Hereinafter called the "VENDEE" of the other part: Both the expressions "VENDOR" and "VENDEE" shall mean and include all their respective heirs, executors, administrators, legal representatives, nominees, successors, and assignees etc., WHEREAS originally the property comprising of land admeasuring Acre 1-31 Guntas equal to 8591 Square Yards or 7183.11 Square Metres in Part of Survey No.89(P) situated at Miyapur Village, Serilingampally Mandal, Ranga Reddy District, now with in the Limits of GHMC (Greater Hyderabad Municipal Corporation, Hyderabad)belonged to and possessed by Smt. Yousuf Begum wife of Late Sri. Shaik Khaja Pash & Four others and the above said property was inherited by the Owners herein being the legal heirs of Late Sri. Dadesab and others as per Law of Inheritance accordingly and by virtue records of the Government of A.P, Revenue Records, Patta Pass Book/Title Deed No.420824 and the said landed property mutated by Virtue of Proceedings No.B/2570/2003, Dated:13-04-2004 issued by the concerned Revenue Authorities; thus they were became absolute owners and possessors of the aforesaid property. fe Cu. AND WHEREAS Smt Yousuf Begum wife of Late Sri. Shaik Khaja Pash& Four others being absolute owners and possessors of the aforesaid property comprising of land admeasuring Acre 1-31 Guntas equal to 8591 Square Yards or 7183.11 Square Metres in Part of Survey No.89(P) situated at Miyapur Village, Serilingampally Mandal, Ranga Reddy District, now with in the Limits of GHMC (Greater Hyderabad Municipal Corporation, Hyderabad) have entered in to an Agreement for sale in respect of aforesaid property with the parties namely viz: 1Sri Mirza Abdullah Bai,2.Sri.S.Farooqui and 3,Mohd Sharfuddin by virtue of Agreement of Sale-cum-GPA Dated:20-05-2005 registered as No.6975 of 2005 of Book-I, Scanning No,1510-16975-2005 by the Joint Sub Registrar-I, office of the District Registrar, Ranga Reddy. In turn THEY, the above Agreement of Sale-cum- GPA holders have sold the aforesaid property comprising of Jand admeasuring Acre 1-31 Guntas equal to 8591 Square Yards or 7183.11 Square Metres in Part of Survey No.89 (P) situated at Miyapur Village, Serilingampally Mandal, Ranga Reddy District by themselves and on behalf of the original owners to (1) Smt. KHAIRUNNISA BEGUM wife of Sri Mirza Osman Baig and (2) Smt. HUSSENI BEGUM wife of Sri. Mirza Osman Baig by virtue of Sale Deed Dated: 06-11-2007, registered as Document No.13225 of 2007 of Book-I, Scanning No.1510-1-13225- 2007 by the Joint Sub Registrar-I office of the District Registrar, Ranga Reddy; thusthe above First Party/Owners at SI.No.2 & 7 became absolute owners and possessors of the aforesaid property and the First Party/Owners at SI. No. 2 & 7 that being wives of Sri Mirza Osman Baig (First Party/Owners at SI.No.1) in consultation with their husband Sri Mirza Osman Baig and their respective children (First Party/Owners at SI.No.3 to 6 R. 8 to 12) all the family members (jointly & collectively) have orally agreed and settled their respective share in the property according to their Personnel Law and by virtue oral gift by and in favour of each family and further they (jointly & collectively) have decided to develop the above said property by entrusting to the reputed builder-cum- Developers for construction of Multistoried Residential Apartments/Flats etc., as joint venture of the above named first party/owner. ‘And whereas the above referred builder cum developer offered to develop the cleared and available and form the aforesaid property of the first party/owner after obtaining relevant clearance from the competent authorities of line concerned departments in time to time manner as applicable according to the rules of the government or local bodies etc concerned. for B Director be aa (yl Cy AND WHEREAS, as a first step for development of the aforesaid property it is necessary to apply to the Government of Andhra Pradesh for conversion of land use from Agricultural etc to Residential use etc and the Owners in coordination with tree Builder-cum-Developers and a person Appointed as Liaison-in-Charge by the Owners to look after all Liaison works etc and to obtain all permissions clearance etc in respect of above property of owners to enable the Builder-cum- Developers to go for and start construct work thereon; And the said Liaison-in- Charge has applied for conversion of land use to the Government of Andhra Pradesh and paid demanded and required fee to the concerned departments and the file is under process vide File No.1096/MP1/PLG/ 2006 of HMDA for the said purpose and the entire aforesaid property was handed over by the First Party/Owners to the Builder-cum-Developers for the purpose of Development; After conversion of the aforesaid landed property in to residential use by the concerned authorities with prior permits, the First Party/ Owners or prospective Builder-Cum-Developers or their nominees to hold and use the land upto& approximate area of land admeasuring 3993 Sq Yrds or 3338.63 Sq. Mtrs out of land admeasuring 1 Acre 31Guntas equal to 8591 Square Yards ‘or 7183.11 Square Metres in Part of Survey No.89 (P) situated at Miyapur Village, Serilingampally Mandal, Ranga Reddy District for the construction of Multistoried Residential Apartments/Flats etc and the remaining part of the land left for green belt area as per the exiting norms of the Government of Andhra Pradesh. The First Party/Owners being absolute owners and they are entitled to possess and develop the land admeasuring 3993 Sq Yards or 