INSTRUCTIONS:
1. Read the questions carefully and answer.
2. Unnecessary queries on the Question Paper shall not be entertained.

Question No. 1 is compulsory. Answer any four questions from Question No. 2 to 6. All
questions carry equal marks.

1. ‘F’ runs a family enterprise ‘Y1’ and resides in Sixmile with his family members ‘G’, ‘H’,
‘J’ and ‘L’. To help their family financially ‘J’ born on 11th March 2007 along with her
brother ‘L’ born on 15th March 2005 work in establishments ‘Y2’ and ‘Y3’respectively.
Every Sunday eight year old ‘H’ plays in the nearby park for one and a half hour and then
accompanies his mother ‘G’ to the market. As on 28th May 2021 ‘L’ works from 4:30 pm
to 6:30 pm on Wednesday in establishment ‘Y3’. ‘H’ after returning from school at 1:30
pm helps ‘F’ in ‘Y1’ every week from 4:30 pm to 6:00 pm on Wednesday and Thursday.
In establishment ‘Y2’ as on 28th May 2021 ‘J’ works for six days a week from 9:15 am to
3:15 pm including interval of rest from 12:15 pm to 1:15 pm and from Tuesday to Saturday
‘L’ works from 8:30 am to 2:30 pm and on Monday ‘L’ works from 9:00 pm to 5:00 am
including interval of rest from 1:00 am to 2:00 am. On Monday every week ‘H’ works
along with ‘F’ in ‘Y1’ from 9:30 am to 2:30 pm. No hazardous operations or processes are
carried out in establishment ‘Y2’ and ‘Y3’. The employer of ‘Y2’ on 17th January 2020
was convicted for employing thirteen year old ‘Q’ and was sentenced to imprisonment for
nine months and fine of Rs. 25,000/-. Examine the above mentioned case in the light of the
relevant provisions of law in India. (10 Marks)

2. Discuss the responsibilities of the contractor and the rights of the contract labour under the
provisions of relevant law in India. (6+4=10 Marks)

3. “Right of woman to a safe environment free from sexual harassment in workplace is


recognised under the Constitution of India and the Convention on the Elimination of all
Forms of Discrimination against Women”.- In the light of the above statement analyze the
legal framework and challenges to the implementation of the relevant law in India.

4. Critically explain the law pertaining to social security and welfare of unorganised workers
in India. (10 Marks)

5. In the light of judicial decisions discuss the legality and justifiability of ‘strike’ in India
under Industrial Disputes Act, 1947. (10 Marks)

6. Explicate the significance of the maternity benefit provided to female employees under the
Maternity Benefit Act, 1961. Briefly discuss the salient features of the Industrial Relations
Code, 2020. (6+4=10 Marks)
