This Contract of Guarantee is made on this

WHEREAS the EMTI is willing to cover, the
training costs in accordance with the terms and ለሚኖርበት የወር/የሳምንት አበል ብድር
conditions set forth in the Enrollment
እንዲሁም የትምህርት ማመቻቻ የቅድሚያ
Agreement for Maritime Education and Career
development; ክፍያ በስምምነቱ መሰረት ስለመከፈሉ ዋስ

WHEREAS, the guarantor agreed to secure ለመሆን በመስማማቱ፤

the payment of the Academic Facilitation
መርከበኛው ስልጠናውን ከጨረሰ በኋላ
Advanced Payment and the monthly/weekly
stipend loan that will be covered by the EMTI, ኢ.ማ.ማ.ተ በሚያመቻችለት የስራ መደብ

WHEREAS, it is being clear that where the ሪፖርት በማድረግ ለመቀጠር ፈቃደኛ ሳይሆን
seafarer decides not to report to work arranged
ቢቀር ወይም ስራውን ከጀመረ በኋላ ከስራ
for her/him by the EMTI after the completion
of the training or defects from her/his job after ገበታው ላይ ቢጠፋ ኢኤምቲአይ በዚህ ውል
commencing the work, it will obviously አማካኝነት ሊደርስበት ያሰበው ግብ ላይ
jeopardize the achievement of EMTI’s goal;
መድረስ የማይችል መሆኑ ግልጽ በመሆኑ፤
WHEREAS, it is necessary to ensure
repayment of the Academic Facilitation
Advanced Payment that will be covered by ኢ.ማ.ማ.ተ መርከበኛውን ለማሰልጠን
the EMTI to train the Seafarer and the
የሚያወጣው ወጪ ተመልሶ የሚከፈል
Guarantor hereby agreed to be jointly and
severally liable for the payment of the መሆኑን ማረጋገጥ በማስፈለጉና ዋስ

Academic Facilitation Advanced Payment በአንድነትና በነጠላ ሃላፊነት ኢ.ማ.ማ.ተ

that will be covered by the EMTI,
መርከበኛውን ለማሰልጠን የሚያወጣውን
NOW, THEREFORE, the parties hereto
have made the following agreement: ውጪ ለመተካት የዋስትና ግዴታ ለመግባት

የተስማማ በመሆኑ ይህ ውል ከዚህ በታች

Article 1
በተመለከቱት ዝርዝር ድንጋጌዎች መሰረት
Definitions
 ተደርጓል፡፡
“EnrollmentAgreement” shall mean
Enrollment Agreement for Marine Education
and Career Development entered between the አንቀጽ አንድ
Seafarer and EMTI.
“Maritime Education” shall mean marine ትርጓሜ

studies training provided by EMTI or its

cooperating partner as provided in the
“የቅበላ ስምምነት” ማለት የማሪታይም
Enrollment Agreement.
“Seafarer” shall mean the student whose name ትምህርትና ሙያ መበልፀግ ቅበላ ለመስጠት
appears on the first page of this Agreement. በመርከበኛው እና በኢ.ማ.ማ.ተ መካከል
“Guarantor” shall mean the Seafarer
የተደረገ ስምምነት ነው፡፡
Colleague who in the past was or currently is
enrolled with EMTI pursuant an Enrollment “የማሪታይም ትምህርት” ማለት
Agreement. በኢ.ማ.ማ.ተ. ወይም በቅበላ ስምምነቱ
“PredictiveAssessments” shall mean እንደተገለጸው የኢ.ማ.ማ.ተ. ተባባሪ አጋር
Psychological Examinations and Reliability በሆነ ድርጅት የሚሰጥ የማሪን ትምህርት
Examinations. “Psychological Examinations” ነው፡፡
include any examinations utilized by EMTI to
“መርከበኛ” ማለት በዚህ ስምምነት
determine suitability of a Seafarer to be
የመጀመርያዉ ገፅ ላይ ስሙ የተገለፀዉ ተማሪ
employed for service at sea. “Reliability
ነዉ፡፡
Examinations” include examinations utilized
“ዋስ” ማለት ከዚህ በፊት ወይም በአሁኑ ጊዜ
by EMTI to support security scrutiny,
በኢ.ማ.ማ.ተ. የቅበላ ስምምነት መሰረት
including but not limited to periodic polygraph
የተመዘገበ የመርከበኛዉ ጓድ ነው፡፡
examinations. Such examinations shall be
utilized with the aim to protect both the safety “ቅድመ ግምገማዎች” ማለት የስነ-ልቦና
of Seafarers and the interests of shipping ምርመራ እና የተዓማኒነት ምርመራ ናቸው፡፡
companies, maintain the reputation of EMTI “የስነ-ልቦና ምርመራዎች“ ኢ.ማ.ማ.ተ
Graduates in the maritime industry, and የመርከበኛው በባህር ላይ ተቀጥሮ የመስራት
minimize the possibility of Seafarer desertion. ተስማሚነትን ለመወሰን የሚያስችሉትን
ማንኛቸውንም ምርመራዎችን ያጠቃልላል፡፡
 Article 2 “የተዓማኒነት ምርመራ” ኢ.ማ.ማ.ተ ደህንነትን
Purpose of the Agreement በጥንቃቄ ለመመርመር ሲል የሚጠቀምባቸው
ማንኛቸውም ምርመራዎች ሲሆኑ በየጊዜው
This contract of guarantee is made for the
የሚካሄዱ የሀሰት ምርመራዎችንም
Guarantor to provide a guarantee for the
ይጨምራሉ፡፡ እነዚህ ምርመራዎች
payment of the whole monthly/weekly stipend
የሚካሄዱት የመርከበኞችን ደህንነት
loan and Academic Facilitation Advanced
ለመጠበቅ፣ የመርከብ ድርጅቶችን ጥቅም
Payment that will be covered by the EMTI.
ለማስጠበቅ፣ የኢ.ማ.ማ.ተ ምሩቃን

