The judgment was pro-
nounced by Justice J.B.
Pardiwala directing the
accused should be tried as
an adult.
The apex court's judg-
ment came on an appeal
filed by the Union Territory
of Jammu and Kashmir chal-
lenging the orders passed by
CJM and the high court.
The court noted that the
medical expert's estimate
regarding the age of the
accused is not a statutory sub-
stitute for proof and it is
only an opinion.
The detailed judgment

was arrested in the brutal gang

Pet dog bites child in society's
lift in Noida: A school child was
bitten by a dog inside a hous-
ing society elevator in Uttar
Pradesh's Greater Noida. This is
the second incident in about
two months of a dog biting a
child in the lift in Uttar
Pradesh's national capital
region. A schoolboy was bitten
by a dog inside a housing soci-
ety elevator in Ghaziabad in
September. The latest incident
was captured by closed-circuit
television (CCTV) camera
installed inside the elevator. It
happened in the lift of La Resi-
dentia Society's tower seven
which falls under the jurisdic-
tion of Bisrakh police station.
The incident occurred when
the child was in the lift for
going to this school. The dog
bit on his hand. As a result, he
sustained injuries and was
administered four injections.
The residents of the society
are scared a lot after the dog
bite incident. The child's moth-
er said that pet dogs should
not be brought near small chil-
dren to avoid recurrence of
such incidents in future. Stray
dogs should not be allowed to
enter into societies, she added.

a proposal for creation of the
post of director (investiga-
tion) to help the anti-graft
body's investigation require-
ments, officials said on
Wednesday.
“The Lokayukta in Delhi
crippled severely ever since its
inception due to lack of some-
thing as critical as a Director
(Investigation) and support
staff as basic as Assistants
and Peons, which will soon find
teeth for the discharge of its
functions and responsibilities,”
sources said.
The body is mandated to
look into complaints of cor-
ruption by public functionaries
without an investigation in-
charge.

Observing that nobody should
stop feeding stray dogs as
canines may become aggres-
sive, the Supreme Court, in
an interim order on Wednes-
day, stayed certain observa-
tions of the Bombay High
Court in which it was said that
who are interested in feed-
ing stray dogs to "formally
adopt" them and directed that
no nuisance must be creat-
ed by people while feeding
them.
A bench of justices San-
jiv Khanna and JK Mahesh-
wari sought a response from
Nagpur Municipal Corpo-
ration (NMC) and Animal
Welfare Board on a plea
against the Bombay High
Court order over guidelines
on stray dog feedings. The
court stayed the certain obser-
vation of the Bombay High
Court related to persons
interested in feeding dogs hav-
ing to adopt them till the
next date of hearing.

In an interim order, the
court directed the Nagpur
Municipal Corporation to
ensure and take steps for the
general public to feed the
street dogs at the appropri-
ate locations identified and
demarcated by them.
The court also asked the
general public to ensure that
no public nuisance is caused
by feeding stray dogs. The
court asked the concerned
municipal corporation to
note down details and names
if any feeders who are creat-

ing of stray dogs.
The petitioner has chal-
lenged the Bombay High
Court order which issued a
slew of directions and direct-
ed the civic officials and the
police to take "stern action"
against anyone obstructing
them from acting against the
menace of stray dogs.

university registrar stating that
the banner has been

has sent a letter to Rahul
Gandhi expressing his will-
ingness to resign as state

a figment of the media's
imagination, Sudhakaran
said in a statement.
For the past many days the
media in Kerala has been
spreading false news against
him, he said."It is suspected
that some media outlets have
an ulterior motive behind
reporting such news without
any verification," Sudhakaran
said.
“I have a sense of organi-
zation that if I need to write
such a letter, it should be to
Congress president Mallikar-
juna Kharge. But the media
gave the news in such a way
that the letter was sent to
Rahul Gandhi,” Sudhakaran
said and added that from this
itself, everyone with common
sense will understand the
ulterior motive behind it.
“ Such a news is the
brainchild of those who want
the downfall of Congress and
UDF. The intention behind
such news is to create con-
fusion among Congress and
UDF workers and take advan-
tage,” he said
Sudhakaran also said that
party workers should be care-
ful not to fall into such a
trap.

dren's Day speech on
Wednesday, which had kicked
up a controversy, Sudhakaran
said most of the hour-long
speech was devoted to stress-

on the tracks is inevitable.

that steps are being taken to
prevent accidents with cattle.

