MOST RESPECTFULLY SUBMITTED AS UNDER:-

1. That the captioned matter is pending adjudication before this

Hon’ble Court and is now fixed for further proceedings today
i.e. on xxxxxxxxx.

2. That the Hon’ble Forum was pleased to issue notice to the

Defendants on 05.08.2019 subsequent to which the Plaintiff
had sent the copy of plaint through Registered Post to the
Defendant on 09.08.2019. That the notice sent to the D1 has
been received back with the remark as “LEFT”. The sealed
copy of the envelope received by the Plaintiff is annexed and
marked herewith as ANNEXURE-A/1.

3. That after making great efforts the Plaintiff has retrieved the
fresh alternate address of the Defendant No. 1 as through the
Master Data of the D1 company retrieved through the website
of Ministry of Corporate Affairs. The Copy of the Master Data of
 the D1 as retrieved through the website of Ministry of Corporate
Affairs is annexed and marked herewith as ANNEXURE-A/2.

4. That for the expeditious proceedings and as the matter of

abundant precaution the Plaintiff has even sent an E-Mail dated
13.09.2019 to the D-1 for appearance before the Hon’ble Court.
That the said E-Mail has not bounced back. The Copy of the E-
Mail sent to the D1 is annexed and marked herewith as
ANNEXURE-A/3.

5. That the notices issued to the D2 has been duly served as per
the tracking report of the postal receipt. The copy of the
tracking report is annexed and marked herewith as
ANNEXURE-A/4. The Plaintiff is also filing the amended
memo of parties which is annexed and marked herewith as
ANNEXURE-A/5.

6. That in view of the circumstances of the present case the

Plaintiff may kindly be allowed to serve the D-1 at the address
mentioned above.

PRAYER

In light of the above-mentioned facts and circumstances of the

present case, it is therefore most respectfully prayed that this Hon’ble
Court may kindly be pleased to issue summons/notices of the Suit to
the Defendant No. 1 on the above-mentioned address.
 Pass further order(s) as the forum deems fit and just in the
interest of justice.
