Consultancy Services to be provided

Reference clause

Clause 2.1 General


The project area, scope and extent of the consultancy work are defined in this Terms of
Reference (TOR). The aim and objective of the project will be achieved basically through the
following approach:

Clause 2.2 Preliminary Study

Preliminary Study Report & Final Design Brief:

A Preliminary Study shall be carried out as appropriate and a report prepared which shall
include but not be limited to the Consultancy Services as defined in Schedule1.
The preliminary study shall include Traffic Impact Study covering the construction stage and
the operation stage.
The preliminary study shall include the most cost / time effective method of construction.
The Consultant will also be required to prepare a summary of the report.
The Consultant may have discussions with the Client to exchange ideas and opinions on
various aspects of the study. Any such ideas and opinions shall not be binding on the
Consultant or bind, commit or in any way signify approval by the Client.
It is anticipated that written acceptance of the receipt of the Preliminary Study will be given
within the period stated in Schedule 4 after it is established that it is generally acceptable.
After appraisal by the Client, the Consultant will, if required, amend and resubmit the
Preliminary Study to the Client within a period to be specified by the Client, which normally
will not exceed one week.
It is anticipated that written approval of the Preliminary Study will be given within the period
stated in Schedule 4 which period will commence from the date acceptance of the receipt of
the Preliminary Study.

The format and number of copies of the drawings and documents to be submitted for approval
at the Preliminary Study stage shall be as stated in Schedule 2.
The Consultant shall collect relevant data and ascertain, in conjunction with the Client, the
Project requirements. These shall include but not be limited to the following:

a. Schedule:
Location of the project requires that a Program study with appropriate programming
investigation analysis and documentation be undertaken in order to develop a detailed Scope
of Works and activities of project construction. The purpose of the Program study is to
determine the most effective approach to meet the project objectives.
a. Project execution strategy / construction activities , risks and constraints
b. Budget and time schedule limitations
c. Site information, such as:
Traffic Impact Study (during construction and operation stages) by an approved consultant
(Appendix C).

Drawings of existing structures, features and utilities


Climatic and environmental data
Boundary limits
Location of major nearby utilities structures
Statement on fundamental general and specific codes, building regulations and zoning
requirements
Preliminary space allocation programme
Extent of infrastructure
Site constraints.

The Consultant shall contact appropriate Public Authorities such as the DM, DEWA, ,
Etisalat, Du, Civil Defence & Civil Aviation etc and services providers in Dubai, to always
obtain relevant data related to the Project, NOC’s and to determine the location and capacity
of public facilities and services.

d. Final Design Brief:

Based on the preliminary Design Brief the Consultant shall develop, along with the Client, a
Design Brief and report for the project and standards for space requirements in compliance
with planning/ design regulations.
The Consultant shall, in close collaboration with the Client, finalise the Project Design Brief
with the objective of developing the Area and to include but not limited to:
• Review of local municipality rules and regulations applying to the site and their
application
• All Spaces allocations, program and Area Schedules.
• Operational requirements
• Facilities requirements
• Special relationships between facilities Designation of users
• Interfaces with existing or proposed facilities
• Special equipment and systems
• Extent of the infrastructure, landscaping and external works (where applicable).
• Preliminary Budget Estimate and Preliminary Cash Flow Forecast
• Client’s Building Management organization chart clearly showing organizational
framework and hierarchy.
• Environmental Report and Study ( if required).
• Review of all applicable Local authorities regulatory requirements.
• Review of all applicable cost and financial data.
• Options of connectivity to RTA headquarter building..
• Cost and time effective construction method/ solutions

The Consultant shall issue a report describing the Project Design Brief and including the
following for Client's approval:
• Project Programme to completion including Preliminary Budget Estimate and
Preliminary Cash Flow Forecast.
• Proposed staff organization chart for all design stages. Details of staff shall be
submitted for the Client’s approval.
• Proposed scope of sub-consultancy design services is if applicable..