Shah on Wednesday sound-
ed confident when he said that
he had come to the state with
its next chief minister.
"Today with me is the next
Chief Minister of Gujarat after
the election," Amit Shah said
while addressing a public
gathering in Gujarat's Ahmed-
abad along with its Chief
Minister Bhupendra Patel.
Shah confidently exuded that
he was accompanied by the
next CM during the public
address made hours before the
latter was scheduled to file his
nomination for the upcom-
ing Gujarat Assembly elections.
Earlier on Tuesday, Union
Home Minister expressed his
trust in the BJP forming gov-
ernment in the Assembly
elections slated to be held in
two phases in early Decem-
ber and said that the party will
"break all records and win with
the most number of seats".
Shah, during his conver-
sation with media persons on
Tuesday, hailed the leadership
of Prime Minister Narendra
Modi and Chief Minister Bhu-
pendra Patel and said that they
are giving pace to the devel-
opmental work in the state.
The Home Minister also
mentioned the law and order
situation and said that it has
improved in the state.
"The leadership of PM
Modi and CM Patel is giving
pace to development work.
Gujarat's law and order situ-
ation has improved, state's
economy has grown. PM
Modi's development model
for Dalits, tribals and OBC com-
munity of Gujarat is being fol-
lowed by CM Patel," he said
on November 15.
Shah in his address also
mentioned the communal
riots in the state from 1985 to
1995 and said that today's gen-
eration in Gujrat "might not
know the meaning of cur-
few".
"This is the same Gujarat
which saw a lot of communal
riots from 1985 to 1995. And
now, even if you ask a small
kid about curfew, he might not
know its meaning," Shah said.
He further attacked Con-
gress for coming with "new
clothes" and asked how their
work was visible in Gujarat
when they have not worked
in the state since 1990.
"Congress has come wear-
ing new clothes, I have seen
posters all over Gujarat, stat-
ing 'Congress nu Kam bole
chhe' (Congress' work is
speaking). If they have not
ruled since 1990, how is their
work speaking?" Shah mocked.
Evidently, Congress is hop-
ing to put its best electoral foot
forward to unseat the BJP
government, which has been
in the state for the last 27 years.
Gujarat is considered a BJP bas-
tion.
On Monday, the BJP
released its fourth list of can-
didates, where it announced
12 names including two
women candidates.
Earlier, the party released
the names of 167 candidates
for Gujarat polls and fielded
Lavingji Thakor from Rad-
hanpur while VJ Jhala has
been been given the ticket from
Himatnagar. Alpesh Thakor
has been fielded from Gand-
hinagar South.
The party has also fielded
Rajulben Desai and Ritaben
Patel from Patan and Gand-
hinagar North respectively.
Further, Babu Singh Jadhav
will contest from Vatva.
In its second list of six
candidates, which was released
on Saturday, the BJP had also
given the ticket to at least
two women.
It has fielded Mahen-
drabhai Padaliya from Dho-
raji, Mulubhai Bera from
Khambhalia, Dheliben
Maldebhai Odedara from
Kutiyana, Sejal Rajiv Kumar
Pandya from Bhavnagar East,
Hitesh Devji Vasava from
Dediapada (ST) and Sandeep
Desai from Choryasi.
The BJP announced the first
list of candidates for 160 can-
didates out of the 182 con-
stituencies, on Thursday, for
the upcoming Gujarat Assem-
bly elections.
The first list of 160 candi-
dates includes 14 females, 13
from scheduled caste, 24 from
the scheduled tribe and there
are 69 candidates who have
been repeated.
In the first round, 89 of the
total 182 Assembly seats will
go to polls and prominent
political parties have declared
their candidates for almost all
these constituencies.
The BJP has drawn up a list
of star campaigners for the
upcoming Gujarat Assembly
elections. Topping the list is
Prime Minister Narendra
Modi besides the party's
national president JP Nadda,
Union Home Minister Amit
Shah, Defence Minister Raj-
nath Singh, Union Road Trans-
port and Highways Minister
Nitin Gadkari and fellow cen-
tral cabinet colleagues Smri-
ti Irani, Dharmendra Pradhan,
Mansukh Mandaviya and
Purushottam Rupala. Chief
Minister Bhupendra Patel,
who is seeking a fresh man-
date from the Ghatlodia
Assembly segment, also fea-
tures in the star campaigners
list along with BJP state pres-
ident CR Patil and state Home
Minister Harsh Sanghvi.
The ruling party is seeking
its seventh, straight term in
power in the ensuing state
polls.
The state has been a BJP
stronghold for a long time, and
the party has set its sights on
returning to power with a
handsome majority this time.
However, it faces a stiff elec-
toral challenge from the Arvind
Kejriwal-led Aam Aadmi Party
(AAP), which has named Isu-
dan Gadhvi as its chief min-
isterial candidate.

Nagaland Chief Minister
Neiphiu Rio on Wednesday said
that even if the Central gov-
ernment and the Naga Politi-
cal Groups (NPGs) signed a final
peace accord or settlement,
there will be no real peace if the
Nagas cannot act as one peo-
ple.
The Chief Minister said
that forgiveness and reconcil-
iation at various levels of Naga
society are the prerequisite
for a peaceful resolution of
the Naga political issue.
Addressing the 75th anniver-
sary celebration of Peren Town-
ship at Peren Town, the Chief
Minister stated that if people
cannot forgive each other and
rise above narrow tribalism, and
if people cannot unite and act
as one people, there would not
be real peace in Nagaland. Rio
said Peren district has good
prospects to become a pros-
perous and self-reliant dis-
trict since it is near the state cap-
ital and the commercial cap-
ital Dimapur.
After over 80 rounds of talks
between the Centre and the
Naga groups, dominated by the
National Socialist Council of
Nagalim (Isak-Muivah), there
is still a stalemate over the
contentious issues of a sepa-
rate Naga flag and constitution.
The NSCN-IM has been
demanding a separate flag
and constitution, which the for-
mer government interlocutor
and then Nagaland Governor
R.N. Ravi had rejected on a
number of occasions.
Meanwhile, former chief
minister and chairman of the
ruling United Democratic
Alliance (UDA) T.R. Zeliang, said
that Peren Town was established
on April 1, 1947, and has since
grown gradually with time.
He urged the people not to for-
get the Peren villagers who
generously donated their land
for the town for the welfare of
the Zeliang community.
He said the 'Mithun' (state
animal of Nagaland and
Arunachal Pradesh) and the
human figurines seen there
today are a recreation of the
event that took place on April
1, 1947, when the inauguration
and declaration function was
held by the sacred act of slaugh-
tering a Mithun and partaking
its meat by all the representa-
tives of 25 villages. Zeliang
said that only 5 human figurines
are standing today but they aim
to put up a total of 25 human
figurines, to signify the 25
ancestral villages, which will be
unique and one of a kind in
Nagaland.
With a population of little
over 10,000, the town is not as
big as other towns in the state.
It is home to many other tribes
who have settled here and
accepted Peren as their own and
live harmoniously with the
locals, he said.

