Family violence in Argentina

What is family violence in Argentina according to their


laws?
Law 24,417 on protection against family violence defines family violence as
that exercised against any member of a family group within that scope. “Any
person who suffers injuries or physical or mental abuse by any of the members
of the family group may denounce these facts verbally or in writing before the
judge with jurisdiction in family matters and request related precautionary
measures. For the purposes of this law, family group is understood to be
originating from marriage or de facto unions.”
For Law 26,485, domestic violence is classified within a form of violence
against the woman. Thus, "domestic violence against women" is that exercised
against women by a member of the family group, regardless of the physical
space where it occurs, that damages the dignity, well-being, physical,
psychological, sexual, economic or patrimonial integrity, the freedom,
including reproductive freedom and the right to full development of women. I
know understands by family group that originated in the kinship either by
consanguinity or by affinity, the marriage, de facto unions and couples or
courtships. Includes existing relationships completed, coexistence not being a
requirement.

What institutions offer protection services against


family violence in Argentina?
.DEMUNA protects, promotes, cares for and monitors compliance with rights
human rights of boys, girls and teenagers
. The CEM attends cases of family violence and sexual, provides legal advice,
defense judicial and psychological counseling
. The PNP is responsible for providing protection immediate and guarantees
compliance with the law for the sake of our safety or the people of our
environment

"VICTIM AGAINST VIOLENCE" PROGRAM OF


THE MINISTRYOF JUSTICE OF THE NATION
The Program aims to care, accompany and assist victims of family and sexual
violence. It is in the orbit of the Ministry of Justice of the Nation. It is in
charge of the Mobile Assistance Brigade for Victims of Family Violence,
which is person in charge of the 137 assistance line for family violence and
who has a cell phone that can move to the place where the victim is if
necessary.
The Brigade is made up of an interdisciplinary team of lawyers, psychologists
and social workers.
The data presented in this document is the result of the analysis of reports
statistics provided by the “Victims against violence” Program.
In Graph 1 we present the number of victims attended between 2007 and 2013
in all the services offered by the Mobile Assistance Brigade for Victims of
Violence. According to data, the Program has assisted 19,706 victims.

Family violence facts


It emerges as a clear common denominator that adult women are the main
victims of domestic violence. Mobile Brigade for Attention to Victims of
Violence Family and the Office of Domestic Violence also reflect a high
percentage of minors old victims of violence.
Another common denominator is that physical and psychological violence are
the most common modalities of domestic violence. Likewise, this violence is
exercised by men who have or had any emotional attachment to the victim

Conclusions
On the basis of what information are measures aimed at improve the
situation of women victims of family violence?
1. In Argentina, there are no unified records on family violence that allow
systematize the varied information provided by the different organizations and
services specialized. This happens at the local level and at the national level.

2. In each jurisdiction, rules of a different nature and for specific purposes


coexist (comprehensive regulations, civil and criminal procedures), which
requires knowledge advanced to identify, record and systematize information
linked to the domestic violence.

3. On the other hand, there are also regulations that provide for the
intervention of different institutions of social services, consultations, advice,
etc, which brings with it the need to coordinate the actions of these bodies and
the need to take into Note that victims of violence can access one or more of
these services. Thus, it is not known exactly if the data published by the
different organizations is not superimpose the accounting of assisted victims.

4. In Argentina there are no regular victimization surveys that can estimate the
actual number of victims of domestic violence. The total number of acts of
violence against women that occur in a society can only be estimated from of
representative surveys applied to the population in general, since many of
These facts will never be denounced by their victims. Thus, in the City of
Buenos Aires, the number of acts of domestic violence prosecuted is known,
but not the number of facts that exist but are left out of this system can be
estimated.

family violence in Latin America, almost no Central American and Caribbean
countries appear in the graph, because in those countries is where there is
more family violence within Latin America.
