FOREWORD
The Faculty of Law of the University of Banja Luka, on the occasion of the 45th
anniversary of its establishment, started the tradition of organizing international
scientific conferences by successfully organizing the 1st international scientific
conference “Transformative Technologies: Legal and Ethical Challenges of the
XXI Century”, on 7th and 8th of February 2020, in co-organization with the Eu-
ropean Division of the UNESCO Department of Bioethics (Haifa) and the Center
for the Studies of Bioethics (Belgrade). The focus of this scientific gathering were
two sub-themes: legal and ethical dilemmas caused by the development of dig-
ital and reproductive technologies. Due to the pandemic of the Covid-19 virus
and the restrictions that were in force, in 2021 an international scientific con-
ference was not organized at the Faculty of Law of the University of Banja Luka.
On the foundations established in 2020, the Faculty of Law of the Universi-
ty of Banja Luka is organizing the 2nd international scientific conference on the
topic “Challenges and perspectives of the development of legal systems in the
XXI century”. Bearing in mind the numerous “turbulences” in the development
of today’s legal systems, both globally and in the Republic of Srpska, Bosnia and
Herzegovina and their immediate surroundings, our intention is to, starting from
the role of the academic community in society, provide a scientifically sound con-
tribution to dealing with the current and upcoming social challenges that have
a significant legal dimension, and to encourage scientific discussion about these
challenges with the aim of illuminating potential detours, but also perspectives
for the stable development of legal systems. The conference primarily maintains
its focus on bioethical issues, following the example of the conference from 2020,
with an expansion of the number of subtopics that will be the subject of papers
presented at the conference. The conference is organized with the support of the
International Chair of Bioethics and in partnership with the Faculty of Law of
the University of Belgrade, the Institute for comparative law from Belgrade, the
Center for the Studies of Bioethics from Belgrade and the Association of Lawyers
for Medical and Health Law of Serbia. The conference will be held at the Facul-
ty of Law of the University of Banja Luka on 15th and 16th of September 2022.
Participants who are unable to attend the conference are allowed to participate
virtually via the Zoom platform.
This collection contains summaries of fifty-five papers. The papers analyzed
legal and other aspects of numerous current issues from legal life both in the
area of the former Yugoslavia and in various European countries. We are con-
vinced that integral works based on these summaries, which will be published
at the end of December 2022 in the Proceedings of the international scientific

Summary: The paper primarily discusses the issue of unilateral acts in inter-
national law, the conditions of their validity, as well as the effect they produce. A
brief breakdown of unilateral legal acts of states that produce legal effects in the
international order is presented. Particular attention was paid to the act of recog-
nition of states and the great specific weight these acts have in the international
community was pointed out. The classical understanding of state recognition was
presented and it was stated that this issue is connected with important principles
and tenets of general international law. Special attention is paid not only to the
status dimension of state recognition, but also to new practice of the withdrawal
of recognition that brings radical changes to this institute. Conclusions were giv-
en on the further development of the institution of recognition and the need for
this issue to be clarified in the context of new events on the international scene
regarding the case of recognition of the self-proclaimed state of Kosovo, but also
regarding Crimea and some other specific cases.

Summary: Legal documents are written in natural language. Legal prose has
a limited capacity to be represented by program code. The main limitation is the
ability to convert complex legal standards and concepts into program code. Le-
gal programming involves integrating the perspectives of law and programming
in order to provide common patterns of functioning of legal and programming
languages. This integration is made possible by two facts. First, the common
denominator of legal and programming languages is the structure of reason-
ing (both languages are based on rules). Second, the similarity between legal
rule and programming is that their creation process has a defined structure and
control rules. Successfully turning legal prose into code requires collaboration
between lawyers and programmers. The framework of that cooperation is the es-
tablishment of the so-called “Legal Expert System” (Legal Expert System - LES).
It is a system that uses artificial intelligence in the context of defining, applying
and controlling legal norms. The result of the work of this system is a program
designed by lawyers that imitates problem solving by lawyers. The goal of LES
is: to acquire the programmer’s knowledge about the contract as a legal institu-
tion; integration of that knowledge in LES; control and testing of program code
through the cooperation of programmers and lawyers. The application of tech-
nology in law does not mean automation at all costs: it should be based on the
complementarity of human efforts and the performance of that technology in
providing optimal quality of legal services.