teenager, who fell off the
fourth floor of an apartment
in Lucknow under mysteri-
ous circumstances, is now
turning into a case of love jihad.
Even as the alleged accused
in the case, Sufiyan, is abscond-
ing, the victim's family has
alleged that he was pres-
surising her to convert and
marry him.
The case registered in the
matter now includes provi-
sion of the religious conver-
sion act.
According to reports, the
two families knew each other
and their children were also
friendly.
"We thought that the fam-
ilies would resolve the mat-
ter between themselves. When
the incident took place, we had
no inkling because both the
children seemed calm and
were talking normally," the
victim's family told the police.
The police said that Sufiyan
even accompanied the girl's
family to the hospital where
she was taken after she fell
down.

Netanyahu's return
I sraeli President Isaac Herzog announced last week
that he is assigning the task of forming a new gov-
ernment to former Prime Minister Benjamin Net-
anyahu following consultations with leaders of all po-
litical parties elected to Parliament in the 1 November
election. Mr Netanyahu, a polarising figure at the best
of times, has since lost no time in announcing he will
be a “Prime Minister for all” and begun hectic negoti-
ations with allies of his party (Likud) to fill up Cabinet
posts. The return of Mr Netanyahu as Prime Minister
~ he has now emerged the winner in a record five
general elections, more than any other politician in
Israel’s history ~ is likely to end the political impasse
in the country, but it also signals a resurgence of the
political-religious right as exemplified by the ultra-
nationalist leader Mr Itamar Ben-Gvir, once convict-
ed of racism, emerging as kingmaker. The establish-
ment left-wing party Meretz, will have no presence in
the Knesset (parliament) for the time since 1992. Of
the 120 seats in parliament, the centre-right Likud
won 32 while outgoing Prime Minister Yair Lapid's
Yesh Atid came in second with 24 seats. But, Likud's
coalition partner Religious Zionism, headed by Mr
Ben-Gvir and his colleague Mr Bezalel Smotrich, won
14 seats. It more than doubled its tally on the back of
a hard-line Zionist message articulated aggressively
by the gun-toting Mr Ben-Gvir. Mr Netanyahu's other
coalition partners, the ultra-Orthodox party United
Torah Judaism and the religious Sephardi party Shas,
are community-based political organisations inter-
ested primarily in controlling the Jewish religious
establishment. In such a scenario, for all Mr
Netanyahu’s efforts to portray his agenda as inclu-
sive and his iteration that Likud will not be under
pressure from the extremist parties he is in bed with,
the influence of the religious right on policy is likely to
be substantive. Religious Zionism in power, a com-
mentator notes, means vast negative implications for
the LGBTQ community, secular citizens, and Pales-
tinians. The concern is that Mr Ben-Gvir, once dis-
missed as a “fringe element” by the traditional centre-
right, is now increasingly considered mainstream. He
is a Kahanist, a disciple of Meir Kahane, a rabbi who
wanted to strip Arab Israelis of citizenship. Mr Ben-
Gvir and Mr Smotrich are proponents of the settler
movement and their presence in government could
mean the expansion of Jewish settlements in the West
Bank. Religious Zionism’s policy of zero tolerance on
law-and-order has in recent times translated into its
leaders urging police to fire on unarmed stone-throw-
ing Palestinian protestors. The party’s demand for
the interior ministry is considered essential for it to
further its agenda of doubling down on keeping Israel
a Jewish state with any move towards secularisation
of society and the expansion of rights for gender and
religious minorities to be resisted at all costs. Israel’s
staunchest ally, USA, has made its displeasure clear
about the likes of Mr Ben-Gvir. “Look at his history,
his actions, his statements… This is not someone we
want to see as part of the government,” a US official
said. Mr Netanyahu, who has enjoyed a close rela-
tionship with successive US administrations, will
need to perform the balancing act of his career if he
wants to stay Prime Minister without drawing global
condemnation and ire.
Trump 2.0
T
he announcement this week by Donald Trump
that he plans to contest the American
presidential election in 2024 should not come as
a surprise. The former President has thrown his hat
into the ring before the message from the mid-terms
~ which appears to be an indictment of his style of
politics ~ sinks in with members of his Republican
party and ensures that whoever chooses to challenge
him will have to play catch-up. The mid-term elec-
tions showed a surprisingly strong showing by the
Democrats; certainly, there was no red wave as Mr
Trump’s supporters had forecast. Additionally, Mr
Trump would have found it galling that Republicans
who do not share his extreme views fared well while
some of his camp followers perished. The results also
saw traditional supporters of the former President in
the American media projecting Florida Governor Ron
DeSantis ~ derisively called DeSanctimonious by Mr
Trump ~ as the best bet for the Republicans in 2024.
Mr Trump would likely also have been stung by the
rebuke of his former Vice-President, Mike Pence, who
told journalists “I think we’ll have better choices”,
when asked about the candidature. While the two
had a bitter falling out in the days leading up to the
Capitol riot, and Mr Trump appeared then to defend
those of his supporters who shouted, “Hang Mike
Pence”, the former Vice-President had so far avoided
direct criticism of his former boss. Now, Mr Pence,
who may well also be a contender for the Republi-
can nomination in 2024, appears to have shed his ret-
icence. At a promotion of his book in New York on
Tuesday, he said: “In the weeks before Jan 6, I repeat-
edly told the president that I did not have the author-
ity to reject or return electoral votes. It was clear he
was getting different legal advice from an outside
group of lawyers that, frankly, should have never been
let in the building.” Mr Trump draws his most vocif-
erous support from the Republican fringe. During the
years of his Presidency, he was able to effectively
shout out party colleagues who preferred a more
sober approach to politics. But traditional Republi-
cans must have sensed from the results of the mid-
terms that the tide is turning. They can be expected to
rally around a less divisive candidate than Mr Trump,
should one choose to join the race. While Mr DeSan-
tis and Mr Pence are possibilities, there are others
who might fancy their chances. They include Texas
Governor Greg Abbott, who shares many of Mr
Trump’s extreme views; Liz Cheney, daughter of for-
mer Vice-President Dick Cheney, who will hope to
leverage the support of the military-industrial com-
plex that saw her father as a benefactor, and former
US Ambassador to the United Nations, Nikki Haley.
In any event, Mr Trump will have a fight on his hands
to secure his party’s nomination.
Empowered Women
India has set a stellar example of reserved quotas for women in local governance for
a country that has a poor record of its overall commitment to women‘s rights. It is an
example of how a country can successfully empower women, politically, economically,
and socially

