubtful.

3. If any Rates, Levies, Taxes, Cess or Charges are due on the Buyer and / or any License /
Permit is required under any Central / State / Local Law in respect of the goods purchased
by the Buyer, the onus of paying such Levies / Taxes / Charges and / or obtaining such
License / Permit will rest entirely on the Highest Bidder.
4. In case of non-lifting of goods, all the payments made against lot will be forfeited.
5. If any additional challan / delivery order copies are required to comply with check post
requirement, the same may be arranged by Buyer themselves by taking photocopies.
6. The goods shall lie at the sole risk and responsibility of the Buyer in all respects from the
time of sale and must be taken away by the Buyer at his own expenses.
7. No interest shall be paid on EMD, Security Deposit or any money deposited by the Buyer
in case the material is not delivered for any reason.

Chapter -8 DELIVERY

1. On receipt of full Sale Value along with applicable GST & other Charges by the Seller,
the Seller shall issue final Sale/ Delivery / Release Order to the Buyer thereby enabling
him to take delivery of the Goods within Seven Working Days.

2. In case the Bidder does not take delivery of the goods within the above-mentioned
timeline, he can be allowed to do so within next 5 days, subject to penalty of Rs.2000/-
plus GST per day. This being subject to Seller’s Management’s discretion, the Bidder
cannot claim taking delivery as a matter of right once the specified delivery dates/Days
are over.
3. Delivery will be given only during the working days and within the working hours of the
Seller.
4. In case the Seller is unable to deliver the goods within the specified time due to
unforeseen administrative reasons, then the Seller shall grant suitable extension of
delivery period to the Buyer without any other related charges till the expiry of such
extended period. In such eventually, however, the Buyer shall not be entitled to claim
any compensation for such delay.
5. The successful Bidder shall co-ordinate the date and time with the Seller for placement of
Trucks to ensure speedy removal of Goods. The Seller will allow the lifting of goods on
all working days.
6. The goods sold shall be removed by the Buyers from any one side of the Lot as per the
sole direction of the Seller and no segregation of items from the sold Lots will be
permitted. The Goods will have to be lifted from one Lot only at a time. While taking
delivery of the Goods, it will be at the discretion of the authorized representative of the
Seller to direct the manner / order in which the Goods or lots shall be removed. No
segregation of the items of any lot is allowed inside the seller premises.
7. Segregation of Goods will not be allowed at Seller’s premises. Breaking/ cutting may be
allowed to the extent necessary for facilitating loading into vehicles as per the discretion
of the Seller’s officials.
8. Resale will not be recognized and the delivery orders will be issued in the name of the
actual/ original bidder only. If the Goods/ Materials are found to be other than described
in this catalogue, Seller. reserves the right to refuse to deliver the Goods/ Materials and
reject the bid at any stage. Any amount paid in part or full shall be refunded without any
interest.
9. Buyer and his representatives are subject to the security rule of the Seller in force while in
the premises. The Buyer and his workmen agents or representatives shall not commit any
nuisance, theft or indulge in any antisocial activities in the premises and the Buyer shall
be liable for the good conduct, safety & discipline of his workmen. In case of any such
activity, delivery will be suspended and strict action as per law will be taken including
forfeiture of EMD.

10.The Buyers shall be responsible for any damage that may be done to premises / fittings of
the Seller in the course of removing the lot or lots purchased by them. The authority may
at its option arrange to make good such damages and the Buyer shall pay for the same on
demand.
11.The Buyers’ workers engaged within the Seller’s premises will be governed by the
Labour laws and rules, Factory Acts and Rules and Safety / Security Rules as applicable.
It shall be the responsibility of the Buyer to see that the statutory provisions are complied
with.
12.The Seller will not be in any way responsible for failure to deliver the goods as per
delivery schedule due to causes beyond their control such as strikes, lockouts, cessation
of labour, shortened hours, acts of God or other causes or contingency whatsoever. The
Buyer shall not be entitled to cancel the contract and the period of delivery shall
automatically be extended accordingly.
13.Delivery of Scrap: All type of scrap containers will be subject to 100% examination in the
presence of Customs officers prior to the delivery of the goods to the Bidders. Further,
there is no time limit for final approval in case of adjudication and other Customs
formalities. The Seller will not be held responsible and no EMD/ Full payment will be
reimbursed to the Bidder due to delay in the Customs procedures.
14.No gas cutting equipment’s or any equipment or any equipment, which are likely to cause
damage, will be allowed in the premises. Only safe oxy-acetylene gas cutting equipment
will be allowed with written permission. The decision of the Seller’s Safety Officer or his
authorized representative shall be final in this regard.
15.If any accident or damage to the property / life etc arises by reason of any act of
negligence / omission / default or non-compliance with any of the Terms & Conditions of
statutory regulations or rules and regulations applicable within the Seller’s premises, on
the part of the Bidder / his representative or employees, resulting in death or injury to any
persons or damages to the property of the Seller or any third party, then in such an event,
the Bidder will have to pay compensation to such person including the employees of the
Seller for such accident or injury / death or damage caused to their employees or to any of
the Seller’s employees or to others or to the Seller’s property. The Bidder shall in such
event, keep the Seller fully indemnified from any demand, claims or proceedings thereof.
16.The Seller /Accurate Auctioneers will not, at any time, be responsible for any injury
caused due to accident within premises or at the place of work either to the Buyer or his
representative / labour etc. and the Bidder will make proper arrangements for any claim
arising out of the employment under any status. It is the responsibility of the Bidder to
provide necessary safety appliances (like hand gloves / safety shoes etc.,) to the laborers,
who are engaged for loading the materials.

• DEMO/ MOCK Auction: For the Bidders who have indicated non-familiarity with e-
Auction, training on a DEMO/ MOCK Auction will be arranged with prior appointment.
Only those Bidders who have registered themselves for the Auction for the auction by
submitting the “Acceptance Form” and have paid the EMD can participate in this
Auction. No training will be given during the day of e-Auction.
• A note of caution for the Bidders: Bidders may encounter certain unforeseen problems
such as time-lag, heavy traffic, system/power failure at the Bidders end. To avoid losing
out on bidding because of above-mentioned reasons, it is advised not to wait for the last
moment. OR they can submit the E-tender before.
