COMELEC OFFICERS AND DIVISION WHO WILL CONDUCT AND SIT IN

HEARINGS, AND RESOLVE CASES, ISSUES, OR CONTROVERSIES INVOLVING
OFFENSES COMMITTED BY POLITICAL PARTIES

WHEREAS, pursuant to Article VII, Section 6 of the Accountancy Student Council (ASC)
Constitution of 2017, the Commission shall have the power to legislate for the purpose of proper
conduct of all its functions.

WHEREAS, Section 7 Article VII of the ASC Constitution of 2017 provides that the COMELEC
may sit en banc or in divisions in resolving controversies filed before it and shall promulgate its
rules of procedure in order to expedite disposition of cases and ensure fair trial provided that
motions for reconsideration of cases resolved in division shall be decided by the COMELEC en
banc.

NOW THEREFORE, pursuant to its authority under the ASC Constitution of 2017 and the USEC
of 2011, the COMELEC RESOLVED, as it hereby RESOLVES, that the following officers will
compose the en banc and division who will be tasked to conduct and sit in the hearing and
resolution of cases, issues, or controversies filed before it.
1. Division. This shall be composed of officers in the Legal Division, to wit: the Chairperson,
Vice-Chairperson, Legal Head Officer, Secretary to the Adjudicatory, Associate Legal
Officer, and Associate Secretary to the Adjudicatory.

1.1.The division shall resolve cases, issues, or controversies involving minor offenses and
a first major offense committed by political parties in a given academic year. In case of
a deadlock or if no consensus by the majority has been reached, the en banc shall decide
the case.

1.2.For a hearing to take place, at least three officers of the Legal Division must be present
and preside over the hearing.

2. En Banc. This shall be composed of the Executive Board Officers and Auxiliary Officers
of the Commission, with the exception of the Central Representative and Senior Deputy –
Central Division.

2.1.The en banc shall resolve cases, issues, or controversies involving succeeding major
offenses committed by political parties and cases under the jurisdiction of the division
in which no consensus by the majority has been reached.

2.2.For the hearing to take place, at least ten (10) officers from the en banc must be present
and preside over the hearing.

Section 1. Separability Clause. – If any section or portion of this resolution is declared inconsistent,
in conflict, or contrary to the University policies, rules, and regulations, or local student council
constitution, other provisions shall remain valid.

Section 2. Repealing Clause. – All resolutions or part thereof, which are found inconsistent, in
conflict, or contrary to the provisions of this resolution, are hereby repealed, amended, and
modified accordingly.

Section 3. Effectivity. – These rules shall take effect immediately and will be in effectivity until
no new resolution or provision of the same matter is promulgated.