ndia is far from perfect in en-
suring women’s rights, but
quotas at the local govern-
ment level are making a real
impact. Development experts are
discovering that societies and
cultures that invest in and emp-
ower women are on a virtuous
cycle. They become more afflu-
ent, better governed, stable, and
less prone to violence. By contra-
st, countries that limit women’s
educational and employment
opportunities and their political
voices get stuck in a downward
spiral. They are poorer, more
fragile, and have higher levels of
corruption.
In the last two decades, the
gender landscape in rural India
has been slowly greening, and
women are now on the cusp of a
powerful social and political rev-
olution. The harbinger of this
change is a unique policy experi-
ment in village-level governance
that has brought transformative
results for the weakest of the
weak and the poorest of the poor:
the village women. In 1993, India
introduced the Panchayati Raj
Act, mandating a three-tiered
structure of local governance at
the village, block, and district lev-
els with reservation of one-third
of all posts in Gram Panchayats
(village councils) at the bottom
tier of India’s decentralised gov-
ernance system, for women. The
vision was that these women-
headed councils would bring
greater transparency and better
governance to their villages. It
revitalised an age-old method of
rural local government whose
name “panchayat” is drawn from
Sanskrit, meaning the council of
five wise men.
This new law was a step tow-
ards the fruition of Mahatma
Gandhi’s dreams of village-level
self-governance with gender jus-
tice as a critical pillar. Gandhi be-
lieved that if implemented cor-
rectly the Panchayati Raj system
would alleviate alienation of the
common people from governan-
ce and preclude the external in-
tervention of higher-level civic
officials, who might not be famil-
iar with the concerns of local
people. Earlier politics was consi-
dered a foul word, and women
were expected to keep a hygienic
distance from it. However, devel-
opment scientists and social
activists now acknowledge that
the modern development para-
digm has political salience and
that politics underpins all facets
of development.
Politics is the firing engine
for all the cylinders of developm-
ent. It is true that political power
needs to be sanitised and has to
be reinforced with ethical under-
pinnings to make it more benev-
olent. This can come about only
when more educated and devel-
opment-oriented individuals em-
brace politics as a critical arena
for innovation and change. Poli-
tics is the fulcrum of governance,
and unless the quality of politi-
cal timber is improved, govern-
ance will continue to limp.
Experience of this social and
political experiment has shown
that women are not just equal to
the task but also orientate pub-
lic-good provision more towards
the preferences of their gender,
namely more water, healthcare,
and roads. Though less politically
savvy and often only semi-illiter-
ate, these women had an advan-
tage in being actively mentored
by trainers who are building the
district bureaucracy. Several
NGOs also designed programmes
to skill them in governance.

Like all countries, Viet Nam is still
grappling with the far-reaching socio-
economic impacts of the Covid-19
pandemic, and there have been signif-
icant impacts on almost all aspects of
children’s lives. UNICEF's Executive

about the current challenges facing
children and what can be done to bet-
ter protect them.
The pandemic has been challeng-
ing for children everywhere in the
world, and it's been a couple of things.
One, we've seen children be set back
in terms of their routine immunisa-
tions which is very concerning
because we've made progress on rou-
tine immunisations over the years.
And then to see that progress
stopped has been very challenging. So
we're trying to catch up on that.
Second, we've seen many, and
this is a global issue, plunged into
poverty because of Covid. And that is
challenging. People were unable to
work. It's been very difficult. And of
course, for children, it means that their
schooling was disrupted.
And that's something that is of
great concern to every country. Every
country is struggling to get that learn-
ing back because we've seen a real rise
in the number of children who are,
even at the age of 10, unable to read.
Just read a simple sentence, do simple
math.
So that is of great concern certain-
ly to UNICEF, but to countries as well,
because children are the future of their
countries. If they're not educated, if
they're not healthy, that is really dam-
aging for the country as well.
So, Covid has been challenging.
The one upside I would say of Covid
here in Viet Nam is that the response
was very effective and so many people
were immunised. And I think that
demonstrates that the government
here is able to do big things, to do
important things.
So we're looking to the govern-
ment to do a similar sort of thing in
helping children who have been left
behind.
I think what the government, and
this is the case with all governments,
they have to make sure that their
efforts at development, at progress,
don't exclude anybody. We talk a lot
about inclusion. Every child needs to
be included and I think when you have
ethnic minorities, that can be a diffi-
cult situation where they can be in
rural settings. The government has to
affirmatively make sure that these
people have the resources they need
to survive, that their children are nour-
ished so that they don’t suffer from
stunting. They don't suffer from severe
acute malnutrition, which as I said, for
anyone who hasn't seen, I would
encourage you to go to the Central
Highlands and see it. It will break your
heart. And I literally had a sleepless
night last night because I was so heart-
broken by what I saw with those fami-
lies and those children. And I think
that the government here can do the
work and UNICEF will be a good part-
ner in every step. One of the biggest
challenges at the moment is climate
change, especially in areas like the
Mekong Delta. How does that threat
impact children?