Article 3 በማሪታይም ኢንዱሰትሪው ያላቸውን መልካም

ስም ለማስጠበቅ እንዲሁም የመርከበኞችን
Obligation of the Guarantor
የመክዳት እድልን ለመቀነስ በማለት ነው፡፡
1. The Guarantor hereby agreed to stand
as “joint guarantor” as provided under
the Ethiopian Civil Code. አንቀጽ ሁለት
2. The Guarantor irrevocably and
የውሉ አላማ
unconditionally guarantee the due and
punctual payment by the Seafarer to ይህ የዋስትና ውል የተደረገው ኢ.ማ.ማ.ተ
EMTI of the full balance amount of ለመርከበኛው ስልጠና በቅድሚያ ያወጣውንና
the monthly/weekly stipend loan as
በመርከበኛው ተመላሽ ሳይደረግለት የቀረውን
well as the Academic Facilitation
Advanced Payment in accordance with የወር/የሳምንት አበል ብድር እንዲሁም
the terms and conditions set forth in የትምህርት ማመቻቻ ወጪ ለኢኤምቲአይ
the Enrollment Agreement.
የሚመልሱበትን ሁኔታ ለመደንገግ ነው፡፡
3. The Guarantor undertake to pay the
EMTI the full balance amount of the አንቀጽ ሶስት
monthly/weekly stipend loan and the
የዋስ ግዴታዎች
Academic Facilitation Advanced
Payment if Seafarer is unable or
unwilling to pay EMTI in accordance
1. ዋስ በኢትዮጵያ የፍትሐብሄር ህግ
with the payment terms set in the
Enrollment Agreement for whatever በተደነገገው መሰረት በአንድነት ዋስ
 reason upon simple demand by the ለመሆን ግዴታ ገብተዋል፡፡
EMTI.
2. ዋስ በማይሻር እና ያለምንም ቅድመ
4. It is stipulated under this agreement
ሁኔታ መርከበኛው ሙሉውን
that the total liability of the guarantor
by virtue of this Agreement የወር/የሳምንት አበል ብድር እንዲሁም
whatsoever shall not exceed USD
የትምህርት ማመቻቻ የቅድሚያ ክፍያ

To this effect, the Guarantor shall be በቅበላ ስምምነቱ መሰረት በአግባቡ እና

jointly liable for the payment to the ጊዜውን ሳያሳልፍ ለኢ.ማ.ማ.ተ

extent of the above described amount.
እንደሚከፍል ዋስትና ገብተዋል፡፡
Article 4
3. ኢኤምቲአይ መርከበኛውን ለማሰልጠን
Right of the EMTI
ያወጣውን የወር/የሳምንት አበል ብድር
EMTI can at its discretion require the እንዲሁም የትምህርት ማመቻቻ
Guarantor to pay the loan provided to the
የቅድሚያ ክፍያ ወጪ መርከበኛው
Seafarer as weekly or monthly stipend and
the Academic Facilitation Advanced በማናቸውም ምክንያት ለኢኤምቲአይ
Payment actually utilized by the Seafarer or በቅበላ ስምምነቱ ላይ በተደነገገው
part thereof if not utilized in full for any one
መሰረት ለመተካት ካልቻለ ወይም ፈቃደኛ
of the following reasons;
4.1 If the Seafarer is dismissed, with or ካልሆነ ዋስ ይህንኑ የስልጠና ወጪ
without notice, from the training
እንዲተኩ በኢኤምቲአይ እንደተጠየቁ
program for improper conduct, failure
የስልጠናውን ወጪ ለኢኤምቲአይ
to observe the rules and regulations of
the training program, inability to follow ለመክፈል ግዴታ ገብተዋል፡፡
the training program or for any other
4. በዚህ ውል አማካኝነት ዋስ በአንድነትና
reason that justifies the dismissal.
ኃላፊነት ለኢኤምቲአይ የሚከፍሉት
4.2 If the seafarer terminates the training
without completion or if the Seafarer የስልጠና ወጪ በማናቸውም ሁኔታ ከ
upon completion of the training course

