Nashville, TN 37243 Jonathon Burr Paul Schmierbach Knoxville Field Office 3711 Middlebrook Pike Knoxville, TN 37921 To Whom It May Concern: On July 10, 2011, United Mountain Defense volunteers William Wilson, Grant Mincy, and Kerry Brown visited several natural gas wells, an abandoned site, and the Lake City Compressor Station. We visited these sites in early April 2011 and filed formal complaints based on the violations we found then. The only formal acknowledgment of these complaints was a letter from TDEC Commissioner Martineau acknowledging receipt of the complaint but with no specific answers to our complaints. Based on todays visit, it seems that TDECs enforcement has been inadequate at best. This is a formal citizen's complaint, filed under Tennessee Code Annotated 69-3-118 (a). While we did not see direct impacts to the waters of the state, there is adequate reason to believe that severe erosion in a mountainous area will have impacts on water quality. Following are the permit numbers of the sites we visited with descriptions of the violations we saw: 11715 damaged liner, no sign on pump jack, some erosion on the hillside, and an open pit devoid of vegetation. These violations were all evident and reported at the time of our last visit in April. Large, abandoned, unreclaimed area at 36 12 6.82 84 11 59.75: No well visible, empty box labeled Confidence C 60 PBB visible, lots of garbage. Eroded, unseeded hillside. 11849 We saw an open, rusty tank, with fluid inside. Strong gas smell, damaged liner. There were 3 wells, only one had a sign with permit number. Pump jack with no sign. It appears that some effort had been made to control the erosion we previously reported at this site but the hillside was still poorly seeded. The open tank and a leaky gas valve were reported at the time of our last visit, as was the tank jack with no permit sign.

11708 - severe erosion, with several channels and inadequate erosion controls present. The hillside was badly eroded and the ground was unseeded. These violations were all evident at the time of our last visit in April. There appears to have been minimal and inadequate efforts to address the problems. 11712 eroded hillside, evidence of a fire or chemical spill, and some oil on ground. These violations were all evident at the time of our last visit in April, there appears to have been no effort to clean up. Lake City Compressor Station: We found that the drainage ditch leading from the tower inside the fence, which we reported on April 11th, was still there and appeared to have seen recent use. This ditch runs directly into the woods. Is there an NPDES permit for this facility? The Lake City Compressor Station also has several combustion engines running constantly, with dirty exhaust clearly visible. Is there a clean air permit for this site?
