A divorce decree secured by a foreigner/a former Filipino abroad capacitating him/her to


remarry may be recognized in the Philippines by filing before the Regional Trial Court of the
place where the marriage was recorded a Petition for Judicial Recognition of the Divorce
Decree.

Once a court decision is obtained recognizing the Divorce Decree, said court order shall be
registered in the Local Civil Registry Office of the place where the marriage was recorded.
After the annotation at the Local Civil Registry Office, the annotated document and other
requirements shall be submitted to the Office of the Civil Registrar General in Manila. This
registration will effectively cancel/nullify the marriage between the Filipino Spouse and the
Foreigner.

Initially, these are the documents you have to prepare for purposes of filing the Petition:

1. Philippine Marriage Certificate


2. Divorce Decree/Order certified by the Clerk of Court
3. Proof of Citizenship
4. Certified copy of the Foreign Country’s Divorce Law
5. Valid ID

The foreign documents will need to be certified by the appropriate foreign office and they will
need to be authenticated (Red Ribboned) by the Department of Foreign Affairs or the
Philippine Embassy in the foreign country.
