መግቢያ
Preamble
የክልሉ ፍርድ ቤቶች የዳኝነት ሥልጣን እንደገና አይቶ
Whereas, it is found necessary to redefine the powers of

ሕገመንግስት አንቀጽ 51 ንዑስ አንቀጽ ፫(ሀ) መሰረት

የሚከተለው ተሻሽሎ ታውጇል፡፡ Now therefore , in accordance with article 51(3,a) of the
revised constitution of the southern, Nations
Nationalities’ and Peoples Regional state it is hereby
proclaimed as follows;
 ክፍልአንድ PART ONE

ጠቅላላ General

1. አጭርርዕስ 1. Short Title

This proclamation may be cited as the “Re-revised
ይህ አዋጅ እንደገና የተሻሻለው የደቡብ ብሔሮች፣
ብሔረሰቦችና ሕዝቦች ክልል መንግስት ፍርድ ቤቶች
Courts Proclamation No 130 /2009 of the Southern

አዋጅ ቁጥር ፩፻፴/፪፼፪ ተብሎ ሊጠቀስ ይችላል፡፡ Nations, Nationalities and Peoples Regional States

2. ማሻሻያ የተደረገባቸው አንቀጾች

2. Revised Articles
የተሻሻለው የደቡብ ብሔሮች ብሔረሰቦችና Articles 6 and 7 of the revised proclamation
ሕዝቦች ክልል መንግስት ፍርድ ቤቶች አዋጅ ቁጥር No.43/2002 of the Southern Nations,
43/94 አንቀጽ ፮ እና አንቀጽ ፯ ቀጥሎ ባለው Nationalities and Peoples Regional State were
amended as follows:
መልኩ ተሻሽሏል፡፡
3. የከፍተኛ ፍርድ ቤቶች የዳኝነት ሥልጣን 3. Jurisdiction of the High Court
፩. የከፍተኛ ፍርድ ቤት በፍትሐብሄርና በወንጀል ሥነ- 1. High Court shall have the first instance
jurisdiction over the following case,
ሥርዓት ህጎችና በሌሎች ህጎች ውስጥ ከፍተኛ
notwithstanding to matters falling under the
ፍርድ ቤቶች እንዲያዩዋቸው እንደተጠበቁ jurisdiction of the high court’s pursuant to
ሆነው the Civil and criminal Procedure Codes and
other laws;
ሀ) ግምታቸው ከ 300.000 (ሶስት መቶ ሺህ ብር)
በላይ የሆነ የፍትሐብሄር ጉዳዮች፣

ለ) በፌዴራል የመጀመሪያ ደረጃ ፍርድ ቤት ስልጣን a. Civil cases involving and amount in excess
ስር የሚወድቁና በውክልና በተሰጡ of 300.000 Ethiopian birr,
ጉዳዮች
b. Matters falling under the jurisdiction of the
ሐ) አንዱን ጉዳይ ከስሩ ካሉ የወረዳ ፍርድ ቤት
ወደ ሌላ የወረዳ ፍርድ ቤት ወይም ወደ
Federal First Instance Court by delegation;
ራሱ እንዲዛወር በሚቀርብ ጥያቄ፣
c. Application for change of venue from one
መ) አንዱን ጉዳይ በስሩ ያሉት ሁለት ወይም ከዚያ
WoredaCourt to another Woreda court or
በላይ የሆኑ የወረዳ ፍርድ ቤቶች
to itself when both WoredaCourts are
ስልጣናችን ነው ብለው የያዙት ወይም
under its supervision
ስልጣናችን አይደለም ብለው የመለሱት
እንዲሁም በጉዳዩ ላይ ተገቢው ትዕዛዝ
d. Application for an order when two or more

የመጀመሪያ ደረጃ የዳኝነት ሥልጣን
or disclaim jurisdiction over a case,

አ/ ካ
 ሠ) ሆኖም በዚህ አንቀጽ (ሐ) እና (መ) መሰረት e. However, order given under sub article(c)
በሚቀርብ ጥያቄዎች ላይ የሚሰጠው and (d) of this articles shall be subject to
no appeal
ትዕዛዝ ይግባኝ አይኖረውም፣

፬. የወረዳ ፍርድ ቤቶች ሥልጣን

፩. ግምታቸው እስከ ብር 300.000 (ሶስት መቶ ሺህ
ብር) የሚሆኑ የፍትሐብሄር ጉዳዮችን
ግምታቸው በገንዘብ ሊተመን በማይችሉ ጉዳዮች
ላይ የመጀመሪያ ደረጃ የዳኝነት ስልጣን አለው፣
4. Jurisdiction of the Woreda Court
1) The Woreda courts shall have jurisdiction over
ወይም cases involving an amount not in excess of
300.00 Ethiopian Birr or cases that the value of
which cannot be expressed in money

፪. ከማህበራዊ ፍርድ ቤቶች በይግባኝ የሚቀርቡ

ጉዳዮችን የማየት ስልጣን አለው
2) Appellate jurisdiction over cases social court
፭. የመሸጋገሪያድንጋጌ

5. Transitory provision
ይግባኝ ያልደረሱ ውሳኔ ያልተሰጠባቸው በክርክር ላይ
All pending cases, which have not been rendered
ያሉ ጉዳዮች ሁሉ በዚህ አዋጅ መሰረት ፍጻሜ
decision and not taken appeal, shall be disposed in
ያገኛሉ፡፡
accordance with this proclamation

፮. አዋጅ የሚጸናበት ጊዜ

ይህ አዋጅ በደቡብ ነጋሪት ጋዜጣ ታትሞ ከወጣበት

ቀን ጀምሮ የጸና ይሆናል፡፡ 6. EffectiveDate

ሐዋሳ This proclamation shall come in to force of the date

of its Publication on the Debub NegaritGazeta.
