Plaint under Order VII Rule 1 with regard to Compensation for Defamation

The plaintiff humbly states that:

1. The present suit is filed in order to claim compensation for the defamation caused by
the Sindhu News Agency along with their managing director and chief editor Sri
Nageshwar Rao, (hereinafter referred to as the defendant) against Mr. B.
Satyendra the MLA of the Chiviliana constituency(hereinafter referred to as the
plaintiff).
2. The plaintiff humbly states that Mr. B. Satyendra is the S/O Mr. B. V. Reddy aged 61
years, and is occupied in the business of real estate.

The advocate for the plaintiff is K V Srujana

3. The plaintiff humbly states that Mr. Sri Nageshwar Rao, is the son of Mr. Venkat
Rao, who is 59 years old and is the C.O.O of ACB Pvt ltd.

The advocate for the defendant is V. Kumar

4. The Plaintiff is the MLA of The of the Chivilia constituency. The government of
Indiana granted Rs.1 crore for the development of the constituency under the charge
of the Plaintiff on 5.01.2022.
5. The defendant is the managing director and chief editor of Sindhu news Agency who
publishes a Daily newspaper called the Sindhu daily news.

6. On 05.04.2022 the defendant publicly accused the plaintiff of misappropriating the


amount allotted by the government for the development of his constituency in his
daily newspaper, this has caused immense harm to the reputation of the plaintiff.
7. Plaintiff had approached the defendant on 06.04.2022, in order to discuss the same
and requested the defendant to issue a public apology in their daily newspaper and
deny the accusations made against him.
8. The defendant had agreed to do so to plaintiff but did not issue a notice of the same in
their newspaper the following day.
9. The plaintiff proceeded to issue a legal notice to the defendant on 08.04.2022, to
which he received no response. (the legal notice has been attached at the end as issue
1)
10. The plaintiff submits that the cause of action arose at the constituency of Chiviliana
on 05.04.2022, and hence the hon’ble court has the jurisdiction to try the matter.
11. The plaintiff humbly submits that since the nature of the suit is civil, the court has the
jurisdiction to entertain the suit. The particular matter is situated in the chiviliana
constituency, and therefore it falls within the territorial jurisdiction of the hon’ble
court.

Prayer

Hence, the plaintiff prays that this Hon'ble Court may be pleased to decree the suit as follows:

1) To pass a decree in favour of the plaintiff, against the defendant, directing to


defendant.

2) Declare and adjudicate the defendant for the defamation of the plaintiff and take the
required steps to undo the damage done to the reputation.

3) And any other reliefs that the court may deem fit in favour of the plaintiff in the
interest of justice, equity and good conscience.
