January 05, 2022 at about 10: 00 in
the evening at Purok 27-A Sitio New
Corella,
Poblacion, Makilala, North Cotabato
II. BRIEF FACTS OF THE CASE
1. The victim was identified as
Marlo Bangot, 22 years old, resident
of Brgy.
Concepcion, Makilala, North
Cotabato.
2. The victim was enjoying a
drinking spree with four (4) other
people at the
suspect's residence, which was
located at the above-mentioned
location,
according to the first inquiry. After a
few moments, the victim left the
group
and went to a neighboring
lavatory. At the same time, one of
the group
members, Albert Duldulao, 22,
pretended to contact someone
on his
smartphone while, in reality, he
was discreetly following the victim
to the
lavatory.
3. The suspect abruptly grasped the
victim's neck and choked him,
resulting in
his death. To conceal the crime, the
suspect put a rope around the
victim's
neck and hanged him, implying that
he had committed himself.
4. After a thorough investigation,
one of the witnesses, Albert
Villarosa, who
was also a participant in the drinking
spree, reported the incident and
signed
an affidavit stating that he
witnessed the crime taking
place since the
member left the drinking
session doubted because the two
were late in
returning to the venue, which led
him to follow the victim and the
suspect.
5. Upon the discovery, and
succeeding investigation, suspect
admitted having
killed the victim because of personal
grudge.
III. Status of the Case

arresting officer.

A. 37 years old, single, and a resident of Brgy. Gabuc, Pontevedra Capiz
3 SUSPECT: Jose Narciso y Gwapo 54 years old, single, high school level,
driver and a resident of Brgy. Ilaya Pontevedra Capiz, without Professional driver’s
License, driver of Ford Raptor color black, with plate no. IDB666 with engine no.
12345678 and chasis no. 7568476757 registered in the name of Melchor Basco y
Calipay of Brgy. Talisay, Ponteverdra Capiz with OR no. 45673899 and a CR no.
894371209435
4 BRIEF FACT OF THE CASE: On the above mentioned DTPI, a Utility
Vehicle Ford Raptor 4x4 driven by the suspect while on the motion coming from
Brgy. Tanza, Pontevedra Capiz bound to Roxas City Capiz and upon reaching the
portion of the national highway of Cogon, Pontevedra Capiz accidentally sideswipe
the victim beside the road. The victim was brought to St. Paul Hospital Medical
Treatment while the suspect was brought to Bailan District Hosptal. Vehicles
involved incurred considerable damages and presently at the custody of this station
for proper disposition.

SWORN STATEMENT
I, Juan Dela Cruz y Bacudo 67 years old, single, collge level, tricycle, and a
resident of Brgy. Guimbal, Pontevedra Capiz, state under aoth as follows:
PRELIMINARY STATEMENT

I am being questioned by PPSg Jenelyn Javier, Investigator of Pontevedra Police

Station, Pontevdra Capiz under the supervision of _________________________
the questions fully conscious that I do so under oath and may face criminal liability
for false testimony.
Q1. Could you please state your name, age, civil status, occupation and
address?
 A1. I, Juan Dela Cruz y Bacud 67 years old single, college level, tricycle and a
resident of Brgy. Guimbal, Pontevedra Capiz ( Ako si Juan Dela Cruz Bacud, 67
anyos ang edad, wala asawa kg pumoluyo sang Brgy. Guimbal, Pontevdedra
Capiz.)
Q2. Why are you here inside the Office of the Provincial Prosecutor of Capiz?

A2. To file a case against the suspect Jose Narciso y Gwapo ( Para
magpasaka kaso batok sa suspetsado nga si Jose Narciso y Gwapo.)
Q3. Do you remember where you were in the afternoon of May 15, 2022?
(Natandaan mo bala kon sa diin ikaw sadto nga hapon?)
Q4. Where were you o that evening? ( Sa diin ikaw sadto nga gab e?)
A4. On or about 2:50 of the afternoon of May 15, 2022 me and my live in
partner Teresita y Baskog were on the roadside beside the public market ( Sang
mga 2:50 ang takna sang hapon sang Mayo 15,2022 upod akon live in partner nga
si Teresita y Baskogsa kilid sang dalan sa Pontevedra Public Market.)
Q5. What happened next? ( Ano ang masunod nga natabo?)
A5. While we were walking, a fast Ford Raptor Pick up 4x4 headed in our
direction and sideswiped me and subsequently bumped into the electric post beside
the road. ( Samtang naga panglakaton kami ang madasig ng nagadalagan ng Ford
Raptor Pick up pakadto sa amon direction, nagsanggit sa akon kag nabunggo sa
poste nga ara sa kilid sang dalan.)
Q6. What happened next? ( Ano ang masunod nga natabo?)
A6. I was brought to St. Paul Hospital for medical treatment then I was
transferred to Capiz Doctors Hospital, Roxas City where my injuries on the right leg
was been operated and I was admitted for thirteen (13) days from May 15 to May 27,
2022. ( Gindala ako sa St. Pau; Hospital para mabulong ang akon tuo nga tiil kg
didto ako nagtinir sang trese (13) ka adlaw umpisa Mayo 15 asta Mayo 27,2022.)
Q7. Did you know the driver of the Ford Raptor Pick up that sideswiped you?
(Nakilala mo bala ang drayber sang Ford Raptor pick up nga nagsanggit sa imo?)
A7. Yes ma’am, I was informed by the police that the driver of Isuzu Ford
Raptor pick up was Jose Narciso y Gwapo a resident of Brgy. Ilaya Pontevedra,
Capiz. (Oo ma’am, ginsugiran ako sang pulis nga ang drayber sang Ford Raptor
Pick up nga nagsanggit sa akon amo si Jose Narciso y Gwapo ngs pumoluyo sang
Brgy. Ilaya, Pontevedra Capiz)
Q8. How much money did you spend on your medication? ( Pila ang imo
nagasto nga kwarta sa imo pagpabulong)
A8. I spent more or less two hundred thousand pesos (P200,000) for my
medication. ( Nakagasto ako sang masobra o makulang sa dosyentos mil pesos
(P200,000) sa pagpabulong)
 Q9. For now I have nothing more question to ask from you, do you have
something to add or to retract from statement? ( Sa subong wala na ako sang my
ipamangkot pa sa imo, may arak a pa nga buatng nga idugang o liwaton sa imo
panaysayon?)