e. Analysis
At the end of the data collection, the Consultant shall submit a Data Collection and Analysis
Report for the Client’s review and approval. This report shall include, but is not limited to the
following:
• An analysis of the collected information, i.e. regulatory, physical, financial,
environmental, traffic impact, parking, utility and demographic opportunities and
constraints and their effects upon the design process and intent.
• An analysis of the purpose of the project, including a clear statement of goals and
more specific objectives including commercial / investment partial areas.
• All plans, charts, graphs, matrices, sketches and similar graphic material necessary to
provide a clear understanding of the above analyses.
• Project Delivery Approach with recommendation on the most effective and feasible
type of construction for the project in terms of cost and time.
• Program of Work and Definitive Design Brief.

During this Stage and in parallel the Consultant is requested to produce and present to the
Client samples of advanced Architectural design sketches indicating design principles options
for the Client’s review, comments and selection.

Clause 2.3 Preliminary Design

The Preliminary Design shall include but not be limited to the Consultancy Services as
defined in Schedule 1.
Tender Documents
The following tender documents shall be presented for approval at Preliminary Design stage
and shall be stamped "Preliminary":
• Roads & Transport Authority Conditions of Contract.
• General Specifications including Particular Specifications, if applicable.
• Format of the Bill of Quantities/Schedule of Rates

The Tender Documents shall include but not be limited to the Consultancy Services as
defined in Schedule 1.
Submission of Drawings and Documents
The format and number of copies of the drawings and documents to be submitted at the
Preliminary Design stage for approval shall be as stated in Schedule 2.
Approval of Preliminary Design
It is anticipated that written approval of the Preliminary Design will be given within the
period stated in Schedule 4 which period will commence from the date of acceptance of the
receipt of the Preliminary Design. The approval will list all points requiring amendment for
incorporation in the Final Design.
The Preliminary Design shall consist of two stages, namely the Concept Design and the
Schematic Design each with its own submission and approvals process as follows:
A. Concept Design Development
This Stage will commence immediately after the Client’s written approval of the Preliminary
study & the final design brief. The Consultant shall, based upon the approved preliminary
study report, prepare a Concept Design Development that will define the building in terms of
space layout; area schedules site plan and preliminary elevations and sections, with 3D
images that can explain the project idea and materials used.

The Consultant shall:


• Commence the Concept Design development following receipt of the Client’s
approved Preliminary Study report Documentation.
• Hold initial meetings to review the Preliminary Study report documentation. The
meetings shall be chaired by the Client and minutes recorded by the Consultant
• Develop the approved design sketches, taking into account the Client’s design review
comments and recommendations, including Authorities requirements.
• The consultant shall issue a report describing the concept design and including the
following for Clients approval:
- Budget estimate and Cash flow forecast.
- Vertical transport analysis
- NOC’s status
- Area schedule
- Site analysis, including Traffic Analysis
- Space layout
- 3D images
- MEP concept
- Structural system

B. Schematic Design
This Stage will commence immediately after the Client’s written approval of the Concept
Design. The Consultant shall, based upon the approved Concept Design, prepare a Schematic
Design that will define the building in terms of final space layout, construction materials,
interior and exterior finishes and built in furniture, equipment and specialist’s equipment.

The Consultant shall:


