This CONTRACTUAL EMPLOYMENT AGREEMENT (“Agreement”) is entered into on __________at ____________,

by and between:

CTK HR Solutions Inc. a Human Capital Management Corporation organized


and existing under the laws of the Philippines, with address at 2 fox Street Filinvest
Homes East Cainta, Rizal (hereinafter referred to as the “COMPANY”);

“EMPLOYEE”)

Witnesseth that:

WHEREAS, this Agreement confirms the Employee’s employment with the Company on a CONTRACTUAL status with
the designation of _________________________________;

WHEREAS, the Employee undertakes to abide by the Company’s rules and regulations as well as by the terms and
conditions stated herein;

NOW THEREFORE, for and in consideration of the foregoing premises, the parties enter into this Agreement under the
following terms and conditions:

1. EMPLOYMENT

(a) The Company hereby employs the Employee to serve as


_________________________________. The Employee hereby accepts such contractual
employment, subject to the terms and conditions set forth herein. Duties and responsibilities
required for the project to be undertaken shall be provided under Annex A of this Agreement.

(b) The Employee shall report to the assigned Immediate Supervisor on everyday operating issues.
The Employee will perform services and assume responsibilities as prescribed by the Company for
the position assigned during the term of this Agreement. Job title and responsibilities assigned to
the Employee may be adjusted and/or revised by the Company as its operations may so require to
accomplish the project specifically named as “Customer Safety and Food Sanitation
Program during Covid 19 Pandemic”.

(c) This Agreement is for a period co-terminus with our contract with client. Your employment will
commence on _______________________ ends on _____________________The Employee
shall remain on contractual status until and unless the Company notifies the Employee in writing,
on or before the expiration of the project period that the Employee’s services will be discontinued.

(d) During the Employee’s contractual employment, the Employee will be working with the Company
on a contractual basis with a regular evaluation within the five months’ contract period. The
Employee’s continuation with the contractual based status shall be based on the Employee’s
having successfully passed or complied with the Company’s established standards as provided in
the official evaluation form to be officially used.

Further the Employee agrees to undergo a regular Performance Evaluation on the 3rd, and 5tth
month of the contract/project period to determine their knowledge, skills and attitude’s fitness to
continue with their employment within the one-year period.

(e) The Company likewise reserves its right to terminate the Employee’s contractual based
employment, even prior to the expiration of the contract / project period, for any of the just and
authorized causes provided by existing law and/or for the Employee’s failure to satisfactorily meet
and comply with company’s standards, conditions and requirements. In such events, the
Employee will be entitled to collect only the salary up to the end of working hours of the last day of
the Employee’s actual service.

2. WORK SCHEDULE

(a) Regular Work Hours: Six days of work per week with one moving rest day to be provided on a
weekly schedule. May also be required to work during Holidays and Rest Days but with
corresponding and lawfully acceptable pay.

(b) The Employee agrees that the Company may adjust or effect changes in the the foregoing regular
daily work hours according to the Company’s operational necessity and capacity. Any excess in

the work hours herein must be first authorized by the immediate supervisor prior rendering of
service to be considered official.

(c) The Employee agrees, during the entire period of this contractual employment, to be assigned to
any work, workstation or branch as assigned by the Company for such periods as may be
determined by the Company and whenever the contract/project requires such assignment.

3. COMPENSATION

(a) For giving his entire time and attention to the work assigned, the Employee shall be paid the
minimum daily basic salary of _____. as prescribed by law and with overtime pay and night
differential pay if necessary.
(b) The above salary shall be released by the Company to the Employee every ____ and ___ of
each calendar month.

4. TERMINATION

(a) The Company may terminate the Employee’s contractual based employment at any time for any of
the just and authorized causes provided by existing law and/or for the Employee’s failure to
satisfactorily meet and comply with the standards, conditions and requirements for employment
stated herein and in the Rules and Regulations of the Company. Likewise, the Company shall have
the right to terminate this Agreement upon the occurrence of any material breach on the part of the
Employee of this Agreement.

(b) The Employee may terminate this Agreement at any time by serving a written notice to the
Company at least thirty (30) days prior to the date of actual last day of employment. Should the
Employee fail to give such notice, Employee agrees that the Company will be entitled to claim
damages in the amount equal to the Employee’s one-month salary and forfeiture of accumulated
cash bond.

(c) The Company reserves the right to immediately pull out/ discontinue the Employee’s work
assignment from the Company’s Client in cases wherein Employee failed to pass the minimum
required standards as provided in the official performance evaluation. The same action of pull out/
discontinuance will apply in cases wherein Employee commits an administrative, civil and/or
criminal violation against the Company or the Company’s Clients provided that a prior written
notice is issued to both Company Client and Employee.

(d) In case of termination of employment as provided herein, the Employee shall abide by the usual
administrative procedure conducted by the company, such as, but not limited to, surrendering of
Company Identification Cards (ID), and submission of clearance form duly signed by all
departments. It is agreed that pending verification of account, the Employee’s final salary shall be
witheld would not be released without the duly accomplished clearance form.

5. NOTICES

All notices provided for in this Agreement shall be in writing and shall be deemed effectively given
or served when it is actually received by the other party, or when mailed, through registered mail with
postage prepaid, in the address of the party herein provided, or to the party’s last known address.

6. LIABILITY

(a) In case of accident The Employee agrees that, in case of losses of the Company and Company Clients’
items, products, funds, records or files which are in his custody or care, the Company shall hold the
Employee responsible or liable to such losses should the Company find the Employee guilty of the said
losses. In such cases, the Employee shall assume the responsibility to pay the amount of the said
losses to the company.

(b) The Employee agrees that violations of the provisions of this Contractual Based Employment
Agreement shall be a ground for the termination of this Agreement and his employment. In addition, the
Employee agrees to pay the Company a reasonable amount representing damages should there be any
caused by such violation. In all the foregoing, the demands of due process shall be observed.

(c) The COMPANY shall answer for losses and damages arising from any accident in the work area which
may cause death or bodily injury to any worker or loss to damage to property due to the fault or
negligence of contractor’s workers while on duty specifically within the amount of Social Security
System Coverage and remaining pay of the affected negligent employee. Thus, any advance payment
or disbursement given by the COMPANY will be considered goodwill and charity.

(d) VENUE OF ACTIONS

In case of any lawsuit that may arise from this agreement, both parties agree that venue of action
shall exclusively take place at Cainta Rizal, Philippines.

ANNEX A:

DUTIES AND RESPONSIBILITIES OF CONTRACTUAL EMPLOYEE

 Ensure consistent customer assistance and satisfaction in every customer touch point assigned to staff to
provide excellent customer service experience.

 Provide assistance in upgrading the sales experience of the customer which include but is not limited to
suggestive selling, upselling and product presentation while customer is waiting to order in line.

 Perform duties and responsibilities of a service crew, cashier, kitchen staff and/or certain administrative
duties from time to time to ensure high level of customer services for both internal and external customers.

 Provide fast and efficient customer objections and complaints assistance and avoid inconvenience of
customers and store operations.

 Provide information campaign for latest promos, products and services.

 Comply with safety, sanitation and company policies provided for the store.

 Attend to any other instruction/tasks provided by the supervisor/coordinator in the upkeep of the company’s
interest and not contrary to laws.

 Ensure good hygienic practices for food safety to avoid spread and cross-contamination of Covid-19 in food
operations.

 Strengthen hygiene and sanitation practices including public health measures inside the work area.

 Attend to any other instructions/tasks provided.
