EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH ABSOLUTE SALE OF A PORTION OF LAND

KNOW ALL MEN BY THESE PRESENTS:

THIS DEED is entered and executed into by and between:

OFELIA MOLIŇO VISORRO, of legal age, Filipino, widow, and a resident of


Poblacion, Sta. Catalina, Negros Oriental, BENIGNO MOLIŇO JR., of legal age,
Filipino, married to Lilibeth Ferraren, and a resident of Taclobo, Dumaguete City,
Negros Oriental, AND TEOTIMO MOLIŇO, of legal age, Filipino, married to Corazon
Tayko, and a resident of Pob.acion, Sta. Catalina, Negros Oriental, hereinafter referred
to as the “HEIRS”,

W I T N E S S E T H:

That the herein HEIRS, as children of the late Benigno Moleňo married to
Juliana Maquiling Moleňo, are co-owners of a parcel of land with an undivided area of
THREE THOUSAND TWO HUNDRED SIXTY-SEVEN (3,267) square meters, more or
less, under Cadastral Lot No. 3270, bearing property identification No. 046-14-0009-
008-37, and another parcel of land with an undivided area of TWENTY SEVEN
THOUSAND EIGHT HUNDRED FORTY EIGHT (27,848) square meters, more or less,
under Cadastral Lot No. 3269, bearing property identification No. 046-14-0009-008-
38, both properties situated in Kabulakan, Sta. Catalina, Negros Oriental, registered
under the name of our predecessor Benigno Moleňo;

That Benigno Moleňo married to Juliana Maquiling Moleňo, both died intestate
at Poblacion, Sta. Catalina, Negros Oriental, without any known debts which remain
unsettled, and upon their deaths, were survived by us, their children, namely Benigno
Moliňo Jr., Ofelia Moliňo Visorro, Teotimo Moliňo, and Glecerio Moliňo;

That upon the deaths of the decedents Benigno Moleňo married to Juliana
Maquiling Moleňo, and the death as well of one of the heirs Glecerio Moliňo, who died
intestate on December 12, 1967, who died without any offspring, left the above-
mentioned parties as the sole and compulsory heirs of Cadastral Lot No. 3270, bearing
property identification No. 046-14-0009-008-37, and Cadastral Lot No. 3269, bearing
property identification No. 046-14-0009-008-38.

WHEREAS, it is to the best interest of the parties herein to settle and adjucate
and apportion the estate of the decedents among themselves, extrajudicially;

NOW, THEREFORE, for and in consideration of the foregoing premises, and


invoking the provisions of Section 1, Rule 74 of the Rules of Court, said above-
mentioned parties, do by these presents, hereby ADJUDICATE, APPROPRIATE and
APPORTION unto and among themselves the above-described portion of the property
thereby becoming the absolute owners thereof, free from all liens and encumbrances,
subject only however to the provisions of Section 4, Rule 74 of the Revised Rules of
Court, for a period of two (2) years from execution hereof.

W I T N E S S E T H F U R T H E R:

That the portion of the above-mentioned OCT No. FV-22902, designated as Lot
No. 3213-N, based on a yet approved survey, with an area of ONE THOUSAND FOUR
HUNDRED NINETY-EIGHT (1,498) square meters, more or less, particularly
described hereunder as follows, to wit:

Line 3-4, N 24˚09’E, 56.17m
Line 4-5, S 65˚33’E, 27.84m”

, inherited by the above-mentioned parties as surviving sole and compulsory heirs,


and who adjudicated extrajudicially among themselves, for and in consideration of the
sum of THREE HUNDRED FIFTY THOUSAND PESOS (P350,000.00) Philippine
Currency, in hand paid and receipt of which is hereby acknowledged by the VENDORS
to their entire satisfaction from the VENDEE, the former hereby SELL, TRANSFER,
and CONVEY all their rights, interests and participations over ONE THOUSAND FOUR
HUNDRED NINETY-EIGHT (1,498) SQUARE METERS, more or less, over an
undivided portion from the above-described real property, unto and in favor of the
herein VENDEE, her heirs and assigns, free from all liens and encumbrances;

That notice of pre-emption and/or redemption has been given but no such pre-
emptioner and/or redemptioner chose to exercise said lot and that said lot is not
tenanted;

IN WITNESS WHEREOF, the herein parties hereby affix their signatures this
___ day of November 2020, at Dumaguete City, Negros Oriental.