• Commence the Schematic Design following receipt of the Client’s approved Concept
Design Documentation.
• Hold initial meetings to review the Concept Design documentation. The meetings
shall be chaired by the Client and minutes recorded by the Consultant.
• Develop the approved exterior and interior designs, taking into account the Client’s
design review comments and recommendations, including Authorities requirements.
• Liaise with all consultants and participate in related meetings as required.
• Hold discussions with relevant statutory authorities and departments
• Prepare General Arrangement drawings and preliminary dimensioned architectural,
structural, mechanical, electrical, plumbing, infrastructure, landscape plans, sections
and elevations covering all areas of design.
• Evaluate various structural, ELV, security, Mechanical, Electrical, Plumbing
Infrastructure systems and make recommendations on the proposed options and
develop schematic design accordingly.
• Establish the basis of and coordinate the detailed architectural, structural and MEP
services design…etc. and operation of the building in conjunction with the Client.
• Carry out the acoustic modelling for specific areas of the development as required and
prepare acoustic studies report.
• Prepare fire, life safety report.
• Conduct Vertical and Horizontal Transportation Analysis and recommendations
• Estimate loads and formulate concept design philosophy for infrastructure Including
HV distribution as required.

• Coordinate with kitchen and specialist suppliers to review and incorporate designs
showing all rooms and primary equipment / hood locations. Provide bulk MEP loads
for those spaces if commercially proposed and accepted..
• Make preliminary submissions of all available information to the relevant authorities
• Finalize the recommended construction procurement strategy.
• Accommodate in the Schematic design any environmental considerations that may be
required.
• Update the Cost Estimate for all buildings and areas.
At the conclusion of this Stage, the Consultant shall prepare a Schematic Design Report that
will summarize all of the work undertaken during this Stage. The Schematic Design Report
shall be submitted to the Client for review and approval and liaison with the Client and other
relevant authorities will be maintained during this period.

The deliverables under the scope of work of this Stage shall consist of but not limited to the
following:
A. Schematic Design drawings
The Schematic Design drawings to appropriate scales will include the following:
a. Architectural drawings
1) Code analysis with drawings showing means of egress and medical and fire rescue.
2) Site plan showing access routes, parking areas, site plan levels, existing and proposed
contours, building location and Project limit lines.
3) Floor plans showing:
• Space allocation and furniture layouts
• Cores and shafts
• Wall thicknesses
• Fixed equipment
• Horizontal and vertical mechanical transportation systems as applicable
• General dimensions and openings
• Fire zoning and partition type and fire rating
• Reflected ceiling plans where applicable.
• Floor pattern layouts
4) Roof plans showing preliminary drainage layout and equipment locations (if any)
5) Large scale partial floor plans of complex areas of important building components
6) Longitudinal and transverse building sections showing floor to floor heights, ceiling
heights and overall heights
7) Building elevations showing exterior finishes, openings and floor levels
8) Coloured interior and exterior perspectives to show the main areas and relations
9) Technical schedules
10) Proposed Suppliers list
11) Schedule of alternatives (with recommendations) for building materials, interior and
exterior finishes, methods of construction, maintenance and service systems, etc.

b.Structural drawings
Structural drawings and proposals of systems including Value Engineering exercises of
alternative materials and design solutions.
Schematic drawings shall include:
1) Standard details
2) Dewatering plans
3) Foundations plans and details

c. Mechanical, Electrical, Fire, Water Supply and Plumbing drawings


Mechanical Electrical, Fire, Water Supply and plumbing drawings and proposals of systems
including Value Engineering exercises of alternative materials and design solutions.

The Schematic Drawings shall include


1) Air conditioning and ventilation schematic drawings
2) Water services schematic drawings
3) LPG and fuel oil schematic drawings ( if applicable)
4) Sprinkler, hose reel, hydrant schematic drawings
5) Public health schematic drawings ( Drainage & Garbage ,etc)
6) Electrical schematic drawings
7) Earthing& lightning protection sys schematic drawings.
8) Fire Detection / PAVA schematic drawings
9) ELV schematic drawings
10) BMS drawing
11) General arrangement plans – air conditioning and ventilation
12) General arrangement plans – public health
13) General arrangement plans – Sprinkle / hose reel / hydrant
14) General arrangement plans – water & LPG services
15) General arrangement plans – power and ancillaries
16) General arrangement plans – lighting
17) General arrangement plans – data, IT, voice, CCTV, security, access control etc.

