NOTICE

Sirs/Mesdames:

Please take notice that the Court, First Division, issued a


Resolution dated September 29, 2021 which reads as follows:

"G.R. No. 254350 (Gregorio Tocmo !pong v. People of the


Philippines); and G.R. No. 254444 (Dennis L. Cunanan v. People of
the Philippines). - On July 14, 2021, the Court granted petitioner
Dennis L. Cunanan's (Cunanan) Motion for Leave to Travel to the
United States of America (USA) from June 29 to July 20, 2021, but
required him to submit anew his detailed flight and travel itinerary
considering that the original date of departure had already lapsed. On
July 28, 2021, Cunanan filed a Manifestation of Compliance
proposing a revised travel itinerary to the USA departing on October
7, 2021, and returning on November 5, 2021. In addition, he deposited
P300,000.00 with the Court for his travel bond, appointed Atty. Je
Froilan M. Clerigo as his personal agent, with authority to act for and
on his behalf for the duration of his absence from the country, and
asserted his willingness to submit a written notice of his return to the ·
Clerk of Court within 24 hours from his arrival in the Philippines.
Cunanan also prays that the hold departure order issued by the
Sandiganbayan be lifted to allow him to depart from the Philippines in
accordance with his proposed travel. 1

Meantime, petitioner Gregorio T. Ipong moved to withdraw his


Petition in G.R. No. 254350 because an appeal was already perfected
on December 1, 2020, docketed as G.R. No. 255222. 2

Considering that we have previously granted the Motion to


Travel,3 and in the interest of justice, we approve Cunanan's revised
travel itinerary from October 7, 2021 to November 5, 2021. 4 The hold

departure order issued by the Sandiganbayan is lifted and the Bureau


of Immigration is directed to implement the same.

FOR THESE REASONS, the manifestation is APPROVED.


Petitioner Dennis L. Cunanan is allowed to travel to the United States
of America from October 7, 2021 to November 5, 2021 . The hold
departure order issued by the Sandiganbayan against petitioner
Cunanan is lifted, in accordance with the approved travel itinerary,
and the Bureau of Immigration is directed to implement the same.

Further, the motion to withdraw of petitioner Gregorio T. I pong


in G.R. No. 254350 is GRANTED. The case in G.R. No. 254350 is
CLOSED and TERMINATED.