3338.63 Sq. Mtrs out of land Acre 1-31 Guntas equal to 8591 Square Yards or 7183.11 Square Metres in Part of Survey No.89 (P) situated at Miyapur Village, Serilingampally Mandal, Ranga Reddy District at present. (Hereinafter called the Schedule of the Property for Development) AND WHEREAS, on the basis of the counter affidavit filed by Collector, Ranga Reddy District in W.P.No.15152/06, the Hon'ble High Court of Andhra Pradesh, observed in it's Judgment Dated:12th February 2007 that an extent of Ac.00.06 Gts in Part of Sy.No.89 comes under Full Tank Level (FTL) of Patel Cheruvu and as such a net extent of Ac.01.25 Gts out of land Acre 1-31Guntas equal to 8591 Square Yards or 7183.11 Square Metres and it is a clear Patta land of the above Owners /First Party. As the Owners /First Party approached the Government of Andhra Pradesh for change of land use and the Government of Andhra Pradesh imposed following conditions as per Memo No.2115/11/2008 dt 26 2 2010 viz Change of land use of the land from partly water body and partly recreational use zone to residential use zone in Sy No. 89(P) of Miyapur village, Serilingampally Mandal, RRDistrict to an extent of 3338.63 sqmtrs (i.e. excluding the area affected in FTL and area affected in 30 mtr green belt from FTL)-Draft variation. WHEREAS the Vendors have proposed to give its respective land for Development into a residential complex and with developer M/S. B.P.R. ENTERPRISES PVT LTD, Represented by its Managing Director: Sri Nukala Preetham Reddy, offered to undertake the descried Development work, Vendors and Developer entered into vide Registered Development Agreement cum General Power of Attorney bearing document No.4788 of 2011, Book-I, dated: 24 day of June 2011, Registered at R.O., Ranga Reddy District. AND WHEREAS the Vendors have obtained permission from the GHMC for the construction of Residential Apartments in the above said property, Vide its Permit No.40404/HO/WZ/Cir-12/2015, Dated: 26/03/2015, Consisting of Cellar, Stilt + Five Upper floors and named the said complex as "PEBBLES BAY". AND WHEREAS the Vendors represented by their General Power of Attorney Holder has offered to sell the Semi-Finished Flat bearing Ni in Fourth Floor, of "PEBBLES BAY ", with a total area 1704 Square feet:(common area;20%) build up;1,363 square feet , along with an undivided share of land admeasuring 61.85 Square yards (Out of total Land admeasuring 3993 Square yards), in Part of Survey No.89 (P), Situated at MIYAPUR VILLAGE, Serilingampally Mandal with in the limits of GHMC, Hyderabad, Ranga Reddy District-Telangana State,, and hereinafter referred to as the schedule property to the Vendees for a total sale consideration of Rs.30,67,200/- (Rupees thirty Lakhs sixty seven Thousand two Hundread Only) the Vendees have agreed to purchase the same for the said sale consideration. eet | cso co Direct 7 : NOW THIS DEED WITNESSETH AS FOLLOWS: ‘That in pursuance of the above offer and in acceptance of the Vendees has paid the advance sale consideration of Rs.12,88,627/- (Rupees Twelve Lakhs Eighty Eight Thousand Six Hundred and Twenty Seven Only) to the Vendor as detailed below: (a). _Rs.50,000/- through RTGS ( reference no;90501395),dated;3/6/18. (0). Rs.1,50,000/- through RTGS (reference no; 815513994509), dated;4/6/18 (©. Rs.5,00,000/- through RTGS ( reference no;91200964), dated;15/6/18.. (@)__ RS. 5,88,627 /- through RTGS (reference no; IRG7849695), dated; 15/6/18. To the receipt of which sum the Vendor hereby admits, acknowledges. z That the Vendees shall pay the balance sale consideration amount of Rs.17,78,573/- (Rupees seventeen Lakhs seventy eight Thousand Five Hundred and seventy three Only) will be paid to the by the Vendees at the time of Registration through Bank Loan, that the Vendees has withdraw the purchase of the Flat 10% total sale consideration amount and services charges will be deducted. Refund will be paid only after the flat is sold. The above price is including of Two car parking in cellar & stilt, and inclusive of betterment charges specifications as per broacher. ‘The Vendor covenants that the Schedule Property hereby conveyed is free from all prior agreements, charges, sales, gifts, court attachments or any encumbrances of whatsoever nature. That the Vendor further covenants with the Vendees that if the Vendees shall be deprived of whole or any part on account of any defect in the title of the Vendor, the Vendor shall indemnify and compensate the Vendees against the same. : oO E © . nin 6. The Vendor covenants to deliver physical vacant possession of the Schedule Property to the Vendees at the time of registration of sale deed and assures to keep the Vendees indemnified from all losses, costs, expenses, damages and whatever may be the Vendees shall be put into by reason of any defect in the title of the Schedule Property hereby conveyed. 7. That Vendor covenants to execute regular sale deed after receiving the balance sale consideration amount, in favour of the Vendees or his nominee(s) as and when the Vendees so requires. 8 That the Vendor covenants to pay all taxes in respect of the schedule property. If any dues are found unpaid, the Vendor shall be liable to pay all such dues and Building Sanctioned Municipal Plan handover to Vendees until the registration of Regular Sale Deed and there after the Vendees shall pay the required taxes. 9. This transaction is not prohibited by any of the existing laws. 10. All the charges and expenses for registration of sale deed shall be borne by the Vendees only.