Making a reality of
the G-20 theme

I
ndia has selected the theme of
‘One Earth, One Family, One
Future’ (Vasudhaiva Kutum-
bakam) as the theme for the G-20
for next year, the year of India’s presi-
dency of this important group of
nations which account for 85 per cent
of the world’s GDP, 75 per cent of
trade and 66 per cent of its popula-
tion.
Without any doubt, this is a very
noble theme, particularly when seen
in the context of the most serious
problems the world faces today.
The concept of one earth has
been most often discussed in the con-
text of the very serious environmen-
tal crisis. While climate change has
become the most debated issue, more
so now due to COP 27, the reality is
that there are about a dozen or so
closely inter-related environmental
problems which have the potential to
endanger life-nurturing conditions of
our planet. These come with tipping
points in the sense that if unchecked,
some of these can spiral out of con-
trol. This is a question of only a very
few decades now, so time is really
running out.
In this context the concept of one
earth informs and reminds us that
there is only one planet which is
inhabited by people of all nations, eth-
nicities, and faiths; we all will be
endangered badly if its life-nurturing
capacity begins to be disrupted. It is
thus the common responsibility of all
people to take urgent steps to avert
such a catastrophic situation. Howev-
er, those who are most responsible for
creating this dangerous situation, and
who co-incidentally are the richest
today in terms of resources, must
share the most responsibility and
must contribute the most for this.

he US midterm election
results show a recurring motif
– a split ballot, where voters
have chosen candidates from
both the Democratic and the Republi-
can parties, instead of voting for all
candidates up and down the ballot
belonging to the same party. This
practice creates an apparent shift
towards moderation, and it showed
up in many states this election. For
example, we can analyse two crucial
swing states: Georgia and Pennsylva-
nia. In Georgia, Donald Trump's
acolyte and MAGA extremist Herschel
Walker lagged behind moderate
Democrat Raphael Warnock, the
incumbent senator. They will face
each other in a run-off election on
December 6. A significant contrast to
Walker is Republican Brian Kemp, the
incumbent governor, who won his re-
election by a margin of approximately
eight percentage points. Governor
Kemp courageously fended off
extreme pressure from the then Presi-
dent Trump, who wanted him to
manipulate Georgia's 2020 presiden-
tial election results in his favour. Many
2022 midterm voters from Georgia
split their ballots,rewarding Kemp and
punishing Walker in a predominantly
Republican state that has looked more
like a swing state in recent election
cycles.
A similar pattern appeared in
Pennsylvania. Doug Mastriano, who
joined the January 6 rioters at Capitol
Hill, believes that Joe Biden is not a
legitimately elected president. Mastri-
ano is an ultra-right-wing MAGA
devotee of Trump. Moderate Democ-

remind the eminent representatives
of G-20 countries and regions of the
most important real challenges and
responsibilities our deeply troubled
world faces at this critical juncture of
its history. However, it is important to
go beyond such a minimal role of this
theme. In fact, this theme can be the
focal point around which several
important initiatives relating to envi-
ronment protection, equality and jus-
tice, peace and disarmament can be
initiated by G-20 in the near future.
This more active pursuit of the noble
theme of ‘one earth, one family, one
future’ is what will be looked forward
to with more hope in the coming
days.

The policy stances of many
Republican candidates in competitive
states showed significant deviations
between the primaries and the gener-
al election. One stark example is
Republican JD Vance of Ohio, who
drastically moderated his extreme
position against abortion rights when
he started campaigning against mod-
erate Democrat Tim Ryan. Vance won
the Senate seat from Ohio. This same
softening transformation was adopt-
ed by several other Republican candi-
dates even in Republican-dominated
states where abortion rights appeared
on the ballot. (Five states – California,
Kentucky, Michigan, Montana, and
Vermont – had this issue on the ballot,
and voters generally were supportive
of abortion rights.) The midterm
seems to have ushered in the rain of
hope after six years of extreme
rhetoric, political violence, insurrec-
tion, and racist demagoguery – all
fuelled by a narcissistic and semi-fas-
cist cult-personality. As the midterm
results came in, I remembered "What
the Thunder Said," Part V of TS Eliot's
poem "The Waste Land." He alluded
to the Upanishad's "Datta, Dayad-
hvam, Damyata," meaning welfare,
self-control, and compassion. May
Medicare, Medicaid, and Social Secu-
rity be spared from the chopping
block as Datta (welfare). May gun vio-
lence, school massacres, and hate
crimes subside as Dayadhvam (self-
control). And may reasonable abor-
tion rights be restored as Damyata

HEAVY RAIN IN
MADRAS

Madras was visited during the early hours
this morning with an extraordinary storm
or cloud-burst, nearly ten inches of rain
falling in a very short period. There was
little wind but thunder and lightning was
continuous throughout the night and
sheets of rain inundated the whole of the
city. A stable in Sullivan's Gardens was
struck by lightning and a house in George-
town collapsed, but fortunately there was
no loss of life. The tramway service was
held up, floods near the power station pre-
venting cars coming out. The suburban
line of the South Indian Railway for a dis-
tance of about half-a-mile was submerged
and the permanent-way washed away.
The permanent-way staff are repairing the
line and expect to set things right in the
course of the afternoon.

are to become established institutions, will

ter. They will give a synopsis of the day's

cies working together. The times of trans-
mission will be carefully fixed, in order
that wireless services shall not encroach
upon the province of the morning and
evening newspapers.

