JUDICIAL AFFIDAVIT

I, TRIS WHITE-GRAY, of legal age, Filipino, married


but separated-in-fact to TOBIAS LAZY GRAY, and a
resident Cotabato City after having been sworn to in
accordance with law, depose and state that:

PRELIMINARY STATEMENT

1. The statements were taken and recorded based on the


examination made by ATTY. NUFA ALYHA B. KALI
with office address at Glimada & Kali Law, P. Sherman,
42 Wallaby Way Sydney, Cotabato City and the taking
of the testimony of the is being held at the same
address;

2. The questions were propounded in English language


which I speak and understand; and,

3. I have answered the questions asked of me, fully


conscious that I am doing so under oath, and that I
may face criminal liability for false testimony and
perjury.

PURPOSES OF THE AFFIDAVIT

This Judicial Affidavit is offered pursuant to


Administrative Matter No. 12-8-8-SC, for the following
purposes:

1. To constitute as the direct testimony in court of Tris


White-Gray, the petitioner in the civil case for
Annulment of Marriage against his husband, Tobias
Gray;

2. To prove that she is eighteen (18) years old at the time


that their marriage was solemnized and that the same
was made without parental consent under the New Civil
Code;

3. To prove that her consent was obtained by his husband


through of force, intimidation or undue influence under
the New Civil Code; and,

4. To identify and testify on relevant and material


documents as well as to prove other relevant matters.

The questions asked of me and my corresponding answers


thereto, consecutively numbered, are the following:

(1) Do you swear to tell the truth and


nothing but the truth?

ANSWER (A): Yes, Ma’am.

(2) Can you state your name, age,


address and other information?

A: I am Tris White-Gray, 24 years old,


Filipino, married but separated-in-fact to Tobias
Gray, and a resident of 120 Homes, Cotabato City;

(3) Do you have any proof that you are a


resident of 120 Homes, Cotabato City?

A: Ma’am, I have here my Barangay ID, a


proof of billing from Cotabato Light and Globe
Telecom., and Sworn Barangay Certificate with
house sketch issued by our Punong Barangay.

(4) I received from you a copy of your


Barangay ID bearing ID No. 03-2316, proof

Telecom, and a sworn barangay certificate,
which I will mark as Annex “A”, “B”, “C” and
“D”, respectively, do you confirm?

A: Yes, ma’am.

proof of billings from Cotabato Light and Power
Company and Globe Telecom, marked as Annex

barangay as Annex “D.”]

(5) What brings you to this office?

A: I am here to give my testimony/ affidavit


with regard to my Petition for Annulment of
Marriage against my husband, Tobias Gray;

(6) Who is this Tobias Gray? Can you


please state his personal circumstances?

A: Tobias Gray is my husband, we were


married to each other but separated-in-fact, and
he presently resides in Parang, Maguindanao;

(7) What is your proof that you are


indeed married to Tobias Gray?

A: I have here the original copy of our


Marriage Contract issued by the Office of the Civil
Registrar;

(8) I received from you a Marriage


Contract consisting of one (1) page between
Tris White-Gray and Tobias Gray dated March
23, 2016, which I will mark as Annex “E”, do
you confirm?

A: Yes, Maam.

(9) When and where were you married


and how long?

A: We were married on February 17, 2016, at


the Municipal Trial Court in Cities – Cotabato City
before the acting Municipal Trial Court Judge, Hon.
Jon Snow.

We were married for six (6) years and a


month ma’am to be exact, however we were living
separately long after our child was born in 2019;

(10) Do you have children? What are


their names and ages, if any?

A: Yes, Ma’am. We only have one child. He is


Bjorn Gray, two (2) years old, born on July 3,
2019 in Cotabato City.

(11) Do you have any documents for this


purpose?

A: Yes, Ma’am. I have here the copy of the


Birth Certificate of our Child issued by the Local
Civil Registry.