Summary: The author starts from the position that the collective legislator
always has in mind the purpose that the law should achieve. In the literature,
there are different understandings of the concept of purpose, closer and further,
as a psychological element or a concrete result. An additional difficulty is that
the mentioned concept is intertwined with the concept of intention, also con-
sidered in numerous ways. In principle, the question of the existence, disclosure
and understanding of the purpose and intention arises when the circumstanc-
es under which a norm should be applied change. Then the interpreter must
establish how the lawmaker, bearing in mind the purpose of making the rules,
would have solved a certain dilemma if it had been presented to him. The prob-
lem with purpose as a more immediate and concrete result that the law seeks to
achieve is that one purpose is the basis for achieving another purpose. This in-
dicates a whole chain in which there is a mutual influence of the results, which
implies a certain skill of prediction. But how far is it possible to predict, wheth-
er during the interpretation one should rely on the near or far purpose of the
norm and what in the case of their mismatch? It seems that it is really easier to
determine the proximate purpose as a concrete result and the intention of the
lawmaker as a psychological element that is directly related to it. Namely, some
extremely abstract further purpose is always present, e.g. ensuring legal certain-
ty, avoiding legal antinomies and legal gaps, etc. The interpreter (most often the
judge) must always take this into account. However, when it comes to the inter-
pretation of concrete norms, the skills of assessment and prediction, as well as an
adequate measure of discretion in terms of understanding the purpose and in-
tention of the legislator, depend to a significant extent on the personality of the
judge. Therefore, we should not have the illusion that determining the purpose
of a legal regulation can solve every concrete interpretive problem.

Summary: In the text, the author discusses the problem of the relationship
between the ban on political parties and the freedom of political association from
the standpoint of theoretical conceptions, international standards on the protec-
tion of human rights and practice in comparative law.
The right to freedom of association is a basic human right without which there
is no democracy, and as such it is guaranteed in domestic law and international
standards, such as the European Convention for the Protection of Human Rights.
The limitation of this right has caused theoretical doubts regarding the answer
to the question in which cases it is legitimate to ban or dissolve a political orga-
nization. In accordance with universal standards, it is considered that the ban
or dissolution of political parties is justified only as an exceptional means in the
defense of the democratic political system, in the case where it unequivocally
manifests the intention of violently changing the constitutional and democrat-
ic order. The decision should be within the competence of the courts, and when
deciding, the competent authority would have to take into account the propor-
tionality between the pronounced measure and the established facts about the
unconstitutional activity of a political organization.
In comparative law, there is no uniform model on the limitation of activities
and the prohibition of political parties. In the legal systems, there are various
ways of organizing this mechanism, the bodies that make the decision to ban or
dissolve a political party, the grounds and reasons for making the decision, the
procedure and the measures that are imposed.
In political practice, apart from the formal prohibition of political parties, there
is also a factual limitation of the freedom of political activity and association. In
order to prevent discretionary decision-making and executive interference, it is
necessary to elaborate in detail the legal regime of banning political parties and
freedom of political association and organization in accordance with the prin-
ciples of the rule of law and democracy.

