A. Cyber crime
1. Computer-related Forgery. —
a. The input, alteration, or deletion of any computer data without
right resulting in inauthentic data with the intent that it be
considered or acted upon for legal purposes as if it were
authentic, regardless whether or not the data is directly
readable and intelligible; or
b. The act of knowingly using computer data which is the product
of computer-related forgery as defined herein, for the purpose
of perpetuating a fraudulent or dishonest design.
2. Computer-related Fraud. — The unauthorized input, alteration, or
deletion of computer data or program or interference in the functioning
of a computer system, causing damage thereby with fraudulent intent:
Provided, That if no damage has yet been caused, the penalty
imposable shall be one (1) degree lower.
3. Computer-related Identity Theft. – The intentional acquisition, use,
misuse, transfer, possession, alteration or deletion of identifying
information belonging to another, whether natural or juridical, without
right: Provided, That if no damage has yet been caused, the penalty
imposable shall be one (1) degree lower.

B. Purpose
when the purpose of such act, by its nature and context, is to intimidate
the general public or a segment thereof, create an atmosphere or spread a
message of fear, to provoke or influence by intimidation the government or
any international organization, or seriously destabilize or destroy the
fundamental political, economic, or social structures of the country, or create a
public emergency or seriously undermine public safety, shall be guilty of
committing terrorism and shall suffer the penalty of life imprisonment without
the benefit of parole and the benefits of Republic Act No. 10592, otherwise
known as "An Act Amending Articles 29, 94, 97, 98 and 99 of Act No. 3815,
as amended, otherwise known as the Revised Penal Code".
A child who is above twelve (12) years of age up to fifteen (15) years of age and who
commits parricide, murder, infanticide, kidnapping and serious illegal detention where the
victim is killed or raped, robbery, with homicide or rape, destructive arson, rape, or
carnapping where the driver or occupant is killed or raped or offenses under Republic Act
No. 9165 (Comprehensive Dangerous Drugs Act of 2002) punishable by more than twelve
(12) years of imprisonment, shall be deemed a neglected child under Presidential Decree
No. 603, as amended, and shall be mandatorily placed in a special facility within the youth
care faculty or ‘Bahay Pag-asa’ called the Intensive Juvenile Intervention and Support
Center (IJISC).
