1. National Narcotics Agency(BNN)

The National Narcotics Agency (abbreviated as BNN) is an Indonesian Non-Ministerial


Government Institution (LPNK) which has the task of implementing government in the field
of prevention, control and illicit trafficking of drugs, psychotropics, precursors and other
addictive substances except for addictive substances for tobacco and alcohol. BNN is led by
a head who reports directly to the President.

BNN's legal basis is Law Number 35 of 2009 concerning Narcotics. Previously, BNN was a
non-structural institution established based on Presidential Decree No. 17/2002, which was
later replaced by Presidential Regulation No. 83/2007.

The current head of BNN RI is Dr. Petrus Reinhard Golose led the Inauguration ceremony and

a. History.
The history of hazard management and its institutions in Indonesia began in 1971
when the Presidential Instruction of the Republic of Indonesia (Inpres) No. 6/1971 was
issued to the Head of the National Intelligence Coordinating Agency (BAKIN) to tackle 6
(six) prominent national problems, namely eradicating counterfeit money, overcoming
counterfeit money. drugs, prevention of smuggling, prevention of juvenile delinquency,
prevention of subversion, supervision of foreigners.

Based on the Presidential Instruction, the Head of BAKIN formed the 1971 Bakolak Inpres,
one of whose duties and functions was to tackle the dangers of drugs. Bakolak Inpres is a
small coordinating body consisting of representatives from the Ministry of Health, Ministry
of Social Affairs, Ministry of Foreign Affairs, Attorney General's Office, and others, who are
under the command and report to the Head of BAKIN. This agency does not have
operational authority and does not receive its own budget allocation from ABPN but is
provided based on internal BAKIN policies.
At that time, the drug problem in Indonesia was still a small problem and the New Order
Government continued to view and believe that the drug problem in Indonesia would not
develop because the Indonesian nation was a nation that adhered to Pancasila and was
religious. This view turned out to make the government and the entire Indonesian nation
unaware of the dangers of drugs, so that when the drug problem exploded with the regional
currency crisis in mid-1997, the Indonesian government and nation seemed unprepared to
deal with it, in contrast to Singapore, Malaysia and Thailand which since 1970 consistently
and continuously fighting the dangers of drugs

Facing the drug problem which tends to continue to increase, the Government and the
House of Representatives of the Republic of Indonesia (DPR-RI) passed Law No. 5/1997 on
Psychotropics and Law No. 22/1997 on Narcotics. Based on these two laws, the
Government (President Abdurahman Wahid) established the National Narcotics
Coordinating Board (BKNN), with Presidential Decree No. 116/1999. BKNN is a drug-control
coordinating agency consisting of 25 relevant government agencies.

BKNN diketuai oleh Kepala Kepolisian Republik Indonesia (Kapolri) secara ex-
officio. Sampai tahun 2002 BKNN tidak mempunyai personel dan alokasi anggaran
sendiri. Anggaran BKNN diperoleh dan dialokasikan dari Markas Besar Kepolisian
Negara Republik Indonesia (Mabes Polri), sehingga tidak dapat melaksanakan tugas
dan fungsinya secara maksimal.

BKNN as a coordinating body is no longer adequate to deal with the increasingly serious
threat of drug danger. Therefore, based on Presidential Decree Number 17 of 2002
concerning the National Narcotics Agency, BKNN was replaced with the National Narcotics
Agency (BNN). BNN, as a forum institution with the task of coordinating 25 relevant
government agencies and supplemented with operational authority, has the following duties
and functions: 1. coordinating relevant government agencies in the formulation and
implementation of national drug control policies; and 2. coordinate the implementation of
the national policy on drug control.

Starting in 2003, BNN has only received a budget allocation from the APBN. With the APBN
budget allocation, BNN continues to improve its performance together with BNP and BNK.
However, because without an institutional structure that has a firm and only coordinating
line of command (mere functional similarities), then the National Narcotics Agency is
considered unable to work optimally and will not be able to deal with drug problems that
continue to increase and become more serious. Therefore, the authorities in this case
immediately issue Presidential Regulation Number 83 of 2007 concerning the National
Narcotics Agency, the Provincial Narcotics Agency (BNP) and the Regency/City Narcotics
Agency (BNK), which have operational authority through the authority of the relevant BNN
Members in the task force, where BNN-BNP-BNKab/City are partners at the national,
provincial and district/city levels, each of which is responsible to the President, Governor
and Regent/Mayor, and each of which (BNP and BN Kab/City) does not have a structural-
vertical relationship with BNN.

Responding to the development of drug problems that continue to increase and become
increasingly serious, the MPR-RI Decree Number VI/MPR/2002 through the General Session
of the People's Consultative Assembly of the Republic of Indonesia (MPR-RI) in 2002 has
recommended to the DPR-RI and the President of the Republic of Indonesia to make
changes to the Law Number 22 of 1997 concerning Narcotics. Therefore, the Government
and the DPR-RI passed and enacted Law Number 35 of 2009 concerning Narcotics, as an
amendment to Law Number 22 of 1997. Based on Law Number 35 of 2009, BNN was given
the authority to investigate and investigate narcotics and precursor crimes. narcotics. What
BNN is currently fighting for is a way to IMPROVE drug dealers or dealers, because it is
alleged and proven in several cases that drug sales have been used for terrorist financing
(Narco Terrorism) and also to avoid drug sales activities for political costs (Narco for
