Eligibility criteria 1. the project is Federal funded; 2, there must be a request from the contractor, 3. approval is on a case-to-case basis and the contract was awarded on open tender basis; 4. the cut-off dates for incligibility to be considered are:- (@) Contracts awarded upon tenders closing after 01.03.2006 (unless there : is evidence of another substantial increase) v (b) Contracts awarded earlier and certified completed on or before . 30.06.2006; 1 Mechanism to effect agreement to reimburse After initial approval by the Director of Public Works Sarawak, and subject to the contractor's agreement of the following conditions, the mechanism to calculate the quantum payable shall be as follows: (@) the contractor is to submit the quantities for bitumen and diesel and the months they were expended; (b) the contractor shall provide receipts/payment vouchers for inspection as proof of expenditure; (©) these quantities shall be confirmed by the Engineer/S.O. under the contract; (@) the base price (as all other monthly prices to be used for this exercise) shall be as per Department of Statistics, duly endorsed by our Department, and for the month the tender closed; (e) the price for the month of delivery shall be used to calculate the difference in price and, except where there is delay the price for the months in delay shall be compared with that of the month of the scheduled completion date or extended date and the lower is to be used; lation of the maximum quantity for variation in price shall be decided by the Department (i.e. the lesser of the calculated quantity as compared with the delivered quantity shall be used to calculate the price variation): (g) Bitumen (to be calculated from the net asphaltic concrete volume as per contract documents). ~ACW20 4.5% Aww iy eo % -ACB28 ~44- 4.5 z (i) Diesel — to be confined to that used in the machinery for clearing, earthwork, aggregates and pavement laying and bridge work (whichever is applicable in the contract). On site asphalt plant shall bbe considered. The number and type of machinery shall be based on site records or accepted criteria (see Jadual A — B attached) as decided by the Engineer, whichever is the lesser. TI Other Criteria (the contractor must also agree to these in writing): 1. no other claims arising from this shall be allowed. 2. in the event of an ex-gratia or other payment for similar reasons by the Government of Malaysia in the future, the sum paid here shall be set off against it, except that there shall be no deduction if that ex-gratia or other amount payable is less then what had been paid (j.e. there shall be no payment for that future exercise). 3. this amount to be paid shall be subject to fund availability. 4, a supplementary agreement to be signed by both parties to effect the above, after fund is confirmed available.