The Narsapur correspondent of the Hindu
says it appears a young man of 25
appeared at Palacoe with a rifle in hand
and a number of cartridges in his pocket
with the intention of killing some mer-
chants. He first shot at a man in the street,
but only grazed his temple. He then went
to a rice mill, where he killed one of the
proprietors. While returning, a coolie tried
to catch him but was fired at. He then
asked a jutka man to take him to Bhi-
mavaram, but when he refused, shot and
killed him. He was chased by the police
and in the ensuing fight, some shots hit
passerby. A sub-inspector eventually
brought the man down with a revolver
shot in the leg, but the ruffian, thinking
he would be caught, killed himself.

ing Representative Andy
Biggs, a leading member of
the Republican party's Free-
dom Caucus, a group of ultra-
conservatives.McCarthy will
be officially elected speaker
in a vote on the floor of the
House on January 3. He will
need 218 votes in the 435-
member chamber to make it
through. The Republicans
are still one vote shy of the
majority number - they were
at 217 to 204 of the Democ-
ers, stating: “You guys are
always messing with me.”

shakedown flight, the rock-

EU to train up to
15k Ukrainian
soldiers

The Council of the Euro-
pean Union (EU) has
announced the launch of a
special military mission to
support Ukraine in the ongo-
ing war with Russia.
The European Union Mil-
itary Assistance Mission
(EUMAM) has a non-exec-
utive mandate to provide
training to up to 15,000
Ukrainian army personnel in
multiple locations among
EU member states, Xinhua
news agency quoted the
Council as saying.
It also announced it has
adopted a 16 million euro
assistance measure under
the European Peace Facili-
ty (EPF) to support capaci-
ty building for the Ukrainian
Armed Forces, Xinhua news
agency reported.
This assistance measure
will last for 24 months. IANS

These observations of the Bombay
High Court in a case about domestic
violence have not only shocked femi-
nists but even others who believe in
gender justice. The observations do
reflect the widespread patriarchy in
our society andof course judges not
being angels but part and parcel of
our society are as patriarchal as most
of us. These observations have once
again revived the debate about
household work and its non-recogni-
tion as productive work. Is it not
shameful that while we glorify our
women as Goddesses we deny them
equal rights and dignity? Is she still a
slavewhose only right is to sincerely
discharge her duties as housewife
and take the full load of domestic
work? What is the history of recogni-
tion of wives’ work as work in the
West? What have been the legislative
initiatives and judicial responses in
this regard?

dependence

multilateral
institutions
impact
sovereignty,

owards the end of World War
II, the idea of ‘decolonisation’
with its attendant images of
freedom fighters, ouster of
the English colonisers and creation of
independent nation states had
echoed throughout the British
Empire. More than half a century
later, the word ‘decolonisation’ is
resounding once again. This time
however, it is being raised by disgrun-
tled minorities within the UK seeking
representation and justice from their
own governments.
The modern-day call for
decolonisation first emerged at a
2011 conference in Malaysia in which
scholars expressed a desire to devel-
op non-Eurocentric paradigms. In a
few years, it was raised again as part
of the ‘Rhodes Must Fall’ campaign
launched at the University of Cape
Town. By 2015 this campaign had
reached the University of Oxford and
its underlying theme of inclusivity
and representation was picked up by
the National Union of Students who
started questioning why their cur-
riculum was predominantly white.
In 2019-2020, the decolonisation
movement received an unexpected
boost by the Black Lives Matter
protests that first erupted in the US in
the wake of the successive brutal
murders of several young black per-
sons but were quickly replicated by
marginalised groups in the UK.
It’s a testament to the determina-
tion of the protestors that finally in
2020 Oxford University placed a
plaque next to the statute of Rhodes
acknowledging his colonial legacy
and UK universities stepped up their
efforts to include non-Eurocentric
approaches in all areas of study It is
entirely pertinent to ask what any of
this has to do with Pakistan.
After all, wasn’t Pakistan
decolonised when it was declared an
independent state in 1947? While
Pakistan’s creation as an indepen-
dent country is not disputed, to
understand whether it was truly
decolonised it is important to go
beyond the formal declarations of
independence made in Pakistan’s
constitutive documents, to examine
the extent to which Pakistan’s gov-
erning institutions allow it to exercise
sovereignty in its political and eco-
nomic decisions.
The starting point for under-
standing any country’s core institu-
this theoretical undervaluation of

