LAW OF CRIMES — II (CODE OF CRIMINAL PROCEDURE
INCLUDING JUVENILE JUSTICE CARE AND PROTECTION ACT
AND PROBATION OF OFFENDERS ACT)

PART A — (2 × 12 = 24 marks)
Answer TWO of the following in about 500 words each.

1. State the circumstances when a police officer can arrest a person


without warrant and the procedure to be followed.

2. State the sentences which may be passed by the different courts having
criminal jurisdiction under the Code of Criminal Procedure.

3. Explain the nature and scope of the provisions of Cr.P.C. to provide


maintenance to wife, children and parents. Under which circumstances
maintenance once granted could be altered?

PART B — (2  7 = 14 marks)

Answer TWO of the following in about 300 words each.

4. What is proclamation and attachment.

5. Explain the procedure for trial of a case before the Sessions Court.

6. Discuss the jurisdiction conferred on Juvenile Justice Board. Discuss its
power to release one on admonition or on probation of good conduct.

Answer TWO of the following by referring to the relevant provisions of law
and decided cases. Give cogent reasons.

8. ‘A’ is accused of theft on one occasion and causing grievous hurt on


another occasion. Can ‘A’ be charged and tried together in one trial?

9. The executive magistrate initiates proceedings against two hostile


groups under Section 107 of Cr.P.C. The hostile parties proceeded
against are bound over in the same proceedings. Decide the legality of
exercise of the power by the executive magistrate.

10. The Judicial Magistrate commits a criminal case for trial before a
Sessions Court. Which court now has the jurisdiction and power to
tender pardon to the accused?
