COMPROMISE AGREEMENT

This compromise agreement is entered into by and between:

__________________, of legal age, Filipino, married, and with address

at_____________________, herein referred to as the “First Party”;

- and -

__________________, of legal age, Filipino, married, and with address

at___________________________, herein referred to as the “Second Party”;

WITNESSETH:

WHEREAS, the First Party is the Plaintiff and the Second Party is
__________________ in the above-titled case which is pending before this
Honorable Court;

WHEREAS, Defendant __________________has unpaid obligations to the

First Party amounting to __________________ (P ), excluding interests and
legal fees, represented by __________________which are the subject of the above-
entitled case;

WHEREAS, the Second Party acknowledges, and voluntarily and willingly

assumes the full obligation of Defendant __________________ to the First Party;

 WHEREAS, the Second Party proposed an amicable settlement in which
the First Party is also agreeable, hence, there is now a meeting of the minds
between the herein parties;

WHEREAS, being part of the compromise agreement, the Parties agree as

follows:

1. The Second Party acknowledges that Defendant __________________

has monetary obligations to the First Party in the amount of
__________________ PESOS (P ), excluding interests and legal
fees;

2. The Second Party voluntarily and willingly assume the responsibility,

and undertakes to pay the full obligation of Defendant
__________________ to the First Party amounting to
__________________ (P ), including interests and legal
fees;

3. The Second Party undertakes to pay in monthly installment of

__________________ (P ) for ________months beginning
__________________ and every ____ of the month thereafter until the
total amount of __________________ PHILIPPINE PESOS (P )
is fully satisfied;

4. The Second Party shall issue _________________ checks payable under

the name of the First Party;

5. In the event that any of the checks issued by the Second Party bounced or
if the Second Party failed to pay any single monthly installment, the
entire amount shall become due and payable without need of demand and
Plaintiff shall be entitled to a Compromise Judgment with six percent
(6%) interest of the total amount due;

6. In entering into this Agreement, the parties hereby acknowledge that they
have been provided with sufficient time and opportunity to fully study
the facts and consequences of their actions and have not relied in any
way upon the representation or statements made by any other parties or
other individuals employed by the parties, and acknowledge that they
have read and understood the effect of the above, and have executed the
same freely and voluntarily without any intimidation, threat or coercion,
but in their own freewill in affixing their signature;

 7. The parties hereby agree that this Agreement may be submitted to any
concerned Court for approval and that any of the parties may file a
motion before the said Court that a judgment be rendered based on this
Compromise Agreement; and

8. The immediately preceding paragraph notwithstanding, and even while

the formal approval of this Agreement by the Court is pending, this
Agreement shall already be valid, binding, and immediately executory
between and against the parties, their respective assignees and
representatives. As such, the parties hereby undertake not to do or
commit any act that tends to contravene the terms of this Agreement.

PRAYER

WHEREFORE, IN VIEW OF THE FOREGOING, the parties respectfully

pray for that the above Compromise Agreement signed by the parties be approved.

Other reliefs just and equitable in the premises are likewise prayed for.

RESPECTFULLY SUBMITTED.

IN WITNESS WHEREOF, the parties hereto have mutually and voluntarily

agreed to the above stipulations, and sign this Agreement on _________ day of
__________ 2022 in __________________.

WHEREFORE, the parties most respectfully pray for the consideration and
approval of this agreement and for the court to render judgment based thereon.
