PETITION
(Under section 43B of the Children Act Cap 59 as amended and section 98 of the Civil
Procedure Act, Cap 71)
The petition of DEO MUKAMA and MARIA MUKAMA of Mpoma, Mukono district states
as follows:
1. That the Petitioners are desirous of obtaining legal guardianship of the child Miranda
Mukama in order to deal with her property comprised in Kyagwe Block 200, Plot 278.
2. That the Petitioners are citizens of Uganda resident at Mpoma, Mukono district.
3. That the Petitioners are the biological parent of the Miranda Mukama (the child
hereinafter).
4. That the Petitioners do not not have any criminal record in Uganda or any other
country.
5. That the Petitioners are above the age of eighteen years.
6. That the Petitioners affirm that a guardianship order made by this Honorable Court
shall be in the best interest of the child
7. That the Petitioners propose to bear the costs of this petition.
WHEREFORE, the Petitioners pray that;
a) An order of legal guardianship be issued permitting them to deal with the land of
Miranda Mukama comprised in Kyaggwe Block 200, Plot 278.
b) The Court make any other orders as it may deem fit.
c) The Petitioners bear the costs of this application.

AFFIDAVIT VERIFYING PETITION
I, DEO MUKAMA C/o M/s Tassaga & Co. Advocates, Suite 3, First Floor, Millennium
Building, Plot 20 Mukono- Jinja Road do solemnly swear and state on oath as follows:
1. That I am a male adult Ugandan of sound mind, the first petitioner in this matter and I
depone this affidavit in that capacity.
2. That I am the biological father of the Miranda Mukama (the child). (The child’s Birth
Certificate is hereto attached marked Annexure “A”).
3. That neither I nor the child’s mother, the second petitioner in the matter has any
criminal record. (Certificates of Good Conduct for the Petitioners from Interporl are
hereto attached collectively marked Annexure B).
4. That both Petitioners are above the age of eighteen years. (Copies of the Petitioners’
National I.Ds are hereto attached collectively marked Annexure C).
5. That this affidavit is in support of the petition seeking for legal guardianship to enable
the Petitioners deal with the child’s land comprised in Kyaggwe Block 200, Plot 278.
(A copy of the certificate of title is hereto attached marked Annexure D).
6. That I affirm that a guardianship order made by this Honorable Court shall be used in
the best interest of the child.
7. That whatever is stated hereinabove is correct to the best of my knowledge.

ORDER
This application is coming up this 22nd day of April, 2022 for final disposal before His
Lordship Winston Ruhayana the learned Judge of the High Court in the presence of Mr. Isaac
Kwagala, counsel for the Petitioners and in the presence of the Petitioners.

Having read the petition, the annexures thereto, and having heard from the petitioners. And
the Court having satisfied itself that the petition is in the best interest of the child.

IT IS HEREBY ordered that;

a) An order of guardianship of Miranda Mukama (Minor) is hereby granted to Deo

Mukama and Maria Mukama her biological parents.
b) The parents are hereby allowed to dispose of the minor’s land to Uganda National
Roads Authority, to claim and obtain compensation money on behalf of the Minor.
c) The petitioners shall use the proceeds therefrom in the best interest of the Minor.
d) The Petitioners shall bear the costs of this application