Summary: The freedom of making a will as the right of a natural person with
testamentary capacity to dispose of property at his own will in the event of death,
is a civilizational legacy present in all legal systems. Possibilities for its realiza-
tion, viewed from the perspective of the admissibility of testamentary forms,
depending on the needs and goals that modern rights are guided by during their
standardization, are different. It is characteristic of some legal systems to express
the plurality of forms through which it is possible to realize this freedom, while in
some of them a smaller number of forms through which it is possible to declare
the last will are standardized. The subject of the paper is a comparative review
of the existing forms of will in order to see the breadth of freedom of testamen-
tary dispositions in modern legal systems.
Special attention is focused on the consequences of the current corona virus
pandemic (covid 19) regarding the possibility of realizing this freedom. This is
taking into account the fact that both on European legal ground and throughout
the world, with the aim of suppressing the SARS-Cov-2 virus, appropriate regu-
lations have been adopted that regulate certain extraordinary measures, such as
mandatory self-isolation, curfew, up to a complete ban on movement of citizens.
It was observed that the implementation of the mentioned measures during the
pandemic, generally speaking, resulted in the narrowing of the freedom of making
a will in all modern legal orders, given that during their duration the availability
of certain forms of wills to persons with testamentary capacity, i.e. the possibil-
ity of using them, was difficult or even completely disabled.
As the negative legal aspects of the limitation of the freedom of making a will
are numerous, and considering that every person with testamentary capacity
needs to be enabled at any time to make a disposition available through a will,
especially through public forms, in the paper we will emphasize the necessity of
guaranteeing the realization of this freedom even in emergency situations and
try to indicate ways of its implementation in practice.

CHALLENGES OF INTERDISCIPLINARY
APPROACH IN TORT AND CONTRACT LAW
Summary: During the work on my article from the general theory of Obliga-
tion Law “Monetary Obligations and Cryptocurrency”, I was faced with a double
problem of interdisciplinarity. In addition to socio-humanistic knowledge from
Economics, as the broadest science of value and money, the research required
familiarization with terms and concepts such as cryptography, electronic signa-
tures, public and private keys, as well as terms for which there are no native words
but only foreign ones such as “blockchain”, “tokenomics”, “oracle”. Understand-
ing the information technologies responsible for the mentioned innovations was
a prerequisite for legal analysis.
I encountered a similar problem in the field of Tort Law, as a mentor for the
topic “The Legal Position of Animals in Tort Law”, where it was necessary to es-
tablish criteria so that the candidate would remain in the field of Civil Studies,
without excessive interference in Animal Protection Law (as a subspecies of Law
environmental protection). In addition, one of the main topics of the disserta-
tion relies on the classification of animals, i.e. on Biology, in order to answer the
question of which animals can possibly be treated as legal entities sui generis.
Both mentioned situations are connected by a similar problem: how far should
a civilian go into other sciences in order for his research to be complete, while
remaining a legal research? Does achieving original results always require inter-
disciplinarity or are there alternative ways to advance legal theory? The answers
are offered by the methodology of legal science, but not the classic one from doc-
toral studies. I consulted recent publications of the European Academy of Legal
Theory in an attempt to come up with an answer.

Summary: In the paper, the author discusses the basic procedural principles
of civil (litigation, executive and non-litigation) proceedings in the legal system
of Bosnia and Herzegovina and the Republic of Srpska and their compliance
with the most important documents on the protection of basic human rights and
freedoms (primarily with the European Convention on the Protection of Human
Rights and fundamental freedoms, which is an integral part of the Constitution
of Bosnia and Herzegovina). Every human right becomes illusory without an
appropriate mechanism for its realization and protection. Although the mecha-
nisms of their protection in criminal proceedings are mostly discussed, we must
not ignore the far greater number of violations of those same rights due to non-
compliance with the basic procedural principles of civil court proceedings. This
is precisely one of the reasons why the author decided to consider this topic the-
oretically. In her research, she will present a brief overview of the basic principles
of civil procedure in Bosnia and Herzegovina and the Republic of Srpska, as well
as to discuss whether they are sufficient to protect and realize the basic rights of
people proclaimed in the Constitution and relevant international documents.