(12) I received here a copy of the


Certificate of Live Birth in the name of Bjorn
Gray, which I will mark as Annex “F”, do you
confirm?

A: Yes, Ma’am.

(13) What happened between you and


your husband that led you to the filing of this
case?

A: I never wanted to get married at first


place but we tried to. However, we never came up
with agreement and everything else is never
mutual between us. That is aside from the fact
that we’ve been living separately since 2019;

(14) What do you think is the reason


why your marriage failed?

A: Perhaps because we were never meant to


get married in the first place;

(15) Why? What are the circumstances


before your marriage that made you say
that?

A: We’ve known each other long before we


got married as he was my school mate in our
University. He was persistent and constant when
he was courting me. He was romantic and he was
the man that a teenager girl could ever wish for.

I fall for his words and his ways, so we


dated. We were dating as a boyfriend and

girlfriend and has been so affectionate. He always


asks me if we could get married as soon as
possible and if we can start a family early.
However, I always refuse to his offer mainly
because of our age – we are still young;

(16) What happened next?

A: It was our anniversary on February 17,


2016, the same day we got married. He set me up
and made me fall into a trap clothed with surprise.
He made his friend fetch me who asked me if I
could go with him to visit him and his friend who
he said is working from Court. They made/
orchestrated an arranged civil wedding;

(17) What was your reaction/ response


at that time?

A: I was surprised, frightened and at the


same time shy. My parents did not know what I
got into and I could not do anything but to go
through the situation.

I am still a teenager back then, I never know


this could be the consequences of my actions.
Perhaps, if I wasn’t frightened enough with the
situation at hand or say If I was brave enough to
refuse to get intimidated or influenced, then
maybe this never happened at all;

(18) You said that your parents didn’t


know that you got married, am I correct?

A: Yes, ma’am. They didn’t know about it as


I have said earlier, I was set-up into a trap by my
husband. Our marriage came into their knowledge
after we were solemnized and that was when I got
home after the event. There, I told them what
happened;

(19) What was the reaction of your


parents?

A: They never consented about it, they never


believed me, and they were very angry.

They were shock, which I understood, for


whose reasonable teenager would go home with a
news that she just got married.

I tried to make them understand that I was


set-up, but to no avail. They thought that I did
things on purpose and instead made me leave our
home. Nonetheless, I tried to reconcile with them;

(20) What happened next?

A: We tried to make up things like a normal


couple, although my parents never consented with
the same. Then, Bjorn came into our life.

(21) What happened during your


marriage?

A: Not long after, we frequently get into


fights, we disagree on almost everything and we
blame each other.

I blame him mainly because of how I got into


this situation – situation I never wanted for
although I love him, I am still young, and fragile
and still want to do things. I never expected those
things to happen that fast, but I tried.

It wasn’t enough for him, so he blame me for


not trying, that I was doing wrong and that I
always fall short;

(22) What happened next?

A: I tried to confront him because I thought


maybe something is really wrong with me as well
us to save our relationship, but we never came up
into agreement, instead, he left me;

(23) What happened after?

A: We live separately since that 2019 – three


(3) years now, more or less. We only talk when I
ask for our child’s financial support or when
circumstances needs his approval such as school
matters and the likes;

(24) Is there any chance of


reconciliation between the both of you?

A: No more, Ma’am. I don’t see a future for


the two of us.

I never wanted it in the first place and maybe


as per him also. Maybe because we were blinded
by the thought that marriage will make our love
last forever or maybe he was just so indecisive
that he have done things which is hard to be
undone and maybe I’m just too naïve to refuse or
too intimidated to act accordingly;

(25) What is your prayer then?

A: I am praying for this Court to grant my


petition for annulment against Tobias Gray, Ma’am
and I likewise propose that the welfare and
support of our child be taken in to consideration
especially that our child is still a minor;

(26) I don’t have any more question but


do you still have anything to say?

A: Nothing for now, Ma’am.
