Dear Ms. Mayer Cunningham,

This letter refers to the complaint that you filed with the U.S. Department of Education’s Office
for Civil Rights (OCR) on behalf of Addison Ray LeMay, who we will refer to as “the Student,”
against Warren County Public Schools, which we will refer to as “the District.” Specifically,
you allege that the District discriminated against the Student on the basis of her disability by
denying the Student a free appropriate public education when it did not provide the Student with
a voice output device, including progress monitoring related to the device, from November 11,
2021 through the present.

Because OCR determined that it has jurisdiction and that the allegation was timely filed, OCR is
opening the Allegation for investigation. Please note that opening the allegation for investigation
in no way implies that OCR has made a determination on the merits of the allegation. During the
investigation, OCR is a neutral factfinder, collecting and analyzing relevant evidence from you,
the Complainant, the District, and other sources, as appropriate. OCR will ensure that its
investigation is legally sufficient and fully responds to the allegation in accordance with the
provisions of OCR’s Case Processing Manual (CPM), available at
https://www2.ed.gov/about/offices/list/ocr/docs/ocrcpm.pdf.

Our goal is the prompt, appropriate resolution of the complaint. While we are proceeding with an
investigation, there are other approaches that can achieve this goal. Information on OCR’s

individual because he or she has filed a complaint or participated in the complaint resolution