Summary: In the paper, the authors strongly advocate for the (final) adoption
of the Law on Nursing, since such a lex specialis could end the spontaneous de-
velopment of the career of nurses, but also numerous other open questions and
problems that burden this part of the functionally decentralized non-state pub-
lic administration in the Republic Serbia. This position will be supported in the
work by reasons of theoretical, comparative-legal, international-legal, but also of
a practical nature. The theoretical basis for passing a special law that would regu-
late the content and method of action, standards of education and advancement,
competences and control mechanisms can be found in the old understanding
that the special status of officials, especially in autonomous services, requires a
separate law for each decentralized service. Also, in the paper, the authors will
examine the level of compliance of the Law on Regulated Professions and Rec-
ognition of Professional Qualifications with EU Directive no. 2013/55 in the part
related to the education and competencies of nurses, and to consider the pos-
sibility of possible addition through the provisions of a special act that would
concern nurses. Furthermore, the paper will highlight the advantages of draft-
ing a special law in those countries, primarily in the region, that opted for such
an approach. Finally, but by no means the least important, since they were the
direct reason for choosing the topic, the paper will present the most important
practical reasons, from the daily life of nurses, especially after the experience of
the pandemic, which speak in favor of the need to pass a special law. Normative
recognition of the specificity of the status and needs of nurses, as special health
workers, would undoubtedly contribute to the improvement of the functioning
of the entire health system, as an indispensable part of non-state public admin-
istration in the Republic of Serbia.

Summary: In the last two years, which were marked, first of all, by the Cov-
id 19 pandemic, with interrupted supply chains, reduced economic activity and
the level of employment, the recommendations of financial theorists and prac-
titioners, but also of all credible international financial institutions, were that
countries all over the world should take on additional debts in order to main-
tain the economy and the population through consumption, maintain economic
growth and development, maintain the number of employees etc.
According to the IMF global debt database, the global debt grew in 2020 by 28
percentage points, that is, the same debt grew to 256% of (world) GDP in 2020. In
the observed debt, public (global) debt had a share of almost 40% in 2020, which
represents its largest share since the mid-60s of the last century.
On the other hand, the time of cheap money and low interest rates is defi-
nitely over. Today, registered inflation rates are at a historical maximum around
the world, and one of the measures used to try to calm inflation is the tighten-
ing of monetary policy, i.e. the increase of reference interest rates. On the other
hand, aggressive monetary policies will consequently lead or have already led to
a change in capital prices on all money markets, that is, they have led to an “in-
crease in price” of debt, both new and servicing existing debt.
This paper will analyze the impact and effects of inflation on debt, both in
the short and long term. In addition, this paper will provide an overview of var-
ious alternatives that “helped” in reducing the debt burden in the past, and will
provide an answer to the question of whether the existing legal framework for
public debt management in the Republic of Srpska is adequate for the manage-
ment of the mentioned debt in the future “hard to predict” period.

Summary: With the exit of the Great Britain from the European Union, there
was an increased interest in the only country of Anglo-Saxon law within the Union
- Ireland and its law. This was the reason for trying to shed light on the historical
aspect of the development of Irish law, which we automatically classified in the
English common law system, although its content is far richer and certainly sig-
nificant for the legal history of European law as a whole. Thus, the British BREXIT
triggered interest and attention on Ireland itself, a country on the Atlantic edge
of Europe, almost unnoticed in the larger EU community, which the separation
of the north from the island as a whole makes even more complicated, and its
law will turn out to be an interesting part of the overall Indo-European heritage.
Looking at the aspect of the state and legal development of Ireland, we dis-
tinguish the following periods; Christian Ireland from the V-XII centuries, the
Norman period of Ireland VIII-XII, England Ireland XII-XIX, Ireland in the
United Kingdom 1801-1914, then the war for independence, and from 1937 -
independent Ireland.
The paper analyzes the emergence of Anglo-Saxon law and the formation of
a separate Irish customary law, which will become the basis for the later devel-
opment of the independent Irish law.

Summary: Until Dušan’s legislative work, the most important general act
of the legal system of the Nemanjić state was the Nomocanon, i.e. Law of Saint
Sava. This compendium of secular and ecclesiastical law included Roman law,
in addition to the «City Law» - Prochiron, and a number of civil law regulations
from previous times. The subject of this work will be those Justinian’s novels that
found their way to the 47th chapter of the Law of St. Sava, which in various ways
concern the issue of church property - bequests made in favor of the heavenly
powers, the use of church funds for the release of prisoners, and finally the issue
of donating abandoned properties to the church. The aim of the research is to in-
dicate the various changes made by the redactor by transferring (transplanting)
these commandments into Serbian medieval law, as well as the possible reasons
for this nomotechnical procedure. We will also deal with the understanding of
the text of the 47th chapter of the Law of St. Sava in the light of both previous
translations of the Law into the modern Serbian language - Petrović’s translation
of Ilovička Krmčija and the commission’s translation of Sarajevska. The purpose
of this approach is not only to understand the way of borrowing from Roman to
Serbian medieval law, but also to recognize the importance of primary sources
and a versatile approach when studying old sources of law.

