a REPUBLIC OF THE PHILIPPINES City of Cebu OFFICE OF THE MAYOR EXECUTIVE ORDER NO._19-7 AN ORDER ESTABLISHING THE PREVENTION, RESTORATION, ORDER BEAUTIFICATION AND ENHANCEMENT (PROBE) TEAM UNDER THE OFFICE OF THE MAYOR WHEREAS, the city of Cebu is among the top tourist destination in the Philippines and it is the thrust of this administration to ensure that order is observed in the cit WHEREAS, the city is mindful of the mandates of Republic Act 9593 which declares the national policy for tourism as an engine of investment, employment, growth and national development; WHEREAS, likewise the city is cognizant of the directive under the DENR Administrative Order No. 99-21 promulgated for strict implementation of the provisions of R.A. No. 1273, Section 16 paragraphs 7 and 8 of P.D. No. 705 and Article 51 of P.D. No. 1067 that the three (3) meter easement for riverbank protection in urban areas shall be established within public and private lands; WHEREAS, in the interest of the general welfare of the inhabitants of the city, it is therefore incumbent upon the city government, as policy, to enforce all laws and ordinances that are purposely to prevent all forms of encroachments, to restore easements and property, like plazas and sidewalks that are beyond the commerce of men, to put order on streets and the city’s environs and to enhance the aesthetic aspect of the city. NOW THEREFORE, |, MICHAEL LOPEZ RAMA, City Mayor, by the powers vested in me by the law, do hereby order that; SECTION 1. This directive shall be known as the “ORDER ESTABLISHING THE PREVENTION, RESTORATION, ORDER, BEAUTIFICATION AND ENHANCEMENT (PROBE) TEAM UNDER THE OFFICE OF THE MAYOR" or for brevity shall be known as “PROBE TEAM". SECTION 2. There Shall be established a team under the Office of the Mayor which shall be called Office of the Prevention, Restoration, Order, Beautification, and Enhancement Team. This Office shall replace the Squatters Prevention Encroachment and Elimination Division (SPEED), All current personnel of the SPEED shall remain to perform as personnel of the PROBE TEAM. From time to time, personnel augmentation may be done from organic city hall ‘employees or by project based personnel (job order), A Team Leader shall be appointed and/or designated who shall supervise all personnel either organic or detailed to ensure the proper performance of their duties and responsibilities. SECTION 3. The PROBE TEAM shall have the following duties and responsibilities in exercise of the police power of the state; a. All duties and responsibilities of the previous office of the SPEED involving obstructions and illegal settlers;b. The enforcement of the provisions of law on the establishment of the three (3) meter easement for riverbank protection in urban areas within public and private lands; c. The enforcement, all throughout the city in coordination with the prohibition of sidewalk vending and of the occupation of sidewalks being beyond the commerce of men; d. The enforcement of the provisions of law on the prohibition of illegal squatting pursuant to the UDHA law in coordination with the DWUP on some areas of concern; fe. The enforcement of the national policy under RA 9593 that tourism as an engine of investment, employment, growth and national development in coordination with the Cebu City Tourism Office on areas of special concerns; f. The summary abatement of all nuisance in coordination with the Office of the Building Official, City Legal Office and other Government Offices; g The enforcement of all laws and ordinances that purposely to prevent all forms of encroachments, to restore easement and property that is beyond the commerce of men, to put order on the streets and the city’s environs, and to enhance the aesthetic aspect of the city; h. Other duties and responsibilities that may be required by law or ordinance, SECTION 4. All executive issuances, orders, rules and regulations or parts thereof Inconsistent with the provisions of the Executive Order are hereby repealed or modified accordingly; SECTION 5. This Executive Order shall take effect immediately upon issuance and shall remain effective until declared unconstitutional, contrary to law or otherwise revoked.
