CIVIL PROCEDURE CODE

Time : 2 12 hours Maximum : 70 marks

PART A — (2 × 12 = 24 marks)

Answer TWO of the following in about 500 words each.

1. Discuss the provisions relating to computation of period of limitation.

2. ―An executing court cannot go beyond the decision of a trial court‖ –


Explain. State the exceptions if any.

3. Explain the provision relating to pleading and when such pleading can
be struck out by the court – Discuss.

PART B — (2  7 = 14 marks)

Answer TWO of the following in about 300 words each.

4. Narrate under which circumstances a temporary injunction can be


granted by the court.

5. State the procedure to be adopted in a suit filed by the plaintiff as


indigent person.

6. When can a matter be res judicata between co-defendants? Distinguish
between res judicata and estoppel.

7. Write short notes on FIVE of the following :

Answer TWO of the following by referring to the relevant provisions of law


and decided cases. Give cogent reasons.

8. Raman files a suit against Krishnan for recovery of Rs. 5 lakhs upon a
promissory note. Due to official work, Krishnan fails to be present in the
court to give evidence. An Ex parte decree was passed against him.
Decide.

9. A Decree was passed by a trial court. The Decree Holder died.


Subsequently, the judgement debtor filed an appeal against that decree.
Decide.

10. ‗A‘ advances loan of Rs. 2,200 to ‗B‘, to bring a suit within the
jurisdiction of court ‗X‘. ‗A‘ sues B for Rs. 2,000/- only. Whether ‗A‘ can
sue for Rs. 200 afterwards?