Sažetak: Iako je pravna znanost kao i općenito znanost koja istražuje od-
nos između prava i društvenog napretka evoluirala, ovo područje istraživanja
ostaje nepoznato mnogim znanstvenicima, pravnicima i kreatorima politike.
Znanstvenici još nisu razvili teoriju koja sustavno objašnjava međuodnos prava
i društvenog razvoja. Ovaj rad pokušava popuniti ovu prazninu predstavljajući
opću teoriju koja definira disciplinarne parametre samog prava kao i društvenog
razvoj te objašnjava mehanizme utjecaja pravnog sistema na razvoj.
Analizirajući ovaj odnos pokušat ću odgovoriti na pitanja - Da li formalno
pravo i formalne pravne institucije značajno pridonose razvoju zemlje?, kao i -
zašto neke zemlje u razvoju i tranziciji imaju kronično loš «pravni sistem»?
Uvide i analizu u radu temeljim na postavkama da ne možemo odvojiti prav-
ne procese od šireg povijesnog, političkog, kulturnog i gospodarskog okruženja
u kojem funkcioniraju. Britansko i američko običajno pravo i kontinentalno gra-
đansko pravo izrasli su iz različitih povijesti i tradicija, kao i autohtoni pravni
procesi u Aziji i Africi. Slab legitimitet pravnih institucija u mnogim današnjim
tranzicijskim zemljama dijelom je rezultat njihove pozicije naslijeđene iz soci-
jalističkog razdoblja.
Naglašavam i objašnjavam značaj tri ključna činitelja za dobro funkcioniranje
pravnog sustava u tržišnoj ekonomiji - ponuda zakona koji su prilagođeni trži-
štu, odgovarajuće institucije za njihovu provedbu te potražnja za tim zakonima
od strane sudionika na tržištu.
U radu pokazujem da koncept razvoja, koji je tradicionalno bio povezan sa
zemljama u razvoju, također se može proširiti na rješavanje ekonomskih proble-
ma u današnjim razvijenim zemljama.

Summary: The importing of hazardous substances into Serbia and the illegal
processing, disposal and storage of hazardous substances is a criminal offense
against the environment, which in Serbian judicial practice and theoretical dis-
cussions, and as the vast majority of other environmental crimes in principle,
is not recognized as particularly relevant, although its consequences can be ex-
tremely far-reaching and irreversible; it is neglected even though its importance
is growing in the light of rapid technological development, and it very often rep-
resents an important segment of activity in the sphere of organized crime.
The criminal act refers to the pollution of soil and water as an eco-medium,
and it can also lead to the destruction of animal or plant life, which the legisla-
tor recognized at one time and included in Article 266 of the Criminal Code as
a more severe form. Generally speaking, the rich legal description of this delict
touches on many aspects that apply to other criminal acts against the environ-
ment, and as such can serve as an illustrative example of how environmental
crimes are regulated in the criminal legislation of Serbia. However, the question
arises whether all issues are really fully regulated by its legal formulation, as well
as whether the existing solution is satisfactory. The aim of the work will be a dog-
matic analysis of the criminal offense of importing dangerous substances into
Serbia and the illegal processing, disposal and storage of dangerous substances,
a presentation of its international sources, as well as a normative evaluation of
this crime both in the general context of the criminal legislation of Serbia and
to a certain extent appropriate comparative law examples of similar criminal of-
fences, as well as in the special framework of crimes against the environment and
characteristics of environmental crimes.