was shocked to see that the popula-
tion census 2001 that is carried out
under an Act of Parliament and had
categorized those who perform
household duties as non-workers
and clubbed them together with beg-
gars, prostitutes and prisoners i.e.
some 367 million who are not
engaged in economically unproduc-
tive work. As per the 2011 census,
while 159.85 million women stated
household work as their main occu-
pation, a meager 5.79 million men
referred to it as their main occupa-
tion. Justice N.V Ramanna in his
authoritative concurring judgment in
Kirti and Another v. Oriental Insur-
ance Company (2021) referred to
“Time Use in India - 2019 Report of
National Statistical office, Govern-
ment of India” published in Septem-
ber 2020 which states that on an
average while Indian women spend
299 minutes per day on unpaid
household services, men spend just
97 minutes. Women also spend 134
minutes in a day on unpaid house-
hold care giving services.
A French government’s Com-
mission on the Measurement of Eco-
nomic Performance and Social
Progress in 2009 that studied the sit-
uation in Germany, Italy, UK, France,
Finland and USA reached similar
conclusions. A report entitled
‘Women’s Economic Contribution
through their Unpaid Work: A Case
Study of India’ (2009) had estimated
the economic value of services by
women to be to the tune of a whop-
ping $612.8 billion annually. British
economist Arthur Cecil Pigou exactly
tions is its constitution. Pakistan has
had three constitutions since it was
created: the first in 1956, the second
in 1962, and finally the third in 1973
which despite 25 amendments,
remains in force today. In the nine
years that Pakistan deliberated its
first constitution it had the option to
acquire a constitution that was fully
in alignment with Islamic principles,
or one based on the liberal values that
had gained currency in the aftermath
of World War II.
Although Pakistani lawmakers
made some concessions for Islamic
considerations, the core constitution-
al institutions were aligned with
accepted Western norms and liberal
values: for instance, the Constitution
largely replicated the institutional
structure provided in the Govern-
ment of India Act, 1935, adopted the
rights enunciated in the UN Declara-
tion of Human Rights (Articles 8-28),
and the economic values of free trade
(Article 18), and private property
(Article 23-24).
In 1985, Gen Ziaul Haq intro-
duced large-scale amendments to the
Constitution ostensibly to bring it in
line with the injunctions of Islam: the
Objectives Resolution was made a
part of the Constitution, provisions
were introduced to establish the Fed-
eral Shariat Court and the National
Assembly was renamed the Majlis-i-
Shoora. However, these reforms were
optical and semantic and did not
interfere with the country’s core legal
and political institutions which con-
tinued to function as before.
Pakistan’s economic life, as its
governance institutions, also
remained aligned with Western
ideals. Although the world Pakistan
was born into had shifted away from
imperial rule, it was now governed by
multilateral agencies whose aim was
to facilitate economic interdepen-
dence between the old and new
nation states. In a bid to integrate
into the global economy, Pakistan
became a member of the IMF and the
World Bank in 1950 and of the WTO
a century ago had lamented that the
household work by wives is not taken
into consideration in calculating
national income.
As a matter of fact, English com-
mon law of marital status had itself
been hierarchical. Forget about the
recognition of the homemaker’s
work as work, she had no right even
in respect of her work outside home.
In fact, till 1851, no country in the
world had recognized a wife’s right in
earnings of any sort. If a housewife
worked for pay in or out of the home,
it was her husband’s prerogative to
collect her wages.
By the middle of the 19th centu-
ry, some American states started
reforming common law of marital
status by enacting “Married
Women’s Property Acts”. Some of
these statutes exempted wives’ real
property from their husband’s
debts; others codified the
equitable separate
estate, allowing
wives to hold,
though fre-
quently not
to control or
dispose of,
property
acquired
before
or dur-
ing
mar-
riage.
By
1850,
the era
of “earn-
ing
statutes”
started
which grant-
ed wives
property rights
in earnings from
their “separate” or
“personal” labour.
Wives were granted rights
in earnings acquired by “trade,
business, labour or services carried
in 1995. To stimulate foreign invest-
ment Pakistan also signed bilateral
investment treaties with several
countries.
The resultant web of ‘interde-
pendence’ rendered Pakistan depen-
dent on the IMF, World Bank and the
WTO for its economic prescriptions.
In time, Pakistan carried out the first-
generation macroeconomic reforms
by liberalising exchange and interest
rates and the second-generation
microeconomic reforms by establish-
ing a range of authorities such as the
SECP, CCP and Nepra to regulate
activities throughout the country.
Most of these reforms were
agreed in closed-door discussions
between the executive and multilat-
eral agencies and these were often
introduced in the country through
temporary ordinances promulgated
without stakeholder consultations.
While it is tempting to attribute
Pakistan’s independence deficit to its
having aligned its constitutional and
economic institutions with its external
obligations, it is not entirely accurate
to do so. Borrowing laws is a historical
and global reality and it is only right
that Pakistan too should benefit from
the collective wisdom of more evolved
democracies. Where Pakistan is lack-
ing, however, is copying laws whole-
sale, at times to meet the conditionali-
ties imposed by multilateral agencies
on or performed on their sole and
separate account”. But the Census
measures of the economy that
appeared in the aftermath of the
American Civil War characterized
household work as “unproductive”,
and, consistent with this gendered
valuation of family labor, excluded
women engaged in income produc-
ing work in the household from the
count of those “gainfully employed.”
It seems that Indian census referred
above followed this precedent.
Subsequently, women demand-
ed a right to “own ourselves, our
earnings, our genius”. They finally
achieved success when the equal
rights of wives in matrimonial prop-
erty was recognized. The third
National Women’s Liberation con-
ference in England in 1972, for the
first time, explicitly
demanded
payment
of
and at others to signal to the world
that it has the institutional trappings
of a well-functioning modern state.
Ultimately, in imposing laws top-
down rather than enacting these
through bottom-up, participatory and
inclusive institutions, the Pakistani
state has drowned out the voices of
the various groups within the polity.
In doing so, it has not only hardened
rather than healed the divisions that it
had inherited at the time of its cre-
ation but has also recast itself as a
colonial master that pursues its agen-
da without regard to the well-being or
representation of its own people.
At its core, the modern call for
decolonisation, just as the one seen
after World War II, is about redressing
the balance of power between the
centre and the periphery and for the
representation of the marginalised in
decisions that affect their lives and
their destinies.
The Pakistani state not only
needs to correct the power imbalance
externally, but also internally,
through truly democratic institutions
that engage with the people and
include their opinions in legislating
for the realisation of their interests
and aspirations.

