V. Background Information:

Child’s Functioning

Kurei is the youngest among the three children of Mrs. Nulada. Since his childhood he did
not see his father, sometimes he wants to find him, but he does not know where to start.
Currently, he is living together with his stepfather and step siblings at Brgy. Trapiche Oton,
Iloilo. Kurei, is already 15 years and 6 months old having been born last March 3, 2007. He
stands 5’2 tall and weight 50 kilograms, with slim built and healthy body with fair
complexion, short dark hair.

According to Kurei’s mother, he graduated his daycare at Villa Rica Trapiche Oton, Iloilo,
and his primary school at Senator Francisco Zulueta Elementary School, also in trapiche.
Currently, he is enrolled at Oton National High school and already in grade 10. He goes to
school around 5:00 or 6:00 a.m. as his class normally starts at 7:00 in the morning. When he
comes home, he usually helps in doing some household chores and sometimes help his aunt
Jolly Cantera on fetching water from the well whenever his aunt’s husband is not around.
Kurei, recalls many events in his course of life, where one of which is the moments his
grandmother regularly sends him off to school and picks him up after class.

When he was in Grade 3, he experienced tremendous pain on his lower right quadrant, he
was brought by his mother to a private physician for consultation, and eventually was
referred to be admitted in the hospital due to ruptured appendicitis. On June 2016, he
underwent major operation in his appendectomy at WVMC and eventually was discharged
afterwards.

Kurei, grown up together with his cousins in a community, he loves playing sports especially
basketball. He is not involved in smoking, but as a child he is curios in so many things; such
as drinking alcohol. Kurei, reiterated, that he experienced drinking alcohol which is only
occasional. As reported by him, he was 14 years old when he starts playing cards it only
started as “lingaw-lingaw” in his pass time.

The Child’s Family

The family lives in their own house and lot at Barangay Trapiche Sitio Tuburan., Oton,
Iloilo. It is made of concrete materials and a mix of light materials such as bamboo and
plywood. Everything in the house is organized neatly.
Kurei’s mother Mrs. Nulada was born and raised in the municipality of Oton, Iloilo, she was
18 years old when she decided to have a relationship. After she graduated from high school,
she already started a job as Sales Clerk/Cashier/Promodizer at Gaisano City, Lapaz. She was
20 years old when she decided to work in Manila as baby sitter and house helper knowingly
that she is pregnant at that time. Mrs. Nulada was 21 years old when she gave birth to her 1st
child Jhaydie. A month later, she went back to Iloilo for vacation where she met kurei’s
father Mr. Rembrant Gayanoche in a charging station at a Passengers ship. Until they
exchange number and communication. 1 month after they became in relationship, where Mr.
Gayanoche consistently pursuing Mrs. Nulada. They decided to live together as common-law
spouse, and after a year, Kurei’s mother gave birth to her 2nd child which is Rancid. While,
during her pregnancy to “Oasis Kurei” she feels that Mr. Gayanoche change. Kurei’s father
did not go home for days, and he never brought Kurei’s mother to introduce to his family.

Eventually, at a very young age Kurei was separated with his father when he was only 1 year
old, Mrs. Nulada asked for “sustento” support but it only lasted for 3 months. On the year
2009, Kurei’s mother went to Mindanao to work and to study NC2 in commercial cooking.
While, Kurei and his older brother Rancid was left in the presence of their grandparents. A
year after Mrs. Nulada went back to Iloilo together with her daughter Jhaydie. Year 2013
Kurei’s mother, meet Mr. Nulada, a tricycle driver. Mr. Nulada courted Kurei’s mother and
eventually they fell for each other. Their relationship lasted for almost 6 years after they
decided to get married March 14, 2019 at Oton, Iloilo.

The Child’s Community

The family once resides at Barangay Trapiche Villa Rica, Oton, Iloilo. At present they are
residing at at Barangay Trapiche, Sitio Tuburan, Oton, Iloilo where their neighbors are
mostly their family and relatives. The barangay has a total land area of 131 hectares 3.6 sq.
kilometers with total population of 6,232 as of 2021 and 1,541 household. It is 5.4 kilometers
from the town proper. Tricycle and jeepney are means of their transportation. The people are
mostly engaged in fishing and rice farming. Beach Resorts such as; Villa Rica and River side
are located at this barangay.

The barangay has a Barangay Hall, Day Care Center, and Health Station.

VI. Evaluation and Recommendation

This is a case of a child in conflict with the law named OASIS KUREI LEGARDE PD
1602 (Poker and Pusoy)

In view thereof the undersigned recommends for diversion acted with discernment.