Summary: This paper illustrates the basic rule on detention as an ultima ra-
tio measure to ensure the presence of the accused and the smooth conduct of
criminal proceedings in the context of the grounds for detention from Art. 211
par. 1 p. 4 of the Criminal Procedure Code of the Republic of Serbia. Accord-
ing to the practice of the European Court of Human Rights, detention must be
a proportionate measure to achieve a certain goal, and it is up to the domestic
authorities to convincingly demonstrate that detention is necessary. Although
the same standards are proclaimed by the Code of Criminal Procedure of the
Republic of Serbia, this paper analyzes whether the mentioned reason for de-
tention and the legal standard of “disturbing the public” left too much room for
discretionary decision-making by domestic courts on this measure, which leads
to the consequence that detention is determined more widely than the intention
of the legislator. In regard to this issue, the authors analyze in detail the Europe-
an Convention for the Protection of Human Rights and Fundamental Freedoms,
standards set through the jurisprudence of the European Court of Human Rights,
legislative solutions of the Republic of Serbia, and also provide several illustra-
tive examples from domestic jurisprudence.

HIGH-TECH CRIMINALITY
Summary: Viewed from the aspect of the time we belong to, and in the time
ahead of us it will be more pronounced every day, one of the most dangerous
types of crime in general is high-tech crime. There are several reasons that speak
in favor of such a high degree of social danger of this type of crime. Among them,
the following are of special importance: every day’s increasing presence, and in
the most sensitive institutions of society as a whole. For example, it is enough to
mention the fact that hackers in the US entered the computer system of the Pen-
tagon; in Germany to the state chancellor’s computer; false anonymous reports
about planting bombs and explosives in schools, airplanes and other public institu-
tions in Serbia; then that the multitude of electronic letters blocked the electronic
system of banks and the government, etc. Considering this, it is not surprising,
for example, nor the warning by NATO officials that online espionage and ter-
rorism on the Internet represent some of the most dangerous threats to global
security. Then there are the consequences it entails, as well as its international
character. The characteristic of high-tech crime is its connection with the most
serious forms of crime (the case, above all, with organized crime and terrorism
where it becomes not only a powerful lever of their planning but also a key means
of execution), and ultimately a difficult way to detect and prove these crimes.

ENFORCED DISAPPEARANCES AS AN
INTERNATIONAL CRIMINAL OFFENSE
Summary: The aim of the paper is to analyze the concept of enforced disap-
pearances. It is an international criminal offense that can be interpreted as one
of the forms of crimes against humanity, as defined by the Rome Statute. At the
same time, this is one of the most serious violations of human rights. The Con-
vention on the Protection of All Persons from Enforced Disappearance from
2007, currently the only universal convention in this area, was analyzed. Part of
the paper is devoted to the Draft Articles on the Immunity of the Highest State
Representatives and, specifically, Article 7. This article lists criminal offenses
where immunity does not apply, and among other things, the criminal offense
of enforced disappearance is listed here. By analyzing this article and the Com-
mission’s work, the position of the states and the international community is
approached, as well as judicial practice in this area.

Summary: High corruption and organized crime connected with the highest
public office holders is a social reality of the modern world. Corruption affects all
aspects of social life and appears in all fields. The process of globalization, market
liberalization and the opening of borders have led to this negative social phe-
nomenon taking on visible global proportions. The author of the paper wants to
present a new and, by all accounts, revolutionary idea in a concise manner: the
International Anti-Corruption Court. New international mechanism for com-
bating high corruption, organized crime and the most serious forms of economic
crime that offends two or more sovereignties has, in today’s world, become an ur-
gent need. High corruption depends on a culture of impunity in countries whose
leaders will not allow national criminal laws to be enforced against their close
colleagues and themselves. The International Anti-Corruption Court would rep-
resent a mechanism for the implementation of international, as well as national,
anti-corruption instruments. It would deal with the issue of punishing corrupt
holders of public and judicial offices, businessmen and “professional” transnation-
al criminals at the international level. Successful prosecution and imprisonment
of corrupt politicians would create opportunities for the democratic process to
produce successors dedicated to serving their people, not enriching themselves.