Vertical and Horizontal Transportation drawings, a transportation analysis report, and
proposals of systems including Value Engineering exercises of alternative materials and
design solutions.
e. Special Systems
Studies and drawings of special systems including Value Engineering exercises of alternative
materials and design solutions.

f. Infrastructures and Utilities


Schematic design and drawings for infrastructure, and utilities including Value Engineering
exercises of alternative materials and design solutions of the following systems (if
applicable):
1) Site development., site survey and existing conditions
2) General Arrangement and Layout drawings
3) Horizontal and Vertical Alignment, setting out details
4) Water supply system
5) Fire fighting system
6) Sewage system
7) Surface drainage system
8) Power and low current distribution networks
9) Roads, accesses, pathway, pedestrian bridges, etc.
10) BMS/Data Centre Systems
11) Storm water network
12) Main irrigation system
13) Road lighting system (if applicable)
14) Central plants and related systems (if applicable)
15) District Cooling
16) Gate and access
17) Any other drawings and systems as viewed necessary.
18) Proposed list of suppliers
19) Initial load and distribution calculations

g. Lighting Design
The Lighting Design section shall describe the Lighting concept design and will include:
1) Project's brief
2) Schematic Design Criteria
3) General description of the proposed system and equipment
4) Lux calculation sheet.

B Outline Specifications
The Consultant shall submit outline/draft specifications for all components of the Project.
These will include material and equipment specifications as well as performance
specifications for custom manufactured and assembled system. The Outline Specifications
will be submitted with the Schematic Design Report in a separate bound document.

The Consultant shall propose, for Client’s approval, a standardized format for the presentation
of performance Specifications. The Consultant shall submit one complete performance
Specification section with the Outline Specifications, to demonstrate to the Client the format
to be adopted.

C Peer review sessions (if applicable)


The Consultant shall carry out peer review sessions throughout the Schematic Design Stage.
These exercises shall comprise the investigation of alternative materials and design solutions
to achieve cost effective and aesthetic solutions.

D Permits and Authorities Approvals


The Consultant shall prepare all requisite documents necessary to obtain all approvals and
permits and shall submit same to all Governmental Authorities having jurisdiction over the
Project. The Consultant shall follow up with the various Authorities to review technical
matters and shall obtain all approvals and permits.
The permits should be obtained by the consultant and it is his responsibility to ensure no
impact / change to the tender/ contract documents to avoid variations.
The cost of any permits and fees for approval shall be borne directly by the Client, unless
additional fees are required to be paid as a result of the Consultant’s underperformance or lack
of performance.

E Schematic Design Report


The Schematic Design Report shall include, but not be limited to, the following sections,
including the above sections and requirements as listed:
1) Executive Summary to include areas of concern, scope changes, major decisions taken
during this stage, etc.
2) Updated Managerial Reports
3) Updated Programme to completion
4) Updated cash flow to completion
5) Updated area gross floor calculations and net area schedules,
6) Review and update of all design disciplines for the Project
7) Alternative design solutions together with a summary of the results of Value
Engineering exercise. Recommendations for the implementation of alternatives.
8) Summary of Schematic Design Estimate, together with reconciliation with Approved
Budget. Estimate back up calculations to be submitted in a separate bound volume.
9) Project procurement and execution strategies.

Clause 2.3 Final Design & Tender Documents


The Final Design shall include but not be limited to the Consultancy Services as defined in
Schedule 1.

2.4.1 Final Design


The Final Design shall include an updating of the Preliminary Design and all approved
relevant data and drawings.
The Final Design shall include all the design, calculations, drawings, details, schedules, and
specifications required for the execution of the Project.
The requirements of the Service Authorities shall be included in the Final Design.

2.4.2 Tender Documents


The Consultant shall prepare and submit the Final Design and Tender Documents
incorporating the Client’s review comments of the previous Stage, final Bills of Quantities
,list of approved sub-contractors, Manufacturers and Material (mechanical & electrical)
should be incorporated.