refuses the employment placed by the
 EMTI. ሊበልጥ አይችልም፡፡
4.3 If the Enrollment agreement is
terminated as the result of the
Seafarer’s refusal to take Predictive አንቀጽ አራት
Assessment tests. For the purpose of

this Article, failure of the Seafarer to
show up at the test center on an ከዚህ በታች ከተዘረዘሩት ማንኛውም

appointed date and time, for any ምክንያቶች መሰረት ኢኤምቲአይ በራሱ
reason, will be considered as refusal to
የተናጠል ውሳኔ መርከበኛው ስልጠናውን
take the test.
4.4 If the seafarer’s employment is legally እስከተከታተለበት ጊዜ ድረስ የተጠቀመበትን
terminated by seafarer’s Employer for የወር/የሳምንት አበል ብድር እንዲሁም
cause, including but not limited to poor
የትምህርት ማመቻቻ የቅድሚያ ክፍያ ወጪ
performance, violations of the
Employer’s rules, regulations or ዋስ በአንድነትና በነጠላ ኃላፊነት እንዲተኩ
policies, violations of law, disciplinary የመጠየቅ መብት ይኖረዋል፡፡
problems, use of illegal substances,
4.1 መርከበኛው ተገቢ ያልሆኑ ባህሪዎችን
alcohol consumption and desertion,
4.5 If the seafarer requests to be በሚያሳይበት ጊዜ ወይም የስልጠናውን
disembarked and repatriated during his ደንቦችና ህጎች በሚተላለፍበት ጊዜ
sailing contract before the end of his
ወይም ስልጠናውን ለመከታተል
contract period,
4.6 If the Seafarer for any reason renders አለመቻሉ በተረጋገጠበት ጊዜ ወይም
himself incapable to perform his በሌሎች በቂ ምክንያቶች
obligations for the repatriation of his
በማስጠንቀቂያ ወይም ያለማስጠንቀቂያ
Academic Facilitation Advanced
Payment in the manner provided by the ከስልጠናው ሲሰናበት፡፡
Enrollment Agreement. 4.2 መርከበኛው ስልጠናውን ከማጠናቀቁ
4.7 If the Seafarer breaches any of its
በፊት በራሱ ውሳኔ ስልጠናውን ካቋረጠ
obligations set under the Enrollment
Agreement.
 ወይም ስልጠናውን አጠናቆ
EMTI may bring a civil action against the
በኢኤምቲአይ የተዘጋጀለትን የስራ ቅጥር
guarantor without previously demanding
ለመቀበል ፈቃደኛ ካልሆነ፡፡
payment from the seafarer as per article 1933
of the Ethiopian Civil Code. 4.3 መርከበኛው ቅድመ ግምገማዎችን

ለማድረግ ፍቃደኛ ባለመሆኑ የቅበላ

Article 5
ስምምነቱ ሲፈርስ፡፡ ለዚህ አንቀጽ ዓላማ
General Provisions
የመርከበኛዉ በምርመራ ቦታዉና ሰዓት
This contract of guarantee is binding on the
በማንኛዉም ምክንያት አለመገኘት
parties as it is a law and will serve as
conclusive evidence, as between the parties to ቅድመ ግምገማዎቹን ለማድረግ
it, of the agreement therein contained and the አለመፍቀድ ተደርጎ ይወሰዳል፡፡
date it bears as per articles 1731 and 2005 of
4.4 የመርከበኛው አሰሪ መርከበኛውን
the Ethiopian Civil Code.
በደካማ አፈፃፀፀሙ፣ የአሰሪውን ህጎች፣

Article 6 ደንቦች እና ፖሊሲዎች በመጣሱ፣ ህጎችን

Language
በመተላለፉ፣ በስነ-ምግባር ጉድለቱ፣
In case of any dispute between the English and
Amharic version of this Agreement, the ህገወጥ ነገሮችን በመጠቀሙ እና አልኮል

English version will be have the final በመውሰዱ ጨምሮ በህጋዊ ምክንያት
determination on the intent of the Parties.
መርከበኛውን ከስራው ካሰናበተው፡፡

I, the guarantor, have read and understood the 4.5 መርከበኛው በመርከብ ጉዞ ውሉ ላይ

terms of this guarantee contract and signed የተቀመጠውን ጊዜ ሳይጨርስ የመርከብ

with my full knowledge and responsibility.
ጉዞውን አቋርጦ ከመርከቡ ከተመለሰ፡፡

The Contracting parties hereby agreed to 4.6 መርከበኛው የትምህርት ማመቻቻ

respect the provisions of the foregoing የቅድሚያ ክፍያዉን በቅበላ ስምምነቱ

Guarantee Agreement.
ላይ በተደነገገው መሰረት በማንኛዉም
 ምክንያት ለመላክ እራሱን እንዳይችል
