Probationary Employment Agreement


This PROBATIONARY EMPLOYMENT AGREEMENT is made and entered by and between
KAPSEL MEDICAL INC., with office address at 20A Jasmine St, Cor. P. Rodriguez St., Capitol
Site, Cebu City, 6000, and ANALOU L. BELASOTO, RN a Filipino citizen, of legal age and
residing at Sangi, Toledo City, 6038, Cebu.

I. STATUS OF EMPLOYMENT

The Company hereby hires ANALOU L. BELASOTO, RN as a Probationary Employee


holding the position of Head Nurse., hereby voluntarily accepts her engagement under such
probationary status, with full knowledge of the terms and condition, rights and obligations,
appurtenant to a probationary employment.

II. TERM OF PROBATIONARY EMPLOYMENT

The Probationary Employment shall be for a period of Six (6) months to commence on
August 1, 2022 and end on February 1, 2023.

Before the end of the term of the probationary employment, particularly within the last week
of the six-month period, the probationary employee shall report to the Chief Administrative
Officer and submit a written letter that she is serving the last week of her probationary
employment. Unless authorized in writing by the company, the probationary employee shall
NOT report for work after the last day of her six-month probationary period. If for any reason,
the probationary employee reported for work after the six-month probationary period without
the required written authority from the company, the same shall not be considered as a
continuation of her employment as probationary employee. Once the same is discovered, the
probationary employee may be directed to immediately leave company premises.

III. FUNCTIONS AND RESPONSIBILITIES

Shall perform the functions and discharge the responsibilities of Head Nurse. listed in
Annex “A” hereof and such other functions and responsibilities as may be given by the
company.

Shall devote her time and attention and will use the best of her energies and abilities in the
performance of her duties and responsibilities as prescribed in this agreement. The company
expects the probationary employee to exhibit the highest standards of performance throughout
the period.

Shall not place himself in a conflict-of-interest situation. Will not accept employment or
appointment as director, officer, partner, shareholder, and consultant or in any other capacity in
any business which competes, directly or indirectly with the business of the company or conflicts
or interferes with the performance of your functions and responsibilities. She shall not solicit,
canvass or accept any business or transactions with any such competing business or ask,
request or accept any gift, anything of value, favor or consideration from suppliers, customers,
clients or competitors.

IV. COMPENSATION AND BENEFITS

For all the services to be rendered in pursuant to this agreement, she shall receive a
monthly base compensation of Twenty-Two Thousand Five Hundred Pesos Only (22,500.00)
and with it being intended that such Monthly Base Compensation shall be reviewed by the Chief
Executive Officer in this sole discretion from time to time based in the performance of the
employee and the results of the Company. The Monthly Base Compensation shall be paid to
you in equal installments twice a month
Mandatory Benefits:
 SSS, HDMF, Philhealth
 13th Month Pay

Other Benefits:
 Position Allowance = 5,000.00
 Meals and Transportation = 2,500.00

V. REASONABLE STANDARDS TO QUALIFY AS REGULAR EMPLOYEE

In additional to the foregoing, the probationary employee must comply with, or pass the
reasonable standards prescribed by the Company to qualify as regular employee as set forth in
Annex “B” hereof. The probationary employee shall be evaluated for purposes of determining
compliance to qualify as a regular employee.

VI. OTHER CONDITIONS / OBLIGATIONS

The probationary employee also commits to:

A. Attend Company-related activities scheduled on weekdays, week-ends, and/or


holidays as may be scheduled.

o Trainings, seminars, workshops and other similar company activities.

B. Secure Company clearance on the 6th month of the date of hire from any existing
property and/or financial obligations/liability/reimbursement, and from the pending
administrative/disciplinary case. In case the probationary employee fails to secure
such clearances, she freely, willingly, and expressly agrees and consents to allow
the Company to withhold her salary and/or commissions/or incentives which may be
released only upon completion of the said clearances.

C. Complete the probationary period. In case of failure to do so, the Company reserves
the right to claim liquidated damages based on:

o Number of months or days remaining unfinished.


o Cost of hiring and training for your replacement.
o Other administrative and litigation costs.

D. Follow regular working schedule.

The probationary employee commits to work with honesty and integrity for excellent
service to the clients