Tender Documents
The tender documents for each contract shall include but not be limited to the followings:
• Instructions to Tenderers
• Scope & Description of the Works
• Tender and Appendix
• Form of Agreement
• General Conditions of Contract
• Particular Conditions of Contract
• General Specifications
• Particular Specifications
• Bill of Quantities/Schedule of Rates
• Drawings
All tender documentation must be to the Client's approval.

A. Final Design and Tender Documents


Final Design and Tender Documents shall comprise:
a. Volume 1 - Conditions of Contract
b. Volume 2 – Specifications
c. Volume 3 - Bills of Quantities
d. Volume 4 – Drawings
e. Volume 5 – Schedules
f. Volume 6 – Soil Report
g. Volume 7 – Annexure, Addendums& Bulletins

B. Final Design Report


On completion of the Final Design and Tender Document Stage, the Consultant shall submit a
Final Design Report summarizing all stages of the design.

C. Consultant’s Design Review


Following submission of the Final Design and Tender Documents, the Consultant shall
conduct and document an internal review and coordination check of the design of disciplines
under its scope. The review shall be conducted by the Consultant’s team that was not involved
in the design development. The Consultant shall report to the Client on the findings and
recommendations and shall update drawings (if any) accordingly to be issued to Tenderers as
an Addendum.

2.4.3 Submission of Drawings and Documents


The drawings and documents submitted for approval must be stamped " Final Design".
Following the approval of the submission all drawings and documents must be stamped
"Approved". The format and the number of drawings and documents to be submitted shall be
as stated in Schedule 2.

2.4.4 Approval of the Final Design


It is anticipated that written approval of the Final Design will be given within the period
stated in Schedule 4, after it is established that all amendments to the Preliminary Design have
been incorporated and the Final Design satisfies the contractual requirements.

The Final Design shall consist of the following:

Final/ Detail Design


Upon the approval of the Schematic Design by the Client, the Consultant shall immediately
proceed with the preparation of the Final/ Detail Design and Tender Documents of the
Project, which shall initially be submitted in draft form.

The sizes, layouts and routes of all services, structures and spaces shall be finalized,
coordinated and submitted as part of the Detail Design drawings and documents. During this
stage:
(a) The Consultant shall prepare detail design documentation comprising location,
assembly and component drawings, schedules, specifications and Bill of Quantities.
(b) The Consultant shall prepare comprehensive particular specifications covering all
aspects of the work, noting minimum requirements of Client specifications.
(c) All drawings shall be fully coordinated across the disciplines, including all other
consultants and shall be signed and checked accordingly by the Consultant
(d) The Consultant shall obtain at completion of this stage all required permits including
the main building permit and shall consult with all services authorities, relevant
governmental departments, and secure approval certificates and no objections
certificates as required.
(e) The Consultant shall prepare and submit weekly progress report of design activities,
comprising actual and planned status of completion.
(f) The Consultant shall prepare comprehensive conditions of particular applications for
the construction contract noting minimum requirements of Client general conditions.
(g) The Consultant shall review the cost plan prepared at Stage 3 (Schematic Design
Stage) and revise in line with the Detail Design drawings and specifications
incorporating approximate quantities.
(h) The referencing of documents and drawings shall comply with Client office standards.

The Detail Design shall comprise detailed and fully coordinated Tender Drawings,
Specifications and other Documents including but not limited to the following (where
applicable):

A. Final/ Detail Design Drawings


The drawings that will be to appropriate scales will include the following if applicable:
a. Architectural drawings
b. Structural drawings
c. Mechanical drawings
d. Mechanical – HVAC
e. Electrical, Fire Detection and ELV drawings
f. Vertical and Horizontal Transportation Systems drawings
g. Special Systems
h. Infrastructure and Utilities drawings
i. Lighting Design drawings where applicable

B. Final Specifications

The Consultant shall prepare and submit in previously approved North American CIS Master
Formats, Specifications for all Project components. These shall include quality control
requirements, product detail technical specification and execution and workmanship

requirements. The Project Specification shall also include performance specifications for
custom manufactured and assembled systems.

