What I have Learned in Environmental Law

According to the book the Natural resources are substances that are found
naturally without any engagement from human beings. There are different kinds of
natural remedies all over the world, like magnetic, forces, gravitational, etc. In our Earth,
there are natural resources like land, water, plants, animals, air, minerals, etc. Natural
remedies can be found in different forms. It can be found as non-living things like
minerals, air, water, etc. These are called abiotic resources. Living things like animals
and plants are also natural resources. These are called biotic resources.

Law on Natural Resources and Rules of Procedure for Environmental Cases is


very interesting subject for the protection and preservation of the environment is one of
the most important issues facing humankind today. I learned that our environment and
life are interrelated. Our lives depend on natural resources such as air, water, and land.
Environmental destruction threatens survival conversely, human violations can cause
environmental degradation, for instance, war can lead to loss of access to clean water.
Thus, the quality of environment is undeniably related to our enjoyment of the right to
life. Because of this interrelationship, environmental and human rights advocates have
pushed for the extension of the right to address environmental harm.

In this specific, I have learned that there was an overwhelming sentiment in the
convention in favor of the principle of the state ownership of natural resources and the
adoption of the Regalian doctrine. The State ownership of natural resources was seen
as a necessary starting point to secure recognition of the state’s power to control their
disposition, exploitation, development or utilization. I Have also learned that the
Regalian doctrine was embodied in the 1935 Constitution in Section 1 of the Article XIII
on Conservation and Utilization of Natural Resources. We also discussed about the
Public Land act and was enacted on November 7, 1936. The Public Land act provisions
apply to lands of the Public domain but timber and mineral lands are governed by
special laws. Land has its classification, I learned that government lands are classified
in a number of ways; they may be land of public domain, either alienable or inalienable,
or lands of the private domain which refer to land belonging to and owned by the state
as a private individual without being devoted for public use, public service or the
development of national wealth similar to patrimonial properties of the state.

We humans are using natural resources endlessly day by day. The population
explosion is causing over exploitation of natural resources with little or no care to
conserving them. To meet this massive population, depletion of natural resources is
happening. However, we need to understand that natural resources are finite. Even
renewable resources are not being given enough time to replenish. Thus, one can even
wonder what the condition of non-renewable resources might be. Therefore, this
depletion of natural resources is quite harmful to the earth and its inhabitants. Natural
resources are a present for the creation. These help in satisfying the human needs to its
fullest. Furthermore, the rational use of natural resources maintains the earth’s
atmosphere. Also, the wise use leads to protection of bio-diversity. Humans cannot
imagine their lives without natural resources. Thus, the conservation of the same is
essential.
