Ltd., through its Director Shri Ajay Sharma, having its registered office at 203, IInd Floor, 4575/15, Onkar House, Daryaganj, New Delhi-110 002, I hereby serve upon you with following notice: That upon consideration you had issued a cheque bearing No.047590 dated 26.09.2013 for Rs.35,00,000/- (Rupees Thirty Five Lacs) drawn on Federal Bank, Meerut, U.P. to my client and at the time of issuance of the aforesaid cheque you had assured to my client about its encashment on presentation. That as per your assurance, my client presented the aforesaid cheque with his banker at Allahabad Bank, Chandni Chowk Branch, Delhi-6, but the same was bounced and was returned by the bankers of my client vide cheque retuming memo dated 28.09.2016 for the reason “Funds Insufficient . That thereafter, my client tried to contact you upon number of times, but you started avoiding taking the phone calls of my client on one pretext or the other and it seems that you are avoiding the payment of the aforesaid cheque. That your above said act and conduct makes it abundantly clear that you have issued the above cheque with malafide interitioti and ulterior motives of playitig fraud upon my client and also to cheat him aknowing full thereby ce, om on Presentation the same shall be dishonoured Gen Blut gain to yourself and wrongful loss to my That indel tenets of your above act, you are liable to be prosecuted ee 138 of the Negotiable Instruments Act, 1881, as nded from time to time and section 420 IPC. ; In the light of the above facts and circumstances, my client have instructed me to call upon you, which hereby I do, to pay within 15 days from the date of receipt of this notice, the aforesaid cheque amount of Rs.35,00,000/- (Rupees Thirty Five Lacs) along with Rs.22000/-towards the legal notice charges, failing which I have full instructions from my client to initiate the criminal as well as Civil Proceedings against you at your risk, cost and consequences.