All Specifications of materials, equipment furniture; finishes, etc. shall be with proven
performance and shall ensure high performance and the capability of withstanding repetitive
abuse by users. Specifications of materials shall also be based on being "maintenance
friendly".

C. Final Bills of Quantities

The Consultant shall prepare and submit, in previously approved formats and in accordance
with previously approved Method of Measurement, Bills of Quantities for the Construction
Contracts.

D. Tender and Contract Conditions

The Consultant shall prepare and submit draft Tender and Contract Documents comprising
the following:
• Instructions to Tenderers
• Form of Tender and Appendix to Tender
• Conditions of Contract
• Any other documents

E. FinaI Cost Estimate

The Consultant shall prepare and submit the Draft Final Cost Estimates for the Project,
supported by fully priced Bills of Quantities. Subject to the Cost Consultant having
continuously updated the cost estimates throughout the previous Design Stages, if the Final
Cost Estimate exceeds the Approved Budget for the Project by more than 5%, the Client shall
have the right to instruct the Main Consultant to amend, without any additional fees, the Final
Design to ensure that the Final Design Cost Estimate does not exceed the Approved Budget.

The Consultant shall carry out a review of the specification and drawings prepared to confirm
or otherwise conformance with the materials and products on which the Approved Budget is
based. The Consultant shall also advise the Client of any non-conformance together with the
estimated cost effect.

Clause 2.4.2 Tender Documents


During final design stage, the Consultant shall prepare a complete set of final tender
documents comprising volumes 1,2,3 and 4 incorporating all comments made during
preliminary and final design submissions.

Cost Estimate – The final cost estimate shall be provided at final design stage based on final
tender documents.

The Consultant shall always return the RTA commented documents along with all new
revised submission in the each stage.

All tender documentation must be submitted with a digital editable copy to the Client's
approval.

Clause 2.4.3 Submission of Drawings and Documents

The hard copies of the drawings and documents submitted for approval must be stamped
"Final Design". Following the approval of the draft submission all drawings and documents
must be stamped "Approved". The format and the number of documents submitted shall be as
stated in Schedule 2.
The soft copies shall be divided into:
A- Tender Document (Adobe "pdf" files that allows printing only)
- Volume 1- Instruction to Tenderer, Form of Tender, Appendix to Tender,
Form of Agreement, Specimen forms (Tender Bond, Performance Bond,
Advance Guarantee), Standard Conditions of Contract Part (1 and 2), Rules of
Arbitration and Conciliation, Conditions and Procedures for Advance
Payment and Engineer's Over Time Schedule.
- Volume 2 - General Specifications and Particular Specifications, if applicable.
- Volume 3- Bill of Quantities
- Volume 4- Drawings
- Volume 5- Other (if any)
B- Supporting Documents (Volume 3 – BOQ and Volume 4 Drawings but in a
different format than stated previously.)
- For Volume 3- BOQ
• It will be an excel file with sheets.
• All the cells in the excel file shall be locked with password except for the
cells where the contractor adds his unit price.
• The sheet shall automatically calculate each section total and the contract
price total.
• The consultant shall test the formulas used in the sheet to ensure that
sheet is free from any calculation errors.
- For Volume 4- Drawings
• It will be normal as the original drawing format.

1. The structure of the CD will be as follows:

Clause 2.4.4 Approval for the Final Design

It is anticipated that written approval of the Final Design will be given within the period
stated in Schedule 4 after it is established that all amendments to the Preliminary Design have
been incorporated and the Final Design satisfies the contractual requirements.