property rights of married women is
not new. Mrs. Veena Verma did
introduce a private member Bill in
1994 entitled “The Married Women
(Protection of Rights) Bill, 1994. Her
Bill provided that a married woman
shall be entitled to have an equal

gain traction in

f India is the pharmacy of the
world, it’s not doing a good job
of providing safe products. A
large number of children in the
Gambia have recently died after
ingesting cough syrup made in
India. And in 2019, 11 children in
India’s Jammu region died the same
way. The cough medicine contained
diethylene glycol, an industrial sol-
vent.
Counterfeit and sub-standard
medicines are only one of several
problems India and the rest of the
world face because of the country’s
weak drug regulations.
A pressing problem is an explo-
sion in the consumption of antibi-
otics in India where overuse and
misuse are major contributors to the
development of antibiotic resis-
tance. India has one of the highest
antibiotic resistance rates, estimated
to be growing by 5-10 per cent annu-
ally. About 1.3 million people died in
2019 as a direct result of antibiotic
resistance. Particularly worrying is
the large number of antibiotics being
consumed in the form of fixed-dose
combinations (FDCs). These prod-
ucts comprise two or more drugs in a
fixed ratio of doses and are available
in a single dosage form.
FDCs are effective for some dis-
eases, such as tuberculosis and HIV
treatments. But many antibiotic
FDCs sold in India are of unknown
effectiveness and have not been
approved by India’s central drug
regulator, the Central Drugs
Standard Control Organisation.
Unapproved and potentially
inappropriate FDCs are a peculiar
feature of the Indian landscape. The
companies claim that FDCs are
innovative, that combining different
medicines in one pill is more conve-
nient for patients and ensures com-
pliance.
However, without clinical trials
to show their safety and effective-
ness, the risks and benefits of these
innovative FDCs are unknown. This
unregulated “innovation” is an
immense problem because of its
potential to accelerate antibiotic
resistance.

In Arun Kumar Agrawal v.
National Insurance Company (2010),
the Supreme Court not only
acknowledged contribution of the
housewives as invaluable but
observed that it cannot be computed
in terms of money. Her gratuitous
services rendered with true love and
affection cannot be equated with ser-
vices rendered by others. Similar
observations were recently made in
the Rajendra Singh judgment (2020).
But then these cases dealt with a lim-
ited question of compensation under
Motor Vehicles Act to calculate the
compensation for the death of home-
makers and not the recognition of a
wife’s right in the husband’s income
during the subsistence of marriage.
Assuming labour is the founda-
tion of wealth, the legal system’s role
in appropriating wives’ labor in car-
rying out household work is
indeedakin to robbery. Will the Uni-
form Civil Code panel in Uttarak-
hand and Gujarat suggest inclusion
of prenuptial marriage agreements
that would ensure sharing of house-
hold work by the husbands or alter-
natively a share for wives in hus-
band’s income for carrying out
household work?

The World Health Organization
is so concerned about the problem
that it has classified antibiotics
according to their impact on antibi-
otic resistance and listed antibiotic
FDCs that it advises doctors not to
prescribe.
The Indian government has a
national action plan on antibiotic
resistance and has introduced sever-
al government initiatives to tackle
sales of FDCs that have not been
approved by the central regulator. It
also has a national list of essential
medicines to promote rationalpre-
scribing and prioritise medicines for
use. These initiatives go back
decades. However, the problem of
unapproved and unsafe medicines
persists.
Most medicines consumed in
India are bought in the private sec-
tor. Our latest research into the sales
of antibiotics (those taken orally,
intravenously or in the form of injec-
tion) in the private sector in India in
2020, showed that a third are in the
form of FDCs. We found that these
sales are driven in large part by drugs
the WHO has listed as not recom-
mended and are not on the country’s
essential medicines list. Focusing
prescribing on well-evidenced FDCs,
such as those listed on the essential
medicines list, would strengthen
antibiotic stewardship in India.
We also found that 278 of 395
(about 70 per cent) antibiotic FDC
formulations marketed in India in
2020 had either no record of
approval by the central regulator or
were banned. These findings
demonstrate the need for a radical
overhaul of drug regulation in India.
A big part of the problem is the
complexity of the much-amended
drug laws that date back to 1940 and
split responsibilities between the
federal and state governments.
The centre has the responsibili-
ty for overseeing the safety and
effectiveness of new drugs while the
states grant licences to manufactur-
ers. However, the states have been
granting licences to manufacturers
for FDCs that have not had the nec-
essary prior approval of the central
regulator.
Unless India introduces laws to
ensure that all FDCs are approved
centrally having met the require-
ments of safety and effectiveness,
ensures that unapproved drugs are
taken off the market, and prosecutes
manufacturers who break the law,
the problems of unapproved and
unsafe medicines and growing
antibiotic resistance will not be
solved. Urgent legislation and strict
enforcement of the rules are needed
to ensure that there is global confi-
dence in India’s drug manufactur-
ers.

captain MS Dhoni after the
franchise retained the south-
paw on November 15.
He was retained by the
Chennai Super Kings ahead
of the IPL mini-auction
scheduled on December
23.
The player shared an
image with Dhoni and cap-

The Chennai franchise had
appointed Jadeja as the

Suryakumar Yadav saw a
decline in his rating points,
but nonetheless retained his
top spot in the ICC T20I Play-
er Rankings issued on
Wednesday. After superb
performances in Super 12 of
the ICC T20 World Cup,
Suryakumar Yadav dethroned
Pakistan's Mohammad
Rizwan to become the top bat-
ter. But his rating points
declined from 869 to 859
after a poor 14 against Eng-
land in the semifinal, which
