NUMBER: 31 YEAR 2009 ON ELECTRICITY PURCHASE PRICE BY PT. PLN (PERSERO) FROM SMALL AND MEDIUM SCALE POWER PLANT THAT USES RENEWABLE ENERGY OR EXCESS OF ELECTRICITY BY THE GRACE OF GOD ALMIGHTY MINISTER OF ENERGY AND MINERAL RESOURCES, Considering: a. that the participation of state-owned enterprises, local-owned enterprises, private enterprises, cooperatives, and community self-reliance for the supply of electricity has a very important role in improving national electricity supply capabilities; b. that in order to encourage the purchase of electricity from small and medium -scale power plant using renewable energy or electricity excess (excess power) from state-owned enterprises, local-owned enterprises, private enterprises, cooperatives, and community self-reliance by PT. PLN (Persero), pricing of electricity purchase is necessary; c. that based on the considerations referred to in letters a and b, it is necessary to stipulate Regulation of the Minister of Energy and Mineral Resources of Electricity Purchase Price By PT. PLN (Persero) From Small and Medium -Scale Power Plant that Uses Renewable Energy Or Electricity Excess; Given: 1. Act No. 30 Year 2007 on Energy (State Gazette Year 2007 Number 96, State Gazette Supplement Number 4746); 2. Act No. 30 Year 2009 on Electricity (State Gazette Year 2009 Number 133, State Gazette Supplement Number 5052); 3. Government Regulation No. 10 Year 1989 on Electricity Provision and Utilization (State Gazette Year 1989 Number 24, State Gazette Supplement Number 3394) as has been amended twice, last amended by Government Regulation Number 26 Year 2006 (State Gazette Year 2006 Number 56, State Gazette Supplement Number 4628); 4. Presidential Decree No. 84/P Year 2009 dated October 21, 2009; 5. Regulation of the Minister of Energy and Mineral Resources No. 0030 Year 2005 dated July 20, 2005 on Organization and Work of the Ministry of Energy and Mineral Resources;

DECIDED: Stipulate: ELECTRICITY PURCHASE PRICE BY PT. PLN (PERSERO) FROM SMALL AND MEDIUM SCALE POWER PLANT THAT USES RENEWABLE ENERGY OR ELECTRICITY EXCESS. Article 1 (1) PT. PLN (Persero) must purchase electricity from small and medium -scale power plant that uses renewable energy with capacity up to 10 MW or electricity excess (excess power) from state-owned enterprises, localowned enterprises, private enterprises, cooperatives, and community selfreliance to strengthen the local electricity supply system. (2) The purchase of electricity excess (excess power) as referred to paragraph (1) can be larger than self-used electricity. Article 2 (1) The electricity purchase price as referred to Article 1 defined as follows: a. Rp 656/kWh x F, when interconnected to Medium Voltage; b. Rp 1,004/kWh x F, when interconnected to Low Voltage. (2) F as referred to paragraph (1) is the incentive factor according to the location of the electricity purchase by PT. PLN (Persero) with the amount as follows: a. Java and Bali Area, F = 1; b. Sumatera and Sulawesi Area, F = 1.2; c. Kalimantan, Nusa Tenggara Barat and Nusa Tenggara Timur, F = I.3; d. Maluku and Papua, F = 1.5. Article 3 (1) The electricity purchase price as referred to Article 2 is used in a contract of electricity sale from small and medium -scale power plant that uses renewable energy without price negotiation and approval from the Minister of Energy and Mineral Resources. (2) The electricity purchase price as referred to Article 2 is used in a contract of electricity sale from electricity excess (excess power) without price negotiation and approval from the Minister of Energy and Mineral Resources, Governor, or Regent/Major within their authority.

Article 4 (1) PT. PLN (Persero) can purchase electricity from small and medium scale power plant that uses renewable energy of state-owned enterprises, local-owned enterprises, private enterprises, cooperatives, and community self-reliance with the price exceeds the price referred to Article 2. (2) The electricity purchase referred to paragraph (1) is based on PT. PLN (Persero) Self-estimated Price (Harga Perkiraan Sendiri/HPS) and shall obtain the approval of the Minister of Energy and Mineral Resources. Article 5 To speed up the electricity sale process referred to Article 1, PT. PLN (Persero) must create a contract standard of electricity sale. Article 6 At this Regulation of the Minister comes into force, the provisions set on the highest reference price and electricity purchase price agreements for the electricity purchase that uses renewable energy sources with capacity up to 10 MW as stipulated in the Regulation of the Minister of Energy and Resources Mineral Resources No. 05 Year 2009 on Guidelines for Electricity Purchase Price By PT. PLN (Persero) From the Cooperative and Other Business Entities, revoked and declared invalid. Article 7 This Regulation of the Minister shall come into force on the date of enactment.
