AFFIDAVIT OF UNDERTAKING

I, MARK VERNON C. DIOQUNO, Filipino, single, of legal age, and a resident of Lot 13 Blk 14,
Orchard C, Savannah Subdv., Abilay Norte, Oton, Iloilo, Owner of VOODOO GASTROPUB, a sole
proprietorship existing and operating under Philippine laws with office address at G/F Unit 14, City
Time Square, Benigno S. Aquino Ave., Iloilo City, after having been duly sworn in accordance with
law, hereby depose and state:

1. That VOODOO GASTROPUB is currently under the construction/renovation phase of its


operation;

2. That, pursuant to Section 1.4.7. of the Tenant Fit-Out Design and Construction Guidelines, the
Lessor, GOLDGIANTS PROPERTIES CORPORATION, requires herein Lessee or the latter’s
contractor to secure a Contractor’s All Risk Insurance Coverage (CARI) prior to the start of
any construction which would cover for any untoward incidents that may result in bodily injury
or damage to the Lessor or any third party, including other Lessee’s premises adjacent,
beside, above or below the leased premises for the duration of the construction;

3. That, GOLDGIANTS PROPERTIES CORPORATION, having considered the short duration


and minimal level of construction work to be conducted by the Lessee, deemed it proper to
waive the Contractor’s All Risk Insurance Coverage (CARI) subject to the execution of this
document;

4. That, in lieu of the waiver made by the Lessor, the Lessee in turn releases the latter from any
and/or all liabilities arising from the occurrence of any fortuitous events, accidents, or any
injury/damage to property arising out of the fault or negligence of the undersigned, his
contractor, or those working under the latter’s direct supervision;

5. That, in case of any untoward incident, the Lessee shall bear all expenses relative thereto,
including medical fees and/or charges for the repair or restoration of any damage to the
Lessor’s property or the other premises adjacent, besides, and/or above the leased premises;
and

6. That I am executing this affidavit to signify good faith, give due regard to the Lease
Agreement, and recompense for the consideration extended by the LESSOR.
