[12A. Procedure to be followed for de-registration of trust
st und. under sectie (1) Every Deputy or Assistant Charity Commissioner sho on the basis of the record of the trust before it, that the the de-registration as contemplated in sub-section he trust a8cert (3-A) of (3-A) of sectiondesr (2) The Deputy or Assistant Charity Commissioner shall, if trust. om de-registration under sub-rule (1), make inquiry of the trust to be d y in the manner be de-regst specified in rule 7 and also by issuing notices to the record and notice in accordance with rule 7-A, to the concerned persontrust whether the trust is liable for de-registration on the grounds mentione section (3-A) of section 22 and then pass appropriate order under it. (3) If the Deputy or Assistant Charity Commissioner, in the course. inquiry, finds that the trust has movable or immovable properties, he over the management of such properties and record its details in form Schedule I-C appended to the rules. gven (4) The Deputy or Assistant Charity Commissioner shall, after taking Ote possession of the trust property and after hearing objections, if any, pass fur orders for disposal of such property after ascertaining value of such propert (5) The Deputy or Assistant Charity Commissioner may, after passing order under sub-rule (4) for the sale of the property, sell it by holding aucte after inviting offers by publishing a notice in the two newspapers having; wide circulation in the area where the property is situated, on such terms conditions as he may deem fit. (6) The Deputy or Assistant Charity Commissioner shall, after sale ofa property of the trust to be de-registered, deposit the sale proceeds in the Puii Trusts Administration Fund.
12B. Maintenance of register of de-registration of trusts:
There shall be maintained in every Public Trusts Registration Office or Public Trust Registration Ofice, a register of the trusts de-registered under ot s section (3-A) of section 22 of the said Act, in the form appended to the rules.] given in Schedule 13.