Clause 3.0 Consultancy Services For Tendering

Clause 3.1 Pre-qualification (If required)

The Consultant is only to proceed with this stage of work upon the Roads & Transportation
Authority request.

- Draft proposal to pre-qualification procedure is to be submitted, discussed


and approved by the client beforehand.
- A comprehensive analysis report, together with the Consultants
recommendations.

Clause 3.2 Tender Procedure


The Consultant to ensure the receipt of the Contractor’s queries, prepare the answers for
Roads & Transport Authority approval before issuing to Contractors. All Addenda and
Bulletins must be issued only upon the client’s approval. With the issuance of Addenda and
Bulletins, an updated CD (as identified in section 2.4.3) should be issued stamped on it all
previously stated items in addition to the revision no. The Contractors shall copy Volume 3-
Bill of Quantities” folder on his computer, insert his rates and copy his updated file to a new
CD and submit it to the Employer to represent his bid. Another Hard copy having
Contractor’s rates shall also be submitted. The contractor shall sign on the CD in the specified
area in addition to another document that states that he had reviewed all the documents on the
CD with the specified Serial No. and he agrees to contents.

The Client shall carry out the tendering procedure and shall receive all tenders, with the
assistant of the Consultant, who shall attend the tender opening. After the opening and
registration of the tenders, copies of the tender submissions will be collected by the
Consultant who shall prepare a tender report with analysis and recommendations to the Client
within the period stated in Schedule 4.

The preparation of Tender Report with detailed analysis and recommendations shall not be
limited to the following areas:

1. Reference
2. Tender Documentation
3. Tender Results
4. Qualification
5. Detailed Tender Comparison
6. Feasibility of each individual item
7. Schedule of “Rates and Day works”
8. Detailed analysis of alternatives with Consultants recommendation
9. Conclusions
10. Recommendation

The Consultant has to submit during this stage of work, the full details of his list of suggested
supervisory staff with their qualifications, detailed C.V.’s and periodical involvement (as per
Clause 5.2).

Clause 3.3 Acceptance of Tender

The Consultant shall prepare and submit Contract Documents as stated in Schedule 2 & 3.
The procedure to be followed on preparation, submission and distribution of Contract
Documents as below:
a) Prepare two (2) Sets of Contract Documents comprising of:

Volume 1 – Tender and Contract Conditions


Volume 2 – Specification and
Volume 3 – Bill of Quantities
Volume 4 – Drawings
Volume 5 – Others (if any)

which shall be marked as “Contract Documents” and forward to the Contractor for its
signature on the Agreement pages and stamp with the company stamp on every page of the
Contract Documents. The Contract Documents shall be forwarded to the Contracts &
Purchasing Department of Roads and Transport Authority within a period of Nine (9) days
from the date of receipt of the “Notification of the Tender Acceptance”. In case of returned of
these documents for any amendments, the revised documents shall be re-submitted with in
Four (4) days.

b) Following the signing of two original sets of Contract Documents by


the officials of Roads and Transport Authority, one original set
containing Volumes 1,2, 3 & 4 will be returned to Consultant, in order
to produce Four (4) sets of photocopies of Volume 1& s and three (3)
photocopies of Volume 2. Upon completion of producing necessary
photocopies, the Original Set of the signed documents shall be
delivered to the Contractor and the photocopied documents shall be
delivered as follows:
1) Concerned Project Liaison Department - Volume 1, 2, 3 & 4.
2) Contracts & Tender Section - Volume 1, 2 & 3.
3) Finance Department - Volume 1 & 3.

Clause 4.0 Construction Supervision

The Consultant shall perform the duties of the Engineer as required by Conditions of
Contract.

The Consultant shall oversee all aspects of the construction to ensure strict compliance with
the Drawings and Contract Documentations. Remuneration shall be as set out in Schedule
3A, Clause 7.7 payment for Construction Supervision.

The Consultant shall perform the duties of the Engineer as required by Conditions of
Contract.

Clause 4.4 Reports

The Consultant shall submit reports of the Contractor’s Forecasted Payment Certificates
(CFPCR) to the Roads Department with a copy to the Contracts and Purchasing Department
and the Finance Department. The First report shall be a provisional report, submitted seven
days after the Commencement Date, after consultation with the Contractor. The Following
reports shall be submitted quarterly, and shall reflect the changes of the most updated clause
14 program, all the previous Payment Certificates, changes in quantities, additions and
omissions, and the anticipated Revised Final Contract Price. The Payments Certificate being
within the amounts mentioned in the (CFPCR) will ensure smooth release of the payments;
therefore, special care shall be considered while preparing the (CFPCR).

Clause 4.5 Accounts, Claims

The Consultant shall check and certify the Contractor's monthly statements within 14 days
from their receipt. The format of these Monthly or Interim Payment Certificates shall follow
RTA’s approved Form. The Consultant’s shall compare the Contractor’s monthly statement
with the Contractor’s most recent Contractor’s Forecasted Payment Report.

The Consultant shall check and verify the Contractor’s insurances as per the Contractor’s
obligation in the Condition of Contract. In the event, that the Contractor was carry beyond
the time for completion, the consultant shall ensure that the Contractor comply with the
insurances requirement before certifying any Contractor’s monthly payments. The consultant
shall send in his submission for the reviewed Contractor's Interim Payments a combination of
soft and Hard copies.

The certified hard copy of Payment Certificate will be submitted for the following:

Submission of Drawings and Documentation

The Consultants shall facilitate and provide the RTA with unfettered access to all
documentation relating to the execution of the Services, in particular demonstrable evidence
of discharging the Consultants duties under this Consultancy Agreement.

All Costs incurred by the Consultants in connection with or in relation to their contractual
obligations concerning the reporting requirements and deliverables are deemed to be included
in the Consultancy Fees unless and until the RTA instructs the Consultants additional copies
of a submitted item.
The additional Submission of Soft or Electronic Format, as applicable, for all deliverables is
mandatory.
RTA reserves the right of deduction on the provided fees, if copies are not submitted as per
RTA requirements.
The Consultant is to obtain RTA approval on the format of submission where optional.

Schedule 3(D): Remuneration in Respect of Professional Indemnity Insurance

The remuneration of the Consultant for the provision of Professional Indemnity Insurance as
described in Clause 6.2.8 shall be included in the fees for the Pre-contract Consultancy
Services. The Indemnity Insurance value shall be as follows:

• Limit of Indemnity per occurrence shall be 10 % of the Project Cost for Projects
costing up to Dhs. 60 million.
• For Projects costing above Dhs. 60 million, limit of Indemnity per occurrence shall
be Dhs. 6 million per occurrence.
• Number of occurrences shall be unlimited.

• The design should fit 900 cars.
• Floors are G+4+Roof
• The building should be designed for a 10 stories height for future expansion.
• Deliver 2 different design concepts.
• 2 Bridges connections between the multistory car park and RTA HQ.to be studied
thoroughly, designed considering authorities regulations.
• Prepare TIS report Study.
• Consider all Authorities regulations on the proposed concepts.
• Detailed study of the vehicle circulation in the area.
• Detailed study of the capacity of the multistory car park.
• Future expansion.
• Green roof as applicable

storm water, irrigation, etc, green roof mechanical requirement ….)
• Design General Analysis of all design criteria and concept assisted by all the necessary
diagrams, sketches and plans, together with alternatives and recommendation.
• Full set of NO OBJECTION CERTIFICATES from all services authorities together
with the estimated cost implications for final connection.
• Design Services Authority requirements in close co-ordination with the Services Co-
ordination Centre at Dubai Municipality.
• Design water drainage including pumping stations if required or to the existing DM
network.
• Design low Noise, environmental and visual intrusion/aesthetic aspects.
